HomeMy WebLinkAbout1632-84A - ADMIN Ordinance - City Council - 1984/09/10ORDINANCE NO. 1632-84A AN EMERGENCY ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR WORK TO BE UNDERTAKEN BY THE CITY IN EXCESS OF $10,000 WITHOUT ADVERTISING FOR BIDS FOR THE CONSTRUCTION OF A WATERMAIN LOOPING FOR THE ST. LOUIS PARK WATER UTILITY SYSTEM THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. The City Council hereby declares that the emergency hereinafter defined exists and that an emergency ordinance is necessary for immediate preservation of the public health, safety or welfare in accordance with sections 3.05, 3.06, 3.08 and 5.06 of the Charter of the City of St. Louis Park. Section 2. The City Council hereby finds and determines the following facts and declares the existence of the emergency as follows: 1. On September 4, 1984, the City Council directed staff to implement a watermain looping project in Shelard Park. 2. The amount of the project exceeds 25 percent of the original contract amount and cannot be legally enacted through a change order. 3. The project would be deferred eight months should the competitive bidding process be adhered to. 4. During the eight month deferrment, there would be no back-up watermain looping system and the property(s) may potentially be without service. 5. The current deficiency in the water utility system constitutes a health and safety hazard and makes necessary the immediate letting of a contract for the resolution of this problem, there being insufficient time of the usual advertising for bids in the manner required by the Charter. 6. The City Council hereby declares that an emergency exists in connection with the water utility system, justifying and requiring that this ordinance, upon its passage or the date hereof, shall become effective immediately without -publication to protect the health and safety of the public as hereinbefore described. Section 3. The City Manager is hereby authorized to negotiate a contract for the construction of a watermain looping system hereinbefore described, and the Mayor and the City Manager are hereby authorized on behalf of the City to execute all necessary instru- ment for such materials, equipment and construction work as may be necessary. 1 Section 4. This ordinance shall take effect immediately upon its passage, without publication on the date hereof.
