THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. That the following sections of the St. Louis Park Ordinance Code are hereby amended to read as follows: STREET, CURB AND GUTTER Section 6-102. Street Dedications. Upon acceptance of any deed or deeds transferring title of property to the City for street or alley purposes when initiated by a private property owner the City Council may require the grantor to pay the City Treasurer the cost of recording such deeds, plus the sum of One Hundred Dollars ($100). Section 6-135. Excavation Permit Fees. (1) For all temporary pavements and permanent pavements over five years old the permit fee shall be $3.00 per square foot up to 25 square feet with an additional $1.00 per square foot charge beyond 25 square feet, which shall be in addition to all other fees for permits or charges relative to any proposed construction work. (4) For excavations in public places which do not involve pavement, the permit fee shall be $2.00. Section 6-122. Application. Application for permit to construct, repair or remove sidewalk, curb, or curb and gutter or driveway shall be made to the City Engineer on forms, provided by him, which shall set forth the location where sidewalk, curb, or curb and gutter is to be so constructed or removed, the name of the owner and the name of the person who will actually do the work. No such permit shall be granted until the applicant shall have paid a fee to the City Treasurer in the sum of Ten Dollars ($10) for curb cutting and repair, Fifty Dollars ($50) for curb construction. In all cases where it is necessary for the City Engineer to make a survey and set grade stakes the permit fee shall be Thirty Dollars ($30.00) for curb cutting and repair, One Hundred Dollars ($100.00) for curb construction. Permits shall expire one year after issuance. VACATION Section 6-111. Street, Alley, and Utility Easement Vacations. No petition to vacate a street, alley or utility easement or portion thereof, shall be filed with the City Clerk until those petitioning therefor shall pay to the City Treasurer the sum of One Hundred Dollars ($100.00). If the Council denies the petition prior to publication of notice of hearing, one-half (1/2) of the fee shall be refunded to the petitioner. SEWER CONNECTIONS Section 9-205. Connection Fees and Charges. (1) Fee for permit for connection to a City sewer shall be $25.00 for each connection. In addition thereto, before any permit shall be issued, there shall be paid any sum required under Section 9-205(2). GAS Section 13-212. Qualifications of Applicants. Each person, firm or corporation desiring to engage in, or carry on, the business as above mentioned shall be well qualified to do so. Each individual applicant and each partner of a partnership applicant engaged in the work for which a license is required must pass a written examination to determine his qualifications before receiving his license. Such examination shall be conducted by the Director of Inspectional Services in consultation with the Minneapolis Gas Company. The Director of Inspectional Services may waive such examination of persons licensed by the City of Minneapolis to repair, alter or install gas piping and gas burning devices. No officer or employee - 2- 1 r of a licensee shall do any work for which the licensee is required to be licensed under this Ordinance until he shall have been examined to determine whether he is well qualified to do the work. Each individual licensee and each employee and officer of a licensee so examined, and found well qualified shall be issued a Certificate of Competence by the Director of Inspectional Services, Class A certificate being issued to licensees and Class B certificates being issued to officers and employees of a licensee. No such licensee or officer or employee thereof shall engage in, or carry on, business as above mentioned unless he shall have in his possession such a Certificate of Competence. Section 13-214. License Fee. The annual license fee for each such license shall be $50.00. HEATING, VENTILATING AND AIR CONDITIONING Section 13-223. License Fee. The annual fee for such license shall be $50.00. PLUMBING Section 13-232. License Fee. The annual license fee for such license shall be $50.00. NON -INTOXICATING LIQUOR Section 13-304. License Fee. The annual license fee for "on -sale" licenses shall be five hundred dollars ($500) and for "off sale" licenses shall be twenty-five dollars ($25.00) provided, however, that the City Council may issue special "on sale" license directly to established and bonafide veterans organizations, clubs and fraternal and charitable societies not engaged in the regular commercial sale to the public of non -intoxicating malt beverages and not organized for profit, and no part of the profits of the operation of which insure to the benefit of any individual members, for an annual license fee of Twenty-five dollars ($25.00). The fee for an "on -sale" wine license shall be one half (1/2) of the annual license fee for such an establishment as provided in Section 13-324. INTOXICATING LIQUOR Section 13-320. Definition of Terms. As used in this Ordinance: (12) The term "floor area" for the purpose of calculating the license fee shall be all of the floor area of the various floors of a licensed premise measured to the centers of all partitions, except those areas primarily for non -service purposes including, but not limited to dead storage, building management, toilets or restrooms mechanical equipment rooms and kitchens. -3- (13) The term "entertainment or dancing" shall mean any direct or organized effort on the part of management to attract clientele through but not limited to the provision of live musical, comical or dramatic entertainers, dancing by entertainers, vaudeville or similar entertainment, singing, contests, audience participation activities closed circiut television, television with screens exceeding 30 inches diagonally, ten or more mechanical amusement devices, modeling or fashion shows of any type or dancing by patrons. Section 13-324. Fees. (1) On Sale. The annual license fee for an "on sale" license shall be: Floor Area 0-3,000 3,001-6,000 Over 6,000 sq. ft. sq. ft. sq. ft. No Entertainment $4,500 $5,000 $5,500 Entertainment and/or Dancing $5,500 $6,000 $6,500 payable in two equal installments in advance, and a receipt for the first shall accompany the application for issuance or renewal of the license; the second installment shall be payable on or before the first day of July of each year. When any "on sale" license is issued for an unexpired portion of a license year, the fee shall be pro -rated and a receipt from the City Treasurer for the portion of the license fee due shall accompany the application, provided the minimum thereof shall be one half the license fee. Failure to pay the second installment of the license fee promptly when due shall be cause for revocation of any "on sale" license, without notice. MECHANICAL AMUSEMENT DEVICES Section 13-401. Definitions. Mechanical Amusement Devices. As used herein a mechanical amusement device is defined as a machine which, upon the inserbion of a coin, token or slug, operates or may be operated for use as a game, contest or amusement of any description, or which may be used for any such game, contest or amusement, and which contains no automotic pay-off device for the return of money coins, checks, tokens or merchandise, or which provides for no such pay-off by any other means or manner. The term mechanical amusement devices shall include pin -ball machines, mechanical miniature pool tables, bowling machines, shuffleboards, electric rifle or gun ranges miniature mechanical devices and games or amusements patterned after baseball, basketball, hockey, tennis, soccer, juke boxes and similar games, which may be used solely for amusement and not as gambling devices. 1 r Section 13-402. License Required. No person shall operate or rent, lease, or otherwise make available to another person to operate within the City of St. Louis Park a mechanical amusement device, as herein before defined, without first obtaining both an owners license and also a machine license therefor from the City Manager, but no such license shall be issued for any machine or device which is a gambling device. Section 13-404. The annual license fee for any individual or business owning a mechanical amusement device operated within St. Louis Park shall be determined according to the total number of machines located within the City. Number of Machines Owners License Fee 1 - 2 3 - 15 More than 15 $100.00 $300.00 $400.00 In addition an annual license fee for each mechanical amusement device shall be required. The annual license fee for each machine shall be $35.00. CHILDRENS AMUSEMENT DEVICES Section 13-414. License Fees. The annual license fee for such a license shall be $15.00 for each such amusement device. CARNIVALS AND CIRCUSES Section 13-423. License Fees. The fees for licenses to be issued under this ordinance shall be $200.00 for each day for which the license is issued. PUBLIC DANCE HALLS Section 13-433. License Fee. A license issued under this ordinance may be for one day only. The license fee for such period shall be $100.00. THEATERS Section 13-441. Application. The application for such license shall be accompanied by plans, if the theater proposed to be licensed has not yet been erected, and such application shall state the number of seats in said theater and the proposed parking facilities adjacent thereto. The applicant for such license shall pay to the City Treasurer the sum of $50.00 for publication and posting of a notice of such application, and thereupon the Clerk shall cause a notice of such application to be published in the official paper once a week for two successive weeks and shall post a copy of such notice in at least two conspicuous places in the vicinity of the proposed theater, which notice shall state the name of the applicant, the purpose for which a license is requested, the location of the premises in which the business of the applicant, when licensed, shall be carried on, and the time w11cn such application shall be presented to the City Council. Section 13-443. License Fee. The annual license fee for such a license shall be: Seating Capacity 0-400 401-700 701 - 1000 1001 - 1300 More Than 1300 TAVERNS License Fee $200.00 $250.00 $300.00 $350.00 $400.00 Section 13-343. License Fee. The annual license fee for such license shall be $2,000.00. GOLF DRIVING FAIRWAYS Section 13-452. License Fee. The annual license fee for such license shall be $100.00. DOGS Section 13-501. Dog License Required. No person shall own, keep, or harbor any dog over the age of three months within the City of St. Louis Park unless a license therefor has first been secured. Licenses shall be issued by the City Clerk for a fee of $5.00. It shall be the duty of each person owning, keeping, or harboring a dog to pay license fee imposed by this section to the City Clerk on or before the first day of February in each year, or upon acquiring ownership or possession of any unlicensed dog, or upon establishing residence in the City to forthwith pay such license fee. All dogs licensed hereunder must have a current rabies vaccination. The Clerk may cause a notice of the necessity of paying such license fee to be printed in the official newspaper in January of each year. Section 13-506. Redemption of Impounded Dogs. Any dog impounded may be redeemed by the owner within the time for redemption by payment to the City Treasurer of the current dog license fee, plus a penalty of twenty five dollars ($25.00) if the dog is not currently licensed, and an impounding fee according to the following schedule: When any one person has had a dog picked up and impounded one or more times during any 12 consecutive month period, the impounding charge shall be for the first pick-up $15.00, for the second pick-up $25.00, for the third and all subsequent pick-ups $50.00. In addition, a sum of $3.00 per day will be charged for board for each day or part thereof during the time the dog is impounded. The said feed may be paid on authorization of the City Council to its agent, pursuant to any contract that may be currently in effect providing for the impounding of dogs within the city and its kennels. KENNELS Section 13-513. License Fee. The annual license fee for such license shall be $200.00 for commercial dog kennels and $100.00 for animal hospitals. r 1 ANIMAL TRAINING SCHOOLS Section 13-543. License Fees. The annual license fee for such license shall be $100.00. TARGET AND TRAP SHOOTING Section 13-603. License Fee. The annual license fee for such target and trap shooting license shall be $100.00. EXPLOSIVES Section 13-614. License Fee. The annual license fee for such license shall be $100.00. EXCAVATIONS Section 13-633. Permit Fee. The fee for a permit shall be fifty dollars ($50.00) which shall accompany the application thereof. EXCAVATIONS -- FROZEN GROUND Section 13-642. Permit Fees. A permit shall be paid to the City Treasurer for issuance of such permit in the sum of twenty five dollars ($25.00). SIGNS AND BILLBOARDS Section 13-703. License and Bond. No person shall engage in the business of erecting signs, nor shall be entitled to a permit to erect a sign under this ordinance unless licensed to do so by the City Manager. Such license may be granted by the City Manager on written application to the City Clerk in such form as he shall prescribe and accompanied by an annual license fee of seventy five dollars ($75.00) and may be terminated by the City Manager at any time for cause. No license shall take effect until the licensee shall file with the City Clerk a bond with corporate surety in form approved by the City Attorney in penal sum of One Thousand Dollars ($1,000) conditioned that the licensee will pay all permit fees required under this ordinance, pay any fines imposed upon him for violation thereof, will conform to all of the provisions of this ordinance, and will indemnify and hold the City, its officers and agents, harmless from any damage or claim resulting from or related to the erection or maintenance of any sign in the City by the licensee. Section 13-708. Permit Fees. (2) Wall Signs. The fee for a wall sign not exceeding fifty (50) square feet, or fraction thereof in excess of one hundred (100) square feet in area shall be five dollars ($5.00). -7- r (3) (4) Ground, Roof and Projecting Signs. There shall be a minimum fee of ten dollars ($10.00) for the first four (4) square feet and twenty-five cents (250 for each additional square foot of area. The square foot area of all such signs shall be determined by multiplying their greatest width by their greatest length. Temporary Signs. For any permit for a temporary sign, up to ten (10) square feet in area, the fee shall be fifteen dollars ($15.00). For any sign over ten feet in area, the fee shall be twenty five dollars ($25.00). Section 13-709. Annual Inspection Fees. The Director of Inspectional Services shall inspect annually, or at such times as he deems necessary, each sign or other advertising structure regulated by this ordinance for the purpose of ascertaining whether the same is secure or insecure and whether it is in need of removal or repair; and to meet the expense of such inspection the permittee thereof shall pay to the City Treasurer a sum of twenty five dollars ($25.00), however, that no such annual inspection fee shall be made with respect to any sign which sets forth only the name of the owner of a business conducted on the premises where the sign is situated. BENCHES Section 13-741. Procedure for Issuance of Permits. A permit to install and maintain a bench on and along any public side- walk or way may be issued by the City Manager to a person by complying with the following requirements: (3) Each application shall be accompanied by an inspection fee of ten dollars ($10.00) payable to the City Treasurer for each such bench. (4) If the application is granted, an additional permit fee of fifteen dollars ($15.00) shall be paid to the City Treasurer for each such bench at the time the permit is issued. NEWSPAPER VENDING MACHINES Section 13-752. Application for Permit; Renewals. (3) Each initial application shall be accompanied by a permit fee of S15.00 per machine. The fee for each annual renewal shall be $15.00 per machine. -8- f 1 2 BICYCLES Section 13-763. License Fee. The license fee to be paid for each bicycle shall be one dollar ($1.00). Upon the loss of any tag or duplicate, and upon application and satisfactory evidence of such loss, a new tag or a new duplicate shall be issued upon payment of a fee of One Dollar ($1.00). FOOD ESTABLISHMENTS Section 13-803. License Fees. Fees for licenses issued hereunder shall be as set forth herein. (1) Food Establishment License Fees. The annual license fee for each food establishment, except catering food vehicles, bakery food vehicles, prepackaged food establishments, readily - perishable food vehicle, retail candy outlets, and retail candy shops, shall be $150.00, provided, however, that if more than on facility, such as, but not limited to, kitchen, bar bakery, meat market, grocery store, delicatessen, which would require food establishment licenses if operated separately, shall be located on the same premises, the license fee shall be an additional $25.00 for each such facility in addition to the $150.00 for the first such facility. (2) Packaged Food Establishments. The annual license fee for each packaged food establishment shall be $60.00. (3) Itinerant Food Establishments. The license fee for each itenerant food establishment shall be $60.00. (4) Retail Candy Shop License. The annual license fee for retail candy shop shall be $60.00 provided, further that if the candy shop is operated in conjunction with another facility, as provided in Section 13-803(1), the retail candy shop shall be an extra facility and a charge of $20.00 be added to the basic cost of the food establishment license. (5) Retail Candy Outlet License. The annual fee for a retail candy outlet shall be $20.00, provided, further that if the retail candy outlet is operated in conjunction with another facility requiring licensing under this ordinance, the retail candy outlet shall not be required to obtain a license. (6) Readily -Perishable Food Vehicles. The annual license fee for each readily -perishable food vehicle shall be $30.00 per vehicle for such vehicles not licensed under Section 13-803(7), fleet vehicles. -9- 1 (7) Readily -Perishable Food Vehicles - Fleet License. The annual license fee for a fleet of one or more readily -perishable food vehicles shall be $100.00. (8) Bakery Food Vehicle License Fee. The annual license fee for each bakery food vehicle shall be $25.00 per bakery food vehicle. FOOD VENDING MACHINES Section 13-913. License Fee. The annual license fee for the license herein required is fixed as follows: (1) For each vending machine dispensing food in a wrapped package or sealed bottle or container, fifteen dollars ($15.00) per annum for the first machine at one location and five dollars $5.00 for each additional machine at the same location. (2) For each vending machine dispensing readily perishable food or food in an open container twenty five dollars ($25.00) for the first machine at one location and fifteen dollars ($15.00) for each additional machine at the same location. SOFT DRINKS Section 13-933. License Fee. The annual license fee for such license shall be $25.00. GARBAGE AND REFUSE Section 13-1004. License Fee and Term. The annual fee for such collector's license shall be $100.00 for the first truck and $25.00 for each additional truck and all such licenses shall expire on December 31 of each year. SCAVENGERS Section 13-1023. License Fee. The annual license fee for such license shall be one hundred dollars ($100.00). SWIMMING POOLS Section 13-1103. License Fees. (1) The license fee for a public swimming pool(s) operating on a year-round basis shall be $150.00 for all such facilities at each location. (2) The license fee for a public swimming pool(s) operating on a seasonal basis shall be $100.00 for all such facilities at each location. -1 f)- d PUBLIC SANITARY FACILITIES Section 13-1132. License Fees. (2) The license fee for each person required to be licensed under Section 13-1131(2) shall be $50.00 annually in addition to $5.00 for each location. MASSAGE PARLORS, ESCORT SERVICES AND EMPLOYEES Section 13-1146. Fees. (1) Business License. The annual license fee for the operation of a massage parlor, massage or escort service business shall be $500.00 for all such facilities or businesses at each location. (2) Personal Service License. The annual fee for each massuese, masseur or escort shall be $50.00. GASOLINE SERVICE STATIONS Section 13-1313. License Fee. The annual license fee shall be: (1) $150.00 for each gasoline service station, plus $5.00 for the second and each additional fuel pump. (2) $50.00 for each private fuel outlet, plus $5.00 for the second and each additional fuel pump. PAWN BROKERS Section 13-1323. License Fee. The annual license fee for any license issued under this ordinance shall be $250.00. CHRISTMAS TREE SALES Section 13-1432. License Fee. The annual fee for such license shall be Fifty Dollars ($50.00). TAXI CABS Section 13-1446. License Fees for Certificate Holders. No certificate shall be issued or continued in operation unless the holder thereof has paid an annual license fee for the right to engage in the taxicab business of one hundred dollars (5100.00) each year plus twenty-five dollars ($25.00) each year for each vehicle operated under a certificate of public convenience and necessity. Said license fees shall be for the calendar year and shall be in addition to any other license fees or charges established by proper authority and applicable to said holder of the vehicle or vehicles under his operation and control. TAXI DRIVERS Section 13-1450. Application for Drivers License. An application for a taxicab driver license shall be filed with the City Clerk on forms provided by him; and .‘uch application shall be verified under oath and shall contain t1i@ following information. - 1' . r (1) The names and addresses of four residents of Hennepin County who have known the applicant for a period of five (5) years and who will vouch for the sobriety, honesty and general good character of the applicant. (2) The experience of the applicant in the transportation of passengers. (3) The educational background of the applicant. (4) The concise history of his employment. Each application shall be accompanied by a certificate from a reputable physician of Hennepin County certifying that in his opinion, the applicant is not afflicted with any disease or infirmity which might make him an unsafe or unsatisfactory driver. At the time the original application is filed the applicant shall pay an investigation fee to the City Treasurer in the sum of twenty five dollars ($25.00). This fee shall not be refundable. TOWING Section 13-1478. Fees. The annual license fee shall be $100.00. The annual driver permit fee shall be $10.00. SPECIAL PERMITS Section 14-215. Special Permits. No application for a special permit under the provisions of the St. Louis Park Zoning Ordinance as amended, shall he filed until the applicant shall have paid to the City Treasurer the sum of Three Hundred Dollars ($300.00) for applications filed under section 14-195 of the ordinance code and Two Hundred Dollars ($200.00) all other special permit applications. SUBDIVISIONS Section 13-303. Procedure. (2) Preliminary Plan. Before subdividing any tract of land the subdivider shall submit a preliminary plan of the subdivision for the approval of the City Council in the following manner. (ii) Filing Fee. A fee of $100.00 plus $20.00 for each lot in excess of four in the R-1, R-2, R-3 district not to exceed $1,000.00 or $300.00 plus $50.00 for each acre in excess of four in any other district not to exceed $2,000.00 shall be paid to the City Treasurer, for the preliminary and final plat. No additional fee is required with respect to the final plat application. 1 BUILDING MOVING Section 15-243. (3) Fee. The application shall be accompanied by a permit fee in the amount of $200.00. Section 2. That the following sections of the St. Louis Park Ordinance Code are hereby repealed: 13-240; 13-241; 13-242; 13-243; 13-244; 13-730; 13-731; 13-732; 13-733; 13-734; 13-735; 13-1010; 13-1011; 13-1012; 13=1013; 13-1014; 13-1301; 13-1302; 13-1303; 13-1304; 13-1305; 13-1306; 13-1433; 13-1434; 13-1435; 13-1436.
