HomeMy WebLinkAbout1472 - ADMIN Ordinance - City Council - 1980/07/15July 15, 1980 ORDINANCE NO. 1472 AN EMERGENCY ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR CONSTRUCTION WORK TO BE UNDERTAKEN BY THE CITY IN EXCESS OF $5,000 WITHOUT ADVERTISING FOR BIDS FOR REPAIRS TO WELL NO. 16 LOCATED AT 2012 FLAG AVENUE THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. The City Council hereby declares that the emergency hereinafter defined exists and that an emergency ordinance is necessary for the immediate preservation of the public peace, health, morals, safety or welfare in accordance with Section 3.05, 3.06, 3.08 and 5.06 of the Charter of the City of St. Louis Park. Section 2. The City Council hereby finds and determines the following facts and defines declares the existence of an emergency as follows: 1. The City is experiencing a capacity problem with the City water system. Recently the pumping capacity of well No. 16 has been severely limited indicating a malfunction of the pump and thereby requiring an immediate need to repair the well and to remove accumulated sand from the bottom of the well. 2. Unless the well is repaired immediately,,the capacity and water shortage problem being experienced by the City would be increased and additional restrictions on water use would have to be imposed, and a loss of revenue would also result. 3. Proposals have, been received indicating that the cost to repair the pump and to remove sand will be approximately $14,300 if 100 cubic yards of sand is removed and such costs would be $20,300 if 200 cubic yards of sand is removed. 4. The City Council hereby declares that an emergency exists, and the City's ability to provide sufficient water without repair of well No. 16, justifying and requiring that this ordinance upon its passage on the date hereof, shall become effective immediately without publication to allow restoration of the pumping capacity for well No. 16 to meet the health needs of the public as hereinbefore described. Section 3. The City Manager is hereby authorized to negotiate a contract for the repair of well No. 16 hereinbefore described, and the Mayor and City Manager are hereby authorized on behalf of the City to execute all necessary instruments for such materials, equipment and construction or repair work atl may be necessary. Section 4. This ordinance shall take effect immediately upon its passage, without publication, on the date hereof.
