HomeMy WebLinkAbout1424 - ADMIN Ordinance - City Council - 1978/10/04ORDINANCE NO.1424 AN ORDINANCE VACATING PUBLIC UTILITY EASEMENT THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. A petition in writing signed by a majority of all of the owners of all property abutting upon the public utility easement proposed to be vacated has been duly filed with the City Clerk, requesting vacation of the public utility easement, and the City Clerk has furnished a copy of said petition to the City Manager who has reported filing of same to the City Council, and the Clerk has published notice in the official City newspaper, the St. Louis Park Sun, on August 30, 1978 as directed by the Council, and the City Council has met at the time and place as published in said notice, and has conducted a public hearing upon said petition and has determined that the public utility easement is not needed for public purposes, and that it is for the best interest of the public that said public utility easement be vacated. Section 2. The following described public utility easement, as now dedicated and laid out within the corporate limits of the City of St. Louis Park, is vacated: The public utility easement platted along the northern, western, and southwestern boundaries of Lot 1, Block 1, Shelard Park; except for that portion of said easement lying within the ten feet of the public utility easement platted along the southeasterly side of Lot 1, Block 1, Shelard Park. Section 3. The City Clerk is instructed to prepare a Notice of Completion containing a copy of this ordinance and to file the Notice in the Office of the Register of Deeds or Registrar of Titles, in and for the County of Hennepin, Minnesota, as the case may be. Section 4. This ordinance shall take effect fifteen days after its publi- cation. J R RITCHAY, being duly sworn, on oath says he is and during all times here stated has been the vice president and printer of the newspaper known at The St Louis Park Sun and has full knowledge of the facts herein stated as follows (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches (2) Said newspaper is a weekly and is distributed at least once each week (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duphcate any other publication and is not made up entirely of patents, plate matter and advertisements (4) Said newspaper is circulated in and near the municipality which it purports to , serve, has at least 500 copies' regularly dehvered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park.
