HomeMy WebLinkAbout1633-84 - ADMIN Ordinance - City Council - 1984/10/15ORDINANCE NO. 1633-84 AN ORDINANCE ESTABLISHING LAND USE CONTROLS IN REDEVELOPMENT DISTRICTS THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 15-600. Title. This ordinance shall be known, cited and referred to as the "St. Louis Park Land Use Controls—Redevelopment District Ordinance", except as referred to herein, where it shall be known as "this ordinance". Section 15-601. Purpose and Intent. St. Louis Park is faced with the problem of providing a sound and fair means for guiding and controlling development and redevelopment of land and buildings in designated redevelopment districts. The City hereby establishes this ordinance for, the purpose of aiding and cooperating in the fulfillment of redevelopment and financial planning by the Authority and other City agencies, undertaking construction or development of property or buildings located in projects designated by the Authority as redevelopment projects and for the purpose of providing a procedure for implementation of redevelopment plans and objectives. Section 15-602. Definitions. The following definitions shall apply in the interpretation and enforcement of this ordinance, and the following words and terms whenever they occur in this ordinance are defined as follows: 1. "Urban Renewal Plan or Redevelopment Plan" means a plan approved by the Housing and Redevelopment Authority and the City Council, which plan provides an outline for the development or redevelopment of a designated redevelopment district and indicates general land uses and general standards of development and redevelopment and includes provisions for financing. 2. "Housing and Redevelopment Authority or Authority" means the Housing and Redevelopment Authority of St. Louis Park, Minnesota. Section 15-603. Effect. After a Redevelopment Plan has been adopted by the Authority and City Council, the issuance of building permits by the City for property located within the designated redevelopment district shall be subject to the provisions of this ordinance. The City officer responsible for issuing building permits shall not approve such applications for permits in excess of $5,000 during a 12 month period to expand an existing building or structure or to establish new buildings or structures; nor shall any new uses of land within the boundaries of a redevelopment project covered by a Redevelopment Plan be approved unless the Authority has adopted a resolution finding that the proposed expansion, new structures and/or new land use is consistent with the adopted Redevelopment Plan. Permits for interior remodeling of existing uses are excluded from the provisions of this section. If the Authority finds the proposal is not consistent with the Redevelopment Plan but finds that upon evidence and arguments presented to it—(a) that the property for which a permit is sought cannot yield a reasonable return to the owner unless such a permit is issued and (b) that balancing the need for compliance and adherence to the Redevelopment Plan and interest in preserving the integrity of the Redevelopment Plan and the interest of the owner of the property in the use of the owner's property and in the benefits of ownership, the granting of such permit is required by considerations of justice and equity, then the Authority shall have six (6) months from the date of such findings to institute proceedings to acquire such land or interest therein. If no such proceedings are started within six (6) months, the officer responsible for issuing buildings permits shall issue the permit if the application otherwise conforms to all local ordinances.
