HomeMy WebLinkAbout1397 - ADMIN Ordinance - City Council - 1977/12/19DECEMBER 19, 1977 10c ORDINANCE NO. 1397 AN ORDINANCE RELATING TO CATV; ESTABLISHING A MORATORIUM ON CONSTRUCTION OF FACILITIES THE CITY COUNCIL OF ST. LOUIS PARK ORDAINS: Section 1. Purpose. Ordinance No. 1236 was adopted on August 20, 1973, granting a CATV franchise to Warner Cable Co. of St. Louis Park for a period of 15 years. On October 9, 1973, Ordinance Nos. 1235 and 1236 were amended in certain respects relating to the commencement and sale of service. Immediately following the granting of the franchise, the franchisee, in good faith, took the actions necessary to secure approval by the FCC of the granting of the franchise, and commenced preparation for construction of its system. Subsequent to August 20, 1973, there has been a decline in public demand for CATV service, which combined with a slowdown in the nation's economy, has resulted in the virtual cessation of all construction of CATV systems in the United States. Until the resumption of public interest in and demand for CATV service occurs, it would be unreasonable to complete construction of a CATV system that will not presently be adequately utilized by the citizens of the city, and will probably be partially technologically obsolete by the time it is used. At the same time, it would be inequitable to forfeit the substantial investment which has been incurred in good faith by the franchisee to begin building a CATV system for the city. Section 2. Moratorium on Construction. Notwithstanding any provisions to the contrary, in Sections 9-701 through 9-726 of the St. Louis Park Ordinance Code, or in Ordinance Nos. 1236 and 1247, the franchisee, Jerrold Polinsky, shall not proceed further with construction of a broadband cable communications system for a period of three years from the effective date of this ordinance, provided that the Council shall review this moratorium annually and may terminate the moratorium on any such review. Section 3. Effective Date. This ordinance shall take effect fifteen (15) days after its publication. Adopted by the City Counc11 December 19, 1977.
