ORDINANCE NO. 1400
AN ORDINANCE RELATING TO THE MOVING OF BUILDINGS
AMENDING SECTIONS 13-124 and 15-243(3) OF
THE ST. LOUIS PARK ORDINANCE CODE
THE CITY COUNCIL OF ST. LOUIS PARK DOES ORDAIN:
Sec. 1. The St. Louis Park Ordinance Code, Sections 13-124
and 13:2W3), is amended to read:

Section 13-123. The applicant shall deliver to the city certificates of
all required insurance on a form specified by the city clerk, signed by
an authorized representative and stating that all provisions of the
specified requirements have been satisfied. The certificate shall include
the identity of the insurer handling the errors and omissions coverage
for the agent executing the certificate. The certificate shall be sub-
mitted directly to the city clerk for review and approval by the city
attorney prior to the issuance of the license.

Section 13-124. Bonds Required. Applicants for the licenses or permits
listed in this section shall maintain in effect bonds in the penal sums
indicated.

All bonds shall be on a form prepared by the city and shall be approved
by the city attorney. All required bonds shall be in the penal sum
specified and shall be executed by a corporate surety. The bonds shall
be conditioned that the applicant will comply with all laws, ordinances
and regulations, will pay all fees and fines, and will hold the city
harmless from any damage that may result from the operations of the
applicant.

(2) Accompanying Papers.
(a) Tax Certificate. The owner of the building to be
moved shall file with the application sufficient
evidence that all real estate taxes and special
assessments against the building and lot from
which it is to be removed are paid in full.
(b) Certificate of Ownership or Entitlement. The
applicant, if other than the owner, shall file with
the application sufficient written evidence that he
is entitled to move the building.
(c) Consent of Public Utility Company. The applicant
shall file with the application prior to issuance of
permit, written evidence of arrangements with all
public utility companies whose wires, lamps or poles
are required to be removed, for the removal thereof
by the company.
(3) Fee. The application shall be accompanied by the following
permit fees:
(a) A building which is a detached accessory structure
including garages and storage sheds not exceeding 750
square feet shall pay a permit fee of $40.
(b) For all other buildings including family dwellings, the
permit fee shall be $80 for moves into the City; $50 for
moves out of the City; the permit fee shall be $25 to
transport a building through the City.
(c) If the building to be moved is located outside the
City, such fee shall be augmented by a charge of 15¢
per mile beyond the City limits to defray inspection
costs.

Section 15-244. Security Requirement.
(1) Cash Deposit. An application hereunder shall be accompanied
by a cash deposit in the sum of $500 as an indemnity for any
damage which the City may sustain by reason of damage or
injury to any highway, street or alley, sidewalk, fire
hydrant or other property of the City, which may be caused
by or be incidental to the removal of any building over,
along or across any street in the City, and for any expense
incurred by the City under Subdivision (2) of Section 15-246.

Sec. 2. Penalty. Any person violating the provisions of this
ordinance shall be guilty of a misdemeanor and upon conviction, shall
be punished by a fine of not more than $300 or by imprisonment for a
period not to exceed 90 days or both.
Sec. 3. Effective Date. This ordinance shall take effect 15 ,
days after its publication.

been the vice president and printer of the newspaper known at The St Louis Park Sun and
has full knowledge of the facts herein stated as follows (1) Said newspaper is printed in the
English language in newspaper format and in column and sheet form equivalent In printed
space to at least 900 square inches (2) Said newspaper is a weekly and is distributed at least
once each week (3) Said newspaper has 50% of its news columns devoted to news of local
interest to the community which it purports to serve and does not wholly duplicate any other
publication and is not made up entirely of patents, plate matter and advertisements (4) Said
newspaper is circulated in and near the municipality which it purports to serve, has at least
500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total
circulation currently paid or no more than three months in arrears and has entry as second-class
matter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park,
Golden Valley School District No 275 and Robbinsdale School District No 281 in the County
of Hennepin and it has its known office of issue in the City of Bloomington in said county,
established and open during its regular business hours for the gathering of news, sale of
advertisements and sale of subscriptions and maintained by the managing officer of said
newspaper or persons in its employ and subject to his direction and control during all such
regular business hours and devoted exclusively during such regular business hours and at which
said newspaper is printed (6) Said newspaper files a copy of each issue immediately with the
State Historical Society (7) Said newspaper is made available at single or subscription prices
to any person, corporation, partnership or other unincorporated association requesting the
newspaper and making the applicable payment (8) Said newspapei has complied with all
foregoing conditions for at least one year preceding the day or dates of publication mentioned
below (9) Said newspaper has filed with the Secretary of State of Minnesota prior to January
1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretaiy of
State and signed by the managing officer of said newspaper and sworn to before a notary
public stating that the newspaper is a legal newspaper
He further states on oath that the printed Ordinance No. 1400
hereto attached as a part hereof was cut from the columns of said newspaper, and was printed
and published therein in the English language, once each week, for Of' successive weeks,
