AN ORDINANCE AMENDING AND ADDING TO
THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO THE CONSTRUCTION AND
SWIMMII'IG POOL REQUIREMENTS: SECTIONS
13-1108, 15-210, 15-253(h) and 15-265
THE ST. LOUIS PARK CITY COUNCIL DOES ORDAIN:
Section 1. Section 13-1108 of the St. Louis Park
Municipal Code is repealed. A new Section 13-1108 is added
to read as follows:
Section 13-1108. Plan Checking and Construction Permit
Fees for All Swimming Pools. All plan checking and construction
permit fees shall be in accordance with the fee schedules
in the various construction codes of the City of St. Louis
Park Ordinance Code.
Section 2. Section 15-210 of the St. Louis Park
Municipal Code is amended to read as follows:
Section 15-210. Building Code. The City of St. Louis Park
hereby adopts and incorporates herein the Minnesota. State
Building Code, hereinafter referred to as Building Code, 1980
Edition, as contained in 2 MCAR Section 1.10101 to Section
1.18901. Also adopted within the Minnesota State Building
Code and adopted by reference is the following:
(1) 1979 Edition of the Uniform Building Code,
hereinafter referred to as "UBC" as adopted
and amended within 2 MCAR Section 1.10101
through Section 1.18901.
(2) 1981 Edition of the National Electrical
Code, as adopted in 2 MCAR Section 1.18601.
Section 3. A new Section 15-253(h) is added to read
as follows:
(h) However, a permit will not be required for
service work, repairs or replacement of
components or controls of any existing
heating, ventiliation, air conditioning
or refrigeration system if all the
following requirements are met:
(1) The total cost of service and labor
charges is less than one hundred
dollars ($100.00);
(2) There is no change in the type or
method of control; and
(3) There is no increase in the required
capacity, rating or BTU input of the
system or equipment.
Section 4. A new Section 15-265 is added to read as
follows:
Section 15-265. Heat Loss Calculations for Electric Heating.
No electric heating permit shall be issued for any electric
heating system until heat loss calculations have been submitted
and approved; provided, that heat loss calculations are not
required when the electrical heating system is used to provide
supplemental heat. The permit fee shall be the minimum established
in Section 15-262 and shall be in addition to the fee for
the electrical devices.
Section 5. Penalty. Any person violating the provisions
of this ordinance shall be guilty of a misdemeanor and upon
conviction shall be punished by a fine of not more than $500 or
by imprisonment for a period not to exceed 90 days or both.
Section 6. This ordinance shall take effect 15 days
after its publication.

RELATING TO THE CONSTRUCTION AND

SUBJECT: Construction and Swimming Pool Codes Amendments and Additions
Attached is an ordinance proposed by the Department of Inspectional Services
and reviewed by the City Attorney's office. This ordinance includes two
sections covering the adoption of the 1981 Electrical Code and an exemption
for a permit and fee for minor repair work under the mechanical ordinance.
Another section will provide that plan checking fees for public pools be
calculated according to the building code fee schedule. This is consistent
with the method of calculation used for residential pools and all other
construction. The last change includes a section to require the submission
of heat loss calculations for electric heating systems. All changes are
needed for clarification and consistency in the construction codes.
Section 15-25 relates to the exemption of permits and fees for minor
mechanical work. The fee schedule is patterned after the fee schedule
used by the City of Minneapolis. Our mechanical fee schedule adopted
last January, 1981 is similar to that of the City of Minneapolis.
Several phone calls were received relative to permits and fees for minor
mechanical work.
Section 15-265 is intended to eliminate any jurisdictional confusion between
the mechanical and electrical inspectors relating to the submission of heat
loss calculations for electrical heating systems. A minimum fee is proposed
for the purpose of having the mechanical inspector review and approve the
heat loss calculations and the heating system. Such heat loss calculations
have been required for systems other than electric heating systems, and
ordinances in other communities do require such calculations for electrical
heating systems.
RECOMMENDATIONS:
It is recommended that the first reading of the attached ordinance be waived
and that the second reading be scheduled for November 2, 1981.
