LOUIS PARK DOES ORDAIN: Section 1. The City has title to the right of way for streets. Section 2. Northwestern Bell Telephone Company has requested an easement for communication purposes over, across and under the following portion of right of way at: Parcel 1. In resolution for City Hall location Parcel 2. Between the sidewalk and property line East of Salem Avenue 16 feet South of the South curb of Minnetonka Boulevard. Parcel 3. On the West right of way line of the service drive of Highway 100 and 64 feet South of the South pavement edge of West 24th Street. Parcel 4. On the West service drive of Highway 100, 23 feet West of the West paving edge and North right of way line of West 26th Street. Section 3. The Mayor and the City Manager are hereby authorized on behalf of the City to execute an easement for communication purposes with Northwestern Bell Telephone Company on the described property for the sum of One Hundred Fifty and No/100 Dollars each for Parcels 2, 3, and 4; permission will be delivered upon payment in full of said $450.00. Northwestern Bell Telephone Company shall, as a condition of the easement, landscape with evergreens and screen the cabinet and concrete slab to the satisfaction of the City. Section 4. This ordinance shall take effect fifteen days after its publication. Breyer (;410 From: Robert Locky, Allen Engen Subject: Mayor and Council Easement to Northwestern Bell Telephone Company Northwestern Bell Telephone Company is proposing improving services in the area of City Hall. To facilitate this, Northwestern Bell Telephone must place an above -ground cabinet on a 3'x5' concrete slab. For this purpose the City has been requested to grant a 10'x10' ease- ment adjacent to and south of Minnetonka Boulevard approxi- mately 60 feet east of Raleigh Avenue. Northwestern Bell has agreed to landscape and screen the cabinet and pay a fee for the easement. A fee of $150.00 would cover administrative costs. Northwestern Bell has also requested easements in City right of way at the locations listed below in order to install new, or to revise electronic cable connectors on concrete pads. Parcel 1. Between the sidewalk and property line East of Salem Avenue 16 feet South of the South curb of Minnetonka Boulevard. Parcel 2. On the West right-of-way line of the service drive of Highway 100 and 64 feet South of the South pavement edge of West 24th Street. Parcel 3. On the West service drive of Highway 100, 23 feet West of the West paving edge and North right-of-way line of West 26th Street. RECOMMENDATION: It is recommended that the easement be conveyed to North- western Bell Telephone Company for a fee of $150.00 and that the City require appropriately landscaped areas. It is further recommended that Ordinance No. 1476 adopted by the Council on September 15 be repealed, and that a new ordinance granting authorization for telephone cabinets on City street right of way be waived for first reading with second reading being set for October 20, 1980. It is further recommended that the first reading of the pro- posed ordinance authorizing the granting of easements for telephone cabinets be waived and that second reading be set for October 20, 1980.
