LOUIS PARK DOES ORDAIN: Sec. 1. The St. Louis Park Ordinance Code is amended by adding Sections 13-1500, 13-1501, 13-1502 and 13-1503, to read: 1 1 CONDUCT OF TEMPORARY OUTDOOR RETAIL SALES Section 13-1500. License Required. No person shall engage in the conduct of a temporary outdoor retail sale without first having obtained a license to do so from the City Manager. Two or more retail establishments con- ducting a temporary outdoor retail sale may do so under a sale license issued to all members of the group, provided all establishments are located in a common trade area. Persons authorized to engage in outdoor sales and displays as provided by Chapter 14 of the Ordinance Code are exempt from the license requirement. The general provisions of Chapter 13 of the Ordinance Code of the City of St. Louis Park relating to the issuance of licenses shall govern temporary outdoor retail sales licenses, except as they are incon- sistent or in conflict with the provisions in this ordinance. The license may contain conditions to eliminate problems and hazards to the health and safety of persons and property which may be caused by traffic, security and access. If the owner of the premises where the temporary outdoor retail sale is to be conducted is not an applicant for the license, then the application shall be accompanied by a statement from the owner of the premises authorizing the applicant to use the premises for the purpose to be licensed. A temporary outdoor retail sale shall be no longer than four consecutive days and a business shall not conduct temporary outdoor retail sales on more than 12 days per calendar year. Section 13-1501. Place of Sale. Outdoor retail sales shall be operated in conjunction with an established retail business within a building or buildings, containing and selling the same or similar items. Section 13-1502. License Fee. The license fee shall be $50 for each day for which the license is issued. Section 13-1503. Inspections. All temporary structures used for temporary outdoor retail sales shall be inspected and approved by the Department of Inspectional Services, and all fire prevention equipment shall be inspected by the Fire Department prior to issuance of a license. Any person violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction, shall be punished by a fine of not more than $500 or by imprisonment for a period of not to exceed 90 days or both. Sec. 3. Effective Date. This ordinance shall take effect 15 days after its publication.
