LOUIS PARK MUNICIPAL CODE SECTIONS 6-105(17), 8-105(4)(d), 9-111, 10-102, 10-106(1), 11-1009(1), 12-101, 12-104(1), 13-1164, 14-230; ADDING SECTION 2-203; DELETING SECTION 11-1009(2) Section 1. The St. Louis Park Municipal Code is amended by adding Section 2-203 to read as follows: Section 2-203. Penalties. Any person who shall violate any provision of the St. Louis Park Municipal Code shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed Seven Hundred Dollars ($700) or imprisoned for a period of ninety (90) days or both. Section 2. The St. Louis Park Municipal Code, Section 6-105(17) is amended to read as follows: (17) Any person who shall violate any provision of this Section shall be guilty of a misdemeanor with penalties as defined in Section 2-203 of the St. Louis Park Municipal Code. Section 3. The St. Louis Park Municipal Code, Section 8-105(4)(d) is amended to read as follows: (d) Penalty for Failure to Comply. Any person to whom an order is directed who shall fail to comply with such order within the specified time shall be guilty of a misdemeanor with penalties as defined in Section 2-203 of the St. Louis Park Municipal Code. Section 4. The St. Louis Park Municipal Code, Section 9-111 is amended to read as follows: Section 9-111. Damaging Meters Prohibited. No person shall damage or knowingly or negligently permit damage to be done to a water meter on his premises or elsewhere. Any person damaging any such meter or knowingly or negligently permitting the same to be damaged shall pay all costs of making the required repairs to said meters upon demand therefor by the City. Any person damaging any such meter or knowingly permitting the same to be damaged shall be guilty of a misdemeanor with penalties as defined in Section 2-203 of the St. Louis Park Municipal Code. Section 5. The St. Louis park Municipal Code, Section 10-102 amended to read as follows: Section 10-102. Penalty for Violation of Incorporated Statutes. It shall be unlawful and a violation of the requirements of Section 10-101 for any person to violate within the City of St. Louis Park any provision of such statutes adopted by reference herein, and any person upon conviction thereof shall be guilty of a misdemeanor with penalties as defined in Section 2-203 of the St. Louis Park Municipal Code, except as otherwise provided in the statutes adopted in Section 10-101, in which case the provision set forth in the statutes adopted by reference shall apply. A complaint alleging violation of this ordinance shall allege the appropriate section of the statute herein incorporated as contrary to Section 10-101 of this ordinance. Section 6. The St. Louis Park Municipal Code, Section 10-106(1) is amended to read as follows: Section 10-106. Attempts. (1) Whoever, with intent to commit an ordinance violation, does an act which is a substantial step toward, and more than preparation for, the commission of the ordinance violation, is guilty of an attempt to commit that ordinance violation, and shall be guilty of a misdemeanor with penalties as defined in Section 2-203 of the St. Louis Park Municipal Code. Section 7. The St. Louis Park Municipal Code Section 11-1009(1) is amended to read as follows: Section 11-1009. Enforcement and penalties. (1) Failure or omission to comply with any section of this ordinance shall be deemed a misdemeanor with penalties as defined in Section 2-203 of the St. Louis Park Municipal Code and may be so prosecuted. Section 8. Section 11-1009(2) of the St. Louis Park Municipal Code is deleted. Section 9 The St. Louis Park Municipal Code Section 12-101 is amended to read as follows: Section 12-101. Penalty. Any person who shall violate any provision of any section or subdivision of this chapter, or -2- who shall fail to comply with any requirement thereof, shall be guilty of a misdemeanor with penalties as defined in Section 2-203 of the St. Louis Park Municipal Code. Section 10. The St. Louis Park Municipal Code, Section 12-104(1) is amended to read as follows: (1) Whoever, with intent to commit an ordinance violation, does an act which is a substantial step toward, and more than preparation for, the commission of the ordinance violation, is guilty of an attempt to commit that ordinance violation, and is, therefore, guilty of a misdemeanor with penalties as defined in Section 2-203 of the St. Louis Park Municipal Code. Section 11. The St. Louis Park Municipal Code, Section 13-1164 is amended to read as follows: Section 13-1164. Penalties. Whoever does any act forbidden by this ordinance or omits or fails to do any act required by this ordinance shall be guilty of a misdemeanor with penalties as defined in Section 2-203 of the St. Louis Park Municipal Code. Each day that a violation exists constitutes a separate and distinct offense. Section 12. The St. Louis Park Municipal Code, Section 14-230 is amended to read as follows: Section 14-230. Violation and Penalty. Any person, firm, corporation, or voluntary association which violates or refuses to comply with any of the provisions of this ordinance shall be guilty of a misdemeanor with penalties as defined in Section 2-203 of the St. Louis Park Municipal Code. Each day that a violation is permitted to exist shall constitute a separate offense. Section 13. The City Clerk is directed to amend any existing language within the St. Louis Park Municipal Code which states the extent of punishment for a misdemeanor and is authorized to replace such language with a reference to Section 2-203 of the St. Louis Park Municipal Code. Section 14. Effective Date. This ordinance shall take effect 15 days after its publication. 1983.
