HomeMy WebLinkAbout1526 - ADMIN Ordinance - City Council - 1981/09/21ORDINANCE NO. 1526 AN EMERGENCY ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR WORK TO BE UNDERTAKEN BY THE CITY IN EXCESS OF $5000 WITHOUT ADVERTISING FOR BIDS FOR THE CONSTRUCTION OF A WELL AND PUMPING APPURTENANCES FOR THE ST. LOUIS PARK WATER UTILITY SYSTEM THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. The City Council hereby declares that the emergency hereinafter defined exists and that an emergency ordinance is necessary for the im- mediate preservation of the public peace, health, morals, safety or wel- fare in accordance with Sections 3.05, 3.06, 3.08 and 5.06 of the Charter of the City of St. Louis Park. Section 2. The City Council hereby finds and determines the following facts and declares the existence of an emergency as follows: 1. The City has been forced to close seven of the 14 wells in its water supply system due to the spread of polynuclear aromatic hydrocarbon (PAH) contaminants in the groundwater. 2. The closing of these wells has significantly reduced the capacity of the water system and heightened the possibility that it will not be able to meet the needs for fire protection and commercial and residential use. 3. A total lawn sprinkling ban effective September 11, 1981 is a temporary measure to conserve water for the balance of 1981. 4. Long-term solutions to meet immediate and future demands on the City's water supply system are urgently needed. 5. The City Manager and Director of Public Works have determined that the most feasible solution is the construction of a new well to the Hinckley formation from a site located near the intersection of West 34th Street and Wyomina Avenue. 6. The current deficiency in the water supply capacity constitutes a health and safety hazard and makes necessary the immediate letting of a contract for the resolution of this problem, there being insufficient time for the usual advertising for bids in the manner required by the Charter. 7. The City Council hereby declares that an emergency exists in connection with the capacity of the water supply system, justifying and requiring that this ordinance, upon its passage or the date hereof, shall become effective immediately without publication to protect the health and safety of the public as hereinbefore described. Section 3. The City Manager is hereby authorized to negotiate a contract for the construction of a well and pumping appurtenances hereinbefore described, and the Mayor and City Manager are hereby authorized on behalf of the City to execute all necessary instruments for such materials, equipment and construction work as maybe necessary. Section 4. This ordinance shall take effect immediately upon its passage, without publication, on the date hereof. Adopted by the City Council September 21, 1981 Attest: ity (5%. Cle k e.
