ORDINANCE NO. 1405
AN ORDINANCE RELATING TO MEMBERSHIP AND TERMS OF
ADVISORY COMMISSIONS
THE CITY COUNCIL OF ST. LOUIS PARK DOES ORDAIN:
Sec. 1. The St. Louis Park Ordinance Code, Section
1-301(1)(2)(4)(5), Section 1-310(3)(4)(5), Section 1-341(1)(6)(8)(9)
and Section 1-401(1)(3), is amended to read:
PART 3 - Advisory Commissions
Planning Commission
Section 1-301. Membership of Commission and Terms.
(1) The Planning Commission shall be an advisory commission
and shall consist of eleven members, eight regular members
and three ex officio members all appointed as hereinafter
set forth.
(2) Eight regular members of the Commission shall be appointed
for terms of three years each by the City Council. Their
terms shall run until the 31st day of December of the year
in which their terms expire and until a successor is
appointed and qualified. Subsequent appointments shall be
for a three-year terms. In the event of a vacancy, the
Council shall appoint a person to complete the unexpired
term. A member of the Commission may be removed with or
without cause by the City Council.
(3)
One ex officio voting member and one alternate shall be
appointed by the Board of Independent School District No.
283 of St. Louis Park for a term of three years and until
their successors shall be appointed and qualify. The
member and alternate shall be residents of the City and
school district but need not be members of said board.
Such alternate may attend all meetings, and in the absence
of such member, shall vote and shall be counted in determining
a quorum. Failure of said school board to appoint its
member or alternate to serve on the Planning Commission shall
in no way affect the validity of the proceedings of the
Planning Commission.
(4) One ex officio member, who shall be a member of the City Council,
shall be appointed by the City Council for a one-year term. No
Council member shall serve as an ex officio member for more than
two consecutive years. Such members shall be appointed as soon
as practicable after the 1st day of January of each year to serve
until the 31st day of December of that year and until their suc-
cessors shall qualify. The Council member may vote in the situa-
tions where lack of quorum or tie vote -occurs.

One ex officio voting member, who shall be a representative
of the youth of the City, shall be appointed by the City
Council and serve a term of one year. Such member shall be
appointed as soon as practicable after the first day of
September each year. Such member shall attend all meetings,
shall vote and shall be counted in determining a quorum.

Parks and Recreation Advisory Commission
Section 1-310. Membership of Commission and Terms.
(1) The Parks and Recreation Commission shall consist of eleven
members, eight regular members and three ex officio members
all appointed as hereafter set forth.
(2) Eight regular members of the Commission shall be appointed by
the City Council for terms of three years each. No less than
five of said regular members shall be residents of the City.
At least one of said regular members shall be a woman. Three
of said regular members shall be residents of the School
District No. 283 but need not necessarily be a resident of the
City, and they shall be appointed by the City Council with the
approval of the Board of said independent school district for
terms of three years each. Subsequent regular appointments
shall be for three-year terms expiring on December 31st of the
third year of such term and until a successor is duly appointed.
In the event of a vacancy, the City Council shall appoint a
person to complete the unexpired term, such appointment being
made with the approval of the School Board in the same manner
as the original appointment.

Independent School District No. 283 for a three-year term
unless such appointment shall be sooner terminated by said
Board. The member and alternate to the Commission need not be
members of the Board but must be residents of the City. Such
member and alternate shall be appointed as soon as practicable
after the first day of January in the year in which such term
shall commence to serve until the 31st day of December of the
third year of such term and until their successors shall
qualify. Such alternate may attend all meetings and in the
absence of such member shall vote and shall be counted in
determining a quorum.

Section 1-311. Expenses of Members. The members of the Commission shall
serve without pay but may be reimbursed for actual expenses if funds
therefor are provided in the adopted budgets of the Park Fund and of the
Recreation Fund.
Section 1-312. Powers and Duties. The Commission shall have the power
to adopt bylaws and elect such officers for such terms as it deems desirable
from the eight members who are not members of the Council or the School
Board. It shall be the duty of the commission to hold meetings of its
members, and to meet from time to time with the City Manager or Director
of Recreation to consider such matters pertaining to public recreation
programs in the City as shall be referred to the Commission by the City
Council, City Manager, or Board of Independent School District No. 283,
or as the members of the Commission deem proper. The Commission shall
make an annual advisory'report not later thalAugust 1st, which shall
contain the Commission's recommendations to the Manager and Council for
the ensuing year. The Commission's advisory reports, conclusions and
recommendations shall be made to the City Council, City Manager or
Board of Independent School District No. 283, as may be requested, or
to any or all of them as the Commission deems appropriate in the light
of the matter under consideration.

Human Rights Commission
Section 1-340. Purpose. The purpose of the Commission shall be to
advise the City Council in its efforts to assure all citizens the oppor-
tunity for full and equal opportunity and participation in the affairs of
this community. The City of St. Louis Park declares as a matter of public
policy that it is interested in securing for all of its citizens equal
opportunity in housing, employment, public services, public accommodations
and education, and that it is the public policy of the City to assist the
State of Minnesota, Department of Human Rights in implementing the
Minnesota State Act Against Discrimination by the Commission's investiga-
tion of complaints, development and implementation of a program of
education, and compliance review, and through advising the City Council
on long range programs to improve human relations in the City of St.
Louis Park.
Section 1-341. Membership of Commission and Terms.
(1) The Commission shall consist of eighteen members,
fifteen regular members and three ex officio members
all appointed as hereafter set forth.
(2) Fifteen regular members, one of whom shall be an
attorney at law, shall be appointed by the City
Council. The initial appointments shall be for the
following terms of office, which term shall commence
on the date of their appointment: 5 members for a
term of three years, 5 members for a term of two years
and 5 members for a term of one year.
(3) All regular members of the Commission shall be citizens
and residents of the City of St. Louis Park. At the
expiration of the terms of office of the original
appointive regular members, their successors shall be
appointed for a term of three years each and until
their successors shall have been appointed and
qualify for office. Any vacancies in the regular
membership of the Commission shall be filled in the
same manner as in the case of an original appointment
for the unexpired term of a member whose office shall
be vacant.
Any regular member of the Commission may be removed
therefrom for cause by the City Council by a majority
vote.
The regular members of the Commission shall be persons
who have demonstrated an interest in and who have had

previous experience in civil and human rights
organizations on the national, state and local level,
due regard being given to the adequate representation
of racial, religious and ethnic minorities.
(6) One ex officio voting member and one alternate shall be

Section 1-342. Organization.
(1) There shall be an Executive Director who shall act as
Secretary to the Commission. He shall be appointed by the
City Manager with the consent and approval of the City
Council and be removed only for cause. The Executive
Director shall be under the administrative rules and
regulations of the City of St. Louis Park.
(2) The Commission shall elect its own chairman by vote of
its members. It shall provide its own rules and procedure
for the conduct of its affairs for the election, assumption
of duties and definition of responsibilities of officers
and committees, shall determine date and time of its
meetings, and upon whatever notice it deems best shall
call public hearings when necessary or desirable.
The Commission shall keep proper records of its
proceedings, and properly account for its receipts and
expenditures of monies in accordance with established City
procedures.

PART 4 - Boards
Board of Zoning Appeals
Section 1-401. Membership and Terms.
(1) The Board of Zoning Appeals shall consist of seven
members, six regular members and one ex officio
member as hereinafter set forth.
(2) Six regular members of the Commission shall be appointed
for the following terms, and until their respective
successors are appointed and qualified. The term of
office for the five present members shall remain unchanged.
The initial appointment of the sixth regular member shall
be for a term of five years ending December 31, 1972
and until his successor is,appointed and qualifies. All
subsequent appointments shall be for terms of five years
each. All appointments shall be made by the City Conncil
and all terms shall run until the 31st day of December
of the year in which their terms expire. In the event
of a vacancy the Council shall appoint a person to
complete the unexpired term. A member of the Commission
may be removed with or without cause by the City Council.
(3)
One ex officio member who shall be a member of the City
Council shall be appointed by the City Council for a one-
year term. No Council member shall serve as an ex officio
member for more than two consecutive years. Such member
shall be appointed as soon as practicable after the 1st day
of January of each year to serve until the 31st day of De-
cember of that year and until his successor shall qualify.
The Council member may vote in the situations where lack of
quorum or tie vote occurs.

Section 1-402. Organization. The Board shall elect its own Chairman,
Vice Chairman, and Secretary, and shall provide its own rules and
procedure, determine the date of time of meetings and call public hearings
when necessary and desirable. No member of the Board shall pass upon any
question in which he is directly or indirectly interested.
Section 1-403. Powers and Duties. The Board of Zoning Appeals shall
have the following powers and duties:

To hear and recommend proper action to the City Council
on appeals from any order, requirement, permit decision
or refusal or determination made by the Zoning
Administrator under the Zoning Ordinance and from any
interpretation of the text of the Zoning Ordinance, or

Sec. 2. This ordinance shall take effect 15 days after its
publication.
