LOUIS PARK MUNICIPAL CODE RELATED TO HOURS OF SUNDAY -SALE, ON -SALE INTOXICATING LIQUOR: AMENDING SECTIONS 13-326(17)(2) & 13-327 THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. The St. Louis Park Municipal Code, Sections 13-326(17)(2) and 13-327, is amended to read as attached: 1 1 (17) No dealer licensed for "Sunday sale" shall sell liquor unless in conjunction with the serving of food. Every dealer so licensed shall comply with the following in making Sunday sales: (1) The licensee must be properly licensed as a restaurant. All personnel, preparation areas, service areas, and equipment must comply with all applicable laws and ordinances. (2) The hours of Sunday operation shall be between 10 a.m. and midnight only. (3) Food service must be maintained from time of opening until ten o'cjock p.m. (4) The food preparation area must be capable of dispensing full meals with at least one "cook" and one "dishwasher" on duty during all hours of food service operation. (5) The food service areas must have table seating for at least 30 people and shall have at least two assigned "waitresses/waiters" or one "waitress/waiter" and one "bus boy/girl" on duty during all hours of operation. In addition to the above minimums, staff must be adequate for usual and suitable preparation and service of the presented menu and adequate for proper sanitation and maintenance of preparation and service areas. (6) The menu must consist of not less than 3 separate and distinct entrees complete with vegetable, salad, rolls or bread, and a selection of beverages. (7) The establishment must be under the supervision and control of a single proprietor or manager who is available on the premises to the public and City officials during hours of operation. (Sec. 13-326(17) Added by Ordinance 1283, March 3, 1975) (18) An "on -sale wine" license shall be issued subject to the conditions that: (1) Only a restaurant having facilities for seating not fewer than thirty (30) persons at one time may be licensed. (Sec. 13-326(18)(1) amended by Ordinance 1394, December 19, 1977) September, 1981 1 1 1 382.1 1 (2) The premises to be licensed shall not be within 300 feet of any school or house of worship. (3) Every License is subject to the conditions in this ordinance and of any other applicable ordinance, state Taw regulation. The structure and premises for which a license is issued shall be in compliance with all applicable building, safety and zoning codes. (Sec. 13-326 (18) (1) (2) (3) Added by Ordinance 1304, October 6, 1975) Section' 13-327. Hours of Operation. Except as hereinafter -provided for "Sunday sale" licenses, no sale of intoxicating liquor shall be made after one o'clock a.m. on Sunday nor until eight a.m. on Monday, nor between the hours of one o'clock a.m. and eight o'clock p.m'. on the day of any statewide election. No "on sale" shall be- made emade between the hours of one o'clock a.m. and eight o'clock a.m. on Tuesday through Saturday nor between twelve o'clock midnight on Sunday and eight o'clock a.m. on Monday. Sales under a special "Sunday, sale" license may be made on Sunday between ten o'cl'ock a.m. and midnight. No 'off -sale" shall be made on Sunday nor before eight o'clock a.m. or after eight o'clock p.m. of any weekday except Friday and Saturday, on which days "off sale' may be made until, ten o'clock p.m. No "off sale' shall' be made on New Years Day, January 1; Independence Day, July 4; Thanksgiving Day; or Christmas" Day, December 25, but on the evenings preceding such days, if the sale of liquor is not otherwise prohibited on such evenings, "'off sale" may be made until ten o'clock p.m.,, except that"no "off sale" shall' be made on December 24 after eight o'clock p.m. During said prohibited hours and at said times no intoxicating liquor in any quantity whatsoever shall be served, kept, displayed or permitted to, be on or in any table, booth, bar or other place in such, licensed premises, except the stock of liquors stored therein during such, times on the premises in such portions thereof as are accessible only to the licensee and his employees. Any person violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction shall be punished by a fine not more than $500 or by imprisonment for a period not to exceed 90 days or both. Sec. 3. This ordinance shall take effect 15 days after its publication. Adopted by the City Council September 8, 1981.
