LOUIS PARK ORDINANCE CODE, CHAPTER 8; BY ADOPTING THE 1979 UNIFORM FIRE CODE, BY REFERENCE THE CITY OF ST. LOUIS PARK ORDAINS: Section 1. The St. Louis Park Ordinance Code, Chapter 8, -.Part 1, Section 8-105 (4) is repealed. The following, . sections shall be renumbered as follows: 8-105(,5)(4),,"; 87105(6)(5),-,8-105(7)(6), 8-105(8)(7). Section 2. The St. Louis Park Ordinance Code, Section 8-105 (4d) shall be amended to read: Section 3. Penalty for Failure to Comply. Any person to whom an order is directed who shall fail to comply with such an order within the specified time shall be guilty of a misdemeanor and upon conviction thereof shall be fined not mere than to exceed Five Hundred Dollars ($500.00) or imprisoned for a period not to exceed -ninety (90) days, or both. The St. Louis Park Ordinance Code, Chapter 8, Part 3, Section 8-301 shall be amended to read: Adoption of Fore Preveet4ee Gede Uniform Fire Code by Reference. There is hereby adopted by the City of St. Louis Park for the purposes of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code entitled the-'F4re Preveet4ee-6ede2;-reeemweeded-5y-t5e-Amer4ean-imsaraeee A4ssee4at4ee-397A-ed4i:4ee "Uniform Fire Code, 1979 Edition" as published by the International Conference of Building Officials and the Western Fire Chiefs Association, and the whole thereof, except such portions as are hereinafter deleted, modified or amended, of which code not less than three copies have been and now are filed in the office of the Clerk of the City of St. Louis Park and marked "Official Copies" and the same are hereby adopted and incorporated as fully as if set out at length herein,,,and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within%the limits of the City of St. Louis Park. Section 4. The St. Louis Park Ordinance Code, Chapter 8, Part 3, Section 8-304 is amended to read: Definitions (1) Wherever the word "Municipality" is used in the F4re-Prevent4en-Gede, Uniform Fire Code, it shall mean the City of St. Louis Park. (2) Wherever the words "Chief" or "Chief of the Bureau of Fire Prevention" are used in the F4re-Prevemt4en-cede, Uniform Fire Code, they shall mean the Fire Chief of the City of St. Louis Park. (3) Subdivision (3) is repealed. Section 5. The St. Louis Park Ordinance Code, Section 8-305(2) is amended to read as follows: Section 6. Section 7. (2) Limits. The St. Louis Park Ordinance Code, Section 8-306 is amended to read as follows: Establishment of Limits in which Bulk Storage of Liquified Petroleum Gases is to be Restricted. The St. Louis Park Ordinance Code, Section 8-307 is amended to read as follows: Establishment of Limits of Districts in which Storage of Explosives and Blasting Agents is to be Prohibited. A:; Section 8. The St. Louis Park Ordinance Code is amended by adding Section 8-309 to read: Section 8-309. Exceptions to the Uniform Fire Code , 1979 Edition. Exceptions shall be made to.the following portions of the 1979 Uniform Fire Code: (1) Part 1, Article 2, Division 3, Section 2.303(b), Standards: Whenever this code is unapplicable for any reason to any situation involving the protection of persons and propertyfrom the hazards of fire and explosion, the materias, methods of construction, installations, practices or operations necessary to provide suchrpro- tections shall be as specified in the National Fire Protection Association Standards. (2) Part 3, Article 10, Division 3, Section 10.310, Standpipes, specifically Table No. 10-310- Standpipe Requirements, second line, Box 1: Occupancies 3 stories or more but less than 150 feet in height, except Group R. The St. Louis Park Ordinance Code, Sections 8-105(4) and 8-304(3) are repealed; Sections 8-105, 8-301, 8-304, 8-305(2), 8-306, 8-307 are amended; and Section 8-309 is added, to read: 1 1 (f) Inadequate fire extinguishing equipment. (g) Materials and buildings especially susceptible to fire. (h) Conditions endangering other property or occupants. (i) Any other fire hazards dangerous to life or property. (4) Order to Correct Violation. Where violations of this ordinance or of any other laws or ordinances relating to fire hazards are found by the Chief or authorized inspector, a written order to correct the violation upon the owner, operator, occupant or other person responsible for the violation. (a) Method of Service. The order required herein shall be served in one of the following ways: (i) By making personal delivery of the order to the person responsible. (ii) By leaving the order with some person of suitable age and discretion upon the premises August 4, 1980 113 (iii) By affixing a copy of the order to the door at the entrance of the premises in violation. (iv) By mailing a copy of the order to the last known address of the owner of the premises, by registered mail. (v) By publishing a copy of the order in the official newspaper once a week, for three successive weeks. (b) Time for Compliance. The order required herein shall set forth a time limit for compliance, dependent upon the hazard and danger created by the violation. In cases of extreme danger to persons or property, the Chief shall have the authority to require compliance immediately upon service of the order. (c) Appeal from Order. A person to whom an order hereunder is directed shall have the right, within twenty-four hours of the service of such order, to appeal to the City Manager, who shall review such order within three days and file his decision thereon. Unless the order is revoked or modified, it shall remain in full force and be obeyed by the person to whom directed. No person to whom an order is directed shall fail to comply with such order within five days after an appeal shall have been determined, or the time specified in the original order, whichever is later. (d) Penalty for Failure to Comply. Any person to whom an order is directed who shall fail to comply with such order within the specified time shall be guilty of a misdemeanor and upon conviction thereof shall be fined not to exceed Five Hundred Dollars ($500.00) or imprisoned for a period not to exceed ninety (90) days, or both. (Sect. 8-105 (5) (d), Amended by Ord. 1407, May 1, 1978) August 4, 1980 (5) (e) Failure to Comply. When a person to whom an order is directed shall fail to comply within the specified time, the Chief shall have the authority, with approval of the City Manager, to contract with others for the removal of such materials and the person to .whom the order is directed shall be obligated forthwith to reimburse the City for the said costs. The person removing material under a contract made hereunder shall be authorized to enter the premises and to remove such material. If the cost of removal is not paid within thirty days after receipt of a statement therefor from the Chief, such cost shall be levied against the property upon which said fire hazard exists, as a Special Assessment. The levying of such assessment shall not affect the liability of the person to whom the order is directed, to fine and imprisonment, as herein provided. Investigation of Fires. The Chief or designated officer shall investigate promptly the cause, origin and circumstance of each and every fire occurring in the City in which property has been destroyed or damaged, and if it appears to the officer making investigation that such fire is of suspicious origin, he shall then take immediate charge of the physical evidence and notify the proper authorities designated by law to make the investigation of such matters and shall further cooperate with them in the collection of the evidence and in the prosecution of the case. (6) Record of Fires. The Chief shall keep a record of all fires and of all the facts concerning the same, including statistics as to the extent of such fires and the damage caused thereby, and whether such losses were covered by insurance and if so, in what amount. (7) Report on Activity of Fire Prevention Division. The Chief of the Fire Department shall submit a monthly report on the Fire Prevention activities of the Department under this section to the City Manager once each month. Section 8-302. Establishment of Bureau of Fire Prevention. The Fire Prevention Code shall be enforced by the Bureau of Fire Prevention in the Fire Department of the City of St. Louis Park which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. Section 8-303. Duties of Bureau of Fire Prevention. The Fire Marshal in charge of the Bureau of Fire Prevention shall be the Fire Chief as set forth in Section 1-202 (2) c of the St. Louis Park Ordinance Code. The Chief of the Fire Department may detail such members of the Fire Department as Inspectors as shall from time to time be necessary. Section 8-304. Definitions. (1) Wherever the word "Municipality" is used in the Uniform Fire Code, it shall mean the City of Ste Louis Park. (2) Wherever the words "Chief of the Bureau of Fire Prevention" are used in the Uniform Fire Code, they shall mean the Fire Chief of the City of St. Louis Park. August 4, 1980 119 Section 8-305. Establishment of Limits of Districts in Which Storage of Flammable Liquids in Outside Above Ground Tanks is to be Prohibited. (1) Zones. Zones comprising areas described as the limits referred to in Section 16.22 (a) of the Fire Prevention Code in which storage of flammable liquids in outside above -ground tanks is prohibited, are hereby established as follows: Zones comprising areas described as Use Districts R1, R2, R3, R4, and RB, as bounded and established pursuant to Ordinance No. 730, passed December 28, 1959, known as "St. Louis Park Zoning Ordinance". (2) Limits. The limits referred to in Section 79.101 of the Uniform Fire Code, covering new bulk plants for flammable liquids are prohibited except as allowed by special permit by the Council. Section 8-306. Establishment of Limits in which Bulk Storage of Liquified Petroleum Gases is to be Restricted. The limits referred to in Section 82.105 of the Uniform Fire Code, covering bulk storage of liquified petroleum gas is restricted, except as allowed by special permit by the Council. Section 8-307. Establishment of Limits of Districts in which Storage of Explosives and Blasting Agents is to be Prohibited. The limits referred to in Section 77.106 of the Uniform Fire Code, covering storage of explosives and blasting agents is prohibited, except as approved by special permit by the Council. Section 8-308. AAealss.. Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a license or permit applied for, or when it is claimed that the provisions of the code do not apply, or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department to the City Manager within thirty (30) days from the date of such decision of the Fire Chief. Section 8-309. Exceptions to the Uniform Fire Code, 1979 Edition.
