HomeMy WebLinkAbout1344 - ADMIN Ordinance - City Council - 1976/09/20SEPTEMBER 7, 1976 ORDINANCE NO. 1344 AN ORDINANCE VACATING UTILITY EASEMENT THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. It is hereby determined that a petition in writing signed by a majority of all of the owners of all property abutting upon both sides of the utility easement proposed to be vacated has been duly filed with the City Clerk, requesting vacation of the utility easement, and the City Clerk has furnished a copy of said petition to the City Manager who has reported filing of same to the City Council, and the Clerk has published notice in the official City newspaper, the St. Louis Park Sun on August 25, 1976, as directed by the Council and the City Council has met at the time and place as published in said notice and has conducted a public hearing on said petition and hereby determines that the utility easement is not needed for public purposes, and that it is for the best interests of the public that said utility easement be vacated as petitioned. Section 2. The following described utility easement, as now dedicated and laid out within the corporate limits of the City of St. Louis Park, is vacated: All that part of the drainage and utility easement in Block 1, Target First Addition, which lies adjacent to and 40 feet southerly of the northerly line of Lot 3, and all that part of said easement which lies adjacent to the easterly line of Lot 2, all lying westerly of a line drawn parallel with and distant 35 feet westerly of the easterly line of Lot 2 and its southerly extension, except for the westerly 10 feet thereof. Section 3. The City Clerk is instructed to prepare a Notice of completion containing a copy of this ordinance and to file the Notice in the Office of the Register of Deeds or Registrar of Titles, in and for the County of Hennepin, Minnesota, as the case may be. Section 4. This ordinance shall take effect fifteen days after its publication.
