ORDINANCE NO. 1399
AN ORDINANCE RELATING TO NOISE, NOISE POLLUTION AND
VIBRATION, AMENDING SECTION 11-507.OF�THE ORDINANCE
CODE RELATING TO SOURCE REQUIREMENTS IN THE DDD AND
PUD ZONING DISTRICTS
THE CITY OF $T. LOUIS PARK DOES ORDAIN;
Sec. 1. Section 11-507(3) of the St. Louis Park Ordinance
Codei samended to read:

(b) Residential Development Units (RDU), Commercial Develop-
ment Units (CDU), and Industrial Development Units (IDU)
shall -be subject to the source level requirements of the
zoning district within which the RDU, CDU or IOU is incor-
porated.
(c) Planned Unit Development Districts (PUD) are assigned
source level requirements as follows:
(i) Lots 11 through 20, Block 3, Minikanda Vista
Second Addition, except the east 20 feet of
Lot 11 zoned PUD, shall be subject to source
level requirements identified for the B-1, B-.,
B-3, I-2 and I-3 Districts as prescribed in
Subsection (3)(a) above.
(ii) All of that area of Oak Park Village zoned PUD
except Blocks 5, 6, 7, 9 and 10, shall be subject
to source level requirements identified for the
R-1, R-2, R-3, R-4 and R -B Districts as prescribed
in Subsection (3)(a) above.
(iii) Blocks 5, 6, 7, 9 and 10 of Oak Park Village zoned
PUD and that land zoned PUD lying south of Walker
Street, east of Pennsylvania Avenue, north of
Highway 7, and west of the center line of vacated
Monitor Street lying between Walker Street and
Highway 7 and west of Block 186, Rearrangement
of St. Louis Park shall be subject to source level
requirements identified for the B-1, B-2, B-3, I-2,
and I-3 Districts in Subsection (3)(a) above.

Diversified Development Districts (DDD) are assigned
source level requirements as follows:

All of that area zoned DPD and bounded by the
north City boundary line, the MN&S Railroad,
West 16 Street, Zarthan Avenue, the center
line of Cedar Lake Road, extending easterly to
a line extending south from Cedar Lake Road to
the Burlington Northern Railroad parallel to
and 750 feet west of the west line of Vernon
Avenue, the Burlington Northern Railroad and
Highway 100 shall be subject to source level
requirements identified for the B-1, B-2, B-3,
I-2 and I-3 Districts as prescribed in Sub-
section (3)(a) above.

All that area zoned DDD and bounded by Highway
100, a line parallel and 340 feet south of the
center line of West 24 Street extending westerly
from Highway 100 to the northerly extension of
the east line of Lot 2, Block 1, Eaton's 3rd
Addition; then north along said northerly exten-
sion to the Burlington Northern Railroad, then
westerly along the north right of way line of
the Burlington Northern Railroad to the east
right of way line of the Minneapolis, Northfield
and Southern Railroad, then northerly along the
east right of way line of the Minneapolis, North-
field and Southern Railroad to the center line of
Cedar Lake Road, then easterly along Cedar Lake
Road to a line parallel to and 750 feet west of
the west line of Vernon Avenue, then southerly
along said line to the Burlington Northern Railroad
to Highway 100, shall be subject to source level
requirements identified for the R-1, R-2, R-3,
R-4, R -B Districts as prescribed in Subsection
(3)(a) above.
(e) In the event that all or part of an existing zoning
district becomes part of a DDD or PUD without the
definition of source level requirements, the activities
and persons within such area shall be subject to the
source level requirements of the zoning district of
which they were a part as of the effective date of this
ordinance.

Sound levels resulting from travel of motor vehicles on state
and county highways and railroads are exempt from these noise
source requirements but not other sections of this ordinance
relating to motor vehicles and railroads. There are other
noise sources which cannot meet these source requirements and
operational limits have been provided in this ordinance for
these specific sources. It is the intent of the city to reduce
highway noise in the various land areas surrounding highways to
or below the source requirements of this section when and wherever
possible.
All sound levels originating in any development or property
which contains one or more buildings and which is without
property lines for each building shall not exceed the source
requirements for the applicable zoning district measured at

the area of human activity, or if this is ill-defined, at
any point on a line, all of whose points are equidistant from
any two buildings.
(6) Noise sources shall reduce sound levels of noise in proportion
to their contribution when the cumulative effect results in a
violation and no specific noise source can be identified as a
violation.

Sec. Z. Penalty. Any person who violates this ordinance is guilty
of a misdemeanor and may be punished by a fine of not to exceed $300
or by imprisonment for not to exceed 90 days, or both.
Sec. 3. Effective Date. This ordinance shall take effect fifteen (15)
days after its publication.

newspaper or persons in its employ and subject to his direction and control during all such
regular business hours and devoted exclusively during such regular business hours and at which
said newspaper is printed (6) Said newspaper files a copy of each issue immediately with the
State Historical Society (7) Said newspaper is made available at single or subscription prices
to any person, corporation, partnership or other unincorporated association requesting the
newspaper and making the applicable payment (8) Said newspaper has complied with all
foregoing conditions for at least one year preceding the day or dates of publication mentioned
below (9) Said newspaper has filed with the Secretary of State of Minnesota prior to January
