LOUIS PARK ORDINANCE CODE, SECTION 13-910(2) AND ADDING SECTION 13-913(3) THE CITY COUNCIL OF ST. LOUIS PARK ORDAINS: Sec. 1. The St. Louis Park Ordinance Code, Section 13-910(2) is amended; Section 13-913(3) is added, to read: Food Vending Machines Section 13-910. Definitions. As used in this ordinance the following terms shall have ascribed to them the definitions set out herein, unless the context indicates otherwise: (1) The word "food" shall mean and include all a t cies of food, confections, drink, or condiments fouman consumption, and all substances or ingredients used in the preparation thereof, and shall mean and include, among other things, candy, chocolate, confectionery, nuts, chewing gum, or fruit, and the enumeration herein of specific items shall not,be deemed a limitation upon the meaning of the word "food'''. (2) The words "vending machine" shall mean any and all types of mechanical devices which operate by the insertion of a coin of more than one cent, paper currency or other token and which deliver or permit the removal from such machine, of any food as herein defined. Vending machine _shall further include a bulk vending machine consisting of two -or more units vending food or lion -food products fastened on a single stand, at least one unit of which dispenses food. (3) "Original package" shall mean food as defined in this ordinance, which is placed in containers by the manufacturers or processors, and which said containers are not altered or broken, and which is delivered to the ultimate consumer in the same container or package as provided by the manufacturer or processor. (4) "Perishable food" shall mean and include all custard filled or cream filled pastries, milk, cream, and milk or cream products; eggs, meat, fish, shellfish, gravy, and poultry; sauces, dressings, and salads containing meat, fish, poultry, eggs, milk, cream, or milk or cream products or drinks which are or which may be readily decomposed by micro organisms when such foods are not maintained at a temperature of 45 degrees F. or less or which are knovn to act as incubation media for micro organisms. Section 13-911. License Required. No person shall engage in the u�siness of selling or vending food by vending machine, nor own, operate, or maintain any food vending machine, without first 1 1 4 _1 1 1 having obtained a license from the City Manager as herein provided. Section 13-912. Application. The application for such a license, shall state the address of the place or places wherein he proposes to install and operate any vending machine, the kind and number of which -machines, the kind and general description of the article or articles he proposes to sell or vend by the use of said machines, the address of the place where the articles to be sold by the use of said machines are placed in said machines, unless the same are filled at the place of their location. Section 13-913. License Fee. The annual license fee for the license herein required is fixed as follows: (1) For each vending machine dispensing food is a wrapped package or sealed bottle or container, fifteen dollars ($15.00) per annum for the first machine at one location and five dollars $5.00 for each additional machine at the same location. _(2) For each vending machine dispensing readily perishable food or food in an open container twenty five dollars (25.00) for the first machine at one location and fifteen dollars ($15.00) for each additional machine at the same location. (Sec. 13-913 Amended by Ordinance 1356, December 20, 1976) (3) For each bulk vending machine dispensing food and non-food products and with eight or fewer units fastened on a single stand shall be $25.00 and $5.00 for each additional unit (food and non-food) beyond eight units. Section 13-914. Change of Location. No licensee may change the location of a licensed vending machine without consent of the City Council. Section 13-915. Regulations Governing Vending Machines. Each vending machine licensed under this ordinance shall be constructed and main- tained as follows: (1) Each machine shall be filled only with wholesome ingredients which have been manufactured and packaged under sanitary conditions and transported to the machine in sanitary containers or vehicles. LOUIS PARK SUN 924 Excelsior Avenue West Hopkins, Minnnesot State of Minnesota County of Hennepin DON R LARSON, being duly sworn, on oath says he is and during all times here stated has been the president and printer of the newspaper known as The St Louis Park Sun and has full knowledge of the facts herein stated as follows (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches (2) Sate newspaper is a weekly and is distributed at least once every week (3) Said newspaper has 50% of it, news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements (4) Said newspaper is circulated in and near the municipalities which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second- class matter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park, Golden Valley School District No 275 and Robbinsdale School District No 281 in the County of Hennepin and it has its known office of issue in the City of Hopkins in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer of said newspaper or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto (6) Said newspaper files a copy of each issue immediately with the State Historical Society (7) Said newspaper is made available at single or subscription prices to any person, corporation, partnership or other unincorporated association requesting the newspaper and making the applicable payment (8) Said newspaper has complied with all foregoing conditions for at least one year preceding the day or dates of publication mentioned below (9) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter and affidavit in the form prescribed by the Secretary of State and signed by the managing officer of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper (Official Publication) MAY 19, 1980 8b ORDINANCE NO. 1465 AN ORDINANCE RELATED TO VENDING MACHINES, AMENDING THE ST.
