ORDINANCE NO. 1373
AN EMERGENCY ORDINANCE AUTHORIZING THE ACTING
CITY MANAGER TO ENTER INTO A CONTRACT FOR CON-
STRUCTION WORK TO BE UNDERTAKEN BY THE CITY IN
EXCESS OF $5,000 WITHOUT ADVERTISING FOR BIDS
FOR PERMANENT REPAIR OF WELL NO. 9
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The City Council hereby declares that the emergency
hereinafter defined exists and an emergency ordinance is necessary for the
immediate preservation of the public peace, health, morals, safety or
welfare in accordance with Section 3.05, 3.06, 3.08 and 5.06 of the Charter
of the City of St. Louis Park.
Section 2. The City Council hereby finds and determines the following
facts and declares the existence of an emergency as follows:
1. The City of St. Louis Park Water Department has reviewed the
condition of Deep Well No. 9 located at Louisiana Avenue and Cedar Lake
Road.
2. Said examination determined the pump shaft in Well No. 9 is broken.
3. That as a result of the foregoing, it is now necessary to
permanently repair the said pump shaft, motor and perform other
maintenance work at an estimated cost in the sum of approximately
$12,998, which work is beyond the capacity of presently -owned City
equipment and personnel.
4. That the prolonged inoperation of Well No. 9 as mentioned herein-
before could constitute a hazard due to inadequate water supply which
threat could result in public problems at any time and which hazard and
inconvenience makes necessary the immediate letting of a contract for
the emergency repair made necessary by the existing conditions, there
being insufficient time for the usual advertising for bids in the
manner required by charter.
5. The City Council hereby declares that an emergency exists in
connection with Well No. 9, justifying and requiring that this ordi-
nance upon its passage on the date hereof shall become effective
immediately without publication, to remove any hazard and inconvenience
to the public as hereinbefore described.
Section 3. The Acting, City Manager is`hereby, authorized to
negotiate a contract for the -repair of Deep_We11_No._9_her_e-inbefor-e-- - ---
descri:bed_and the Mayor -and -Acting City Manager are hereby authorized on
behalf of the City -to execute'al,l necessary -instruments for such materials,
equipment and construction -work- as,may= be -necessary. -
Section 4. This ordinance._shall.take effect immediately upon its
passage', without publication, on the 'date hereof.
