AN ORDINANCE AMENDING THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO POLITICAL ACTIVITY BY AMENDING SECTION 3-104.
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The St. Louis Park Ordinance Code, Section 3-104
is hereby amended as follows:

Section 3-104. Political Activity
(1) Purpose. It is the purpose of this provision to preserve and
promote efficiency and political neutrality in municipal employment
and the conduct of nunicipal business, while affording City employees
the opportunity to participate in political activities not incon-
sistent with this goal.
(2) Permitted Activities. Employees may register and vote in any
election; may make personal financial contributions to political
organizations; and may attend political conventions, rallies, fund
raising functions and similar political gatherings. Employees
may hold membership in a political party and participate in its
functions to the extent consistent with State and local law. As
individuals, employees nay express opinions on political issues
and candidates during off -work hours when not discharging City
functions; they may otherwise participate in public affairs but only
to the extent that such endeavors do not impair the neutral and
efficient performance of official duties or create real or apparent
conflicts of interest.
(3) Prohibited Activities. Employees are prohibited from directly
or indirectly, during their hours of employment, soliciting or
receiving funds or at any time using their authority or official in-
fluence to compel any officer or eriployee in the classified service
to apply for membership in or become a nenher of any organization,
or to pay or promise to pay any assessment, subscription, or con-
tribution, or to take part in any political activity. Employees
are prohibited from using their position of municipal employment to
influence, interfere with, or affect an election campaign or the
results of an election.
(4) Prohibited Misuse of City Property or Services. Employees may
not engage in political activity while on City time or while dis-
charning City responsibilities; nor may they act in a manner which
suggests that the City either supports a particular candidate or
political issue or endorses the personal political opinions of the
municipal employee. Any act which tends to identify the City with
any candidate or political issue, or which otherwise tends to under-
mine the public perception of the City as a politically neutral and
impartial body, is prohibited.
Use of City vehicles, facilities, equipment, or other resources
while engaging in political activities is not permissable. This
includes use of typewriters, duplicators and telephones. This
restriction does not apply to municipal resources available to the
public at large for use in connection with political activities,
such as use of meeting rooms.
(5) Candidacy for Office
(a) Upon becoming a candidate for public office, an employee
may request a leave of absence for the duration of such
candidacy.

(b) If the candidacy of a City employee for public office
involves time commitments that are inconsistent with
the employee's regular municipal employment, so that the
regularly assigned duties cannot be fulfilled, the em-
ployee must request a leave of absence.
(c) An employee shall be considered a candidate under this
section upon filing for political office.
(d) The City Manager riay grant such leave of absence if it is
in the interests of the City and if the required duties
of the employee can be satisfactorily reassigned.
(6) Election or Appointment to Office
(a) If an employee is elected or appointed to a position on
the municipality's governing body, or any other office
which is legally incompatible with municipal employment,
the employee must resign municipal employment before
assuming the responsibilities of the elective or appoint-
ive office.
(b) If an employee is elected to the Legislature or to another
full-time public office, the employee shall be granted
leave of absence, as provided by State law.
(c) If an employee is elected or appointed to a part-time public
office other than on the municipality's governing body, or
any other office which is legally incompatible with
municipal employment, and cannot simultaneously effectively
discharge the responsibilities of full-time City employ-
ment, the employee shall either (1) resign municipal em-
ployment, or (2) request leave of absence to permit the
employee to exercise the part-time public office. The
City Manager may grant such leave of absence if it is in
the interests of the City, and if the required duties of
the employee can be satisfactorily reassigned.
(7) Employees Covered by Hatch Act. Employees on programs receiving
federal funding, who are covered by the Hatch Act, shall conform
to requirements of federal law in addition to those specified
in this section.
Section 2. This ordinance shall take effect fifteen (15) days
after publication.

D K MORTENSON, being duly sworn, on oath says he is and during all times here stated has been the
vice president and general manager of the newspaper know as The St Louis Park Sun and has full
knowledge of the facts herein stated as follows (1) Said newspaper is printed in the English language in
newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches
(2) Said newspaper is a weekly and is distributed at least once every week (3) Said newspaper has 50%
of its news columns devoted to news of local interest to the community which it purports to serve and does
not wholly duplicate any other publication and is not made up entirely of patents, plate matter and
advertisement (4) Said newspaper is circulated in and near the municipalities which it purports to
serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75%
of its total circulation currently paid or no more than three months in arrears and has entry as second-
class matter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park,
Golden Valley School District No 275 and Robbinsdale School District No 281 in the County of Hennepin
and it has its known office of issue in the City of Hopkins in said county, established and open during its
regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and
maintained by the managing officer of said newspaper or persons in its employ and subject to his'
direction and control during all such regular business hours and devoted exclusively during such regula
business hours and at which said newspaper is printed (6) Said newspaper files a copy of each issue,
immediately with the State Historical Society (7) Said newspaper is made available at single or
subscription prices to any person, corporation, partnership or other unincorporated association
requesting the newspaper and making the applicable payment (8) Said newspaper has complied with all
foregoing conditions for at least one year preceding the day or dates of publication mentioned below (9)I
Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each
January 1 thereafter and affidavit in the form prescribed by the Secretary of State and signed by the'
managing officer of said newspaper and sworn to before a notary public stating that the newspaper is a
legal newspaper
