LOUIS PARK ORDINANCE CODE THE CITY OF ST. LOUIS PARK DOES ORDAIN: Sec. 1. The St. Louis Park Ordinance Code is amended by adding Sections 4-205 through 4-208 to read: certify to the Council the names of persons signing or circulating such nominating petitions prior to action by the Council appointing said judges and clerks. Section 4-204. Prohibition. No person while receiving compensation from the United States, the state, or from any county, any city of the first, second or third classes, or any village having a population of more than 10,000 inhabitants, as an officer or employee thereof, shall be eligible to serve as a judge or clerk of any city election; and no person who is the husband, wife, parent, child, brother or sister of a candidate for an elective office shall be eligible to serve as judge or clerk in any election. Section 4-205. Vacancy Resulting from Election Contest. In any election contest where the court declares an office vacant for violation of Minnesota Statutes Chapter 210A, after the time for appeal has expired, or in the case of an appeal, after the final judicial determination of the contest, the Council shall, not later than the next regularly scheduled meeting following determination of an election contest by the court, call a primary and general election to fill the vacancy and fix their dates. Section 4-20.6. Election Contest Vacancy Filings. Nomination shall be by petition, as provided in Sections 4.06 and 4.07 of the City Charter, except that all nominating petitions shall be filed with the City Clerk no later than 14 days before the date specified in the resolution for the primary election. Section 4-207. Primary Election. A primary election shall be held on a date specified in the resolution but not later than the fourteenth day before the general election at which the vacancy is to be filled. In the event that not more than two persons have filed for nomination, no primary election shall be held. Section 4-208. Election Contest Vacancy Procedures. The procedure at the primary and general elections shall conform as nearly as possible to that provided for other municipal elections. Any person violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction, shall be punished by a fine of not more than $300 or by imprisonment for a period not to exceed 90 days or both. - Sec. 3. Effective Date. This ordinance shall take effect 15 days after its publication.
