A petition in writing signed by a majority of all of the owners of all property abutting upon both sides'of the public utility easement proposed to be vacated has been duly filed with the City Clerk, requesting vacation of the public utility easement, and the City Clerk has furnished a copy of said petition to the City Manager who has reported filing of same to the City Council, and -the Clerk has published notice in the official City newspaper, the St. Louis Park Sun, on May 29, 1980 as directed by the Council, and 'the City Council has met at the time and place as published in said notice and has conducted a public hearing upon said petition and has determined that the public utility easement is not needed for public purposes, and that it is for the best interest of the public that said public utility easement be vacated. Section 2. The following described public utility easement as now dedicated and laid out with the corporate limits of the City of St. Louis Park, is vacated: An easement for sanitary sewer purposes in and over a 20 -foot strip lying 10 feet on each side of a line described as commencing at the Northwest corner of Lot 1, Block 3, Oak Park Village, thence on an assumed bearing of South a distance of 527.63 feet along the Westerly line, thence on a curve to the left with a radius of 150 feet a distance of 20.5 feet to the point of beginning, thence North 55 degrees East a distance of 50 feet and there termination. An easement for drainage and storm sewer in and over a 20 foot wide strip lying 10 feet on each side of a line described as commencing at the Northwest corner of Lot 1, Block 3, Oak Park Village, thence on an assumed bearing of South 474.63 feet along the Westerly line to the point of beginning, thence deflecting to the left at an angle of 91 degrees 30 feet a distance of 113 feet and there terminating. Section 3. The City Clerk is instructed to prepare a Notice of Completion containing a copy of this ordinance and to file the Notice in the Office of the Register of Deeds or Registrar of Titles, in and for the County of Hennepin, Minnesota, as the case may be.
