AN ORDINANCE RELATING TO THE ST. LOUIS PARK
BUILDING CODE: AMENDING THE ST. LOUIS PARK
ORDINANCE CODE SECTIONS 5:101, 5:105,
5:110, 5:120, 5:125, 5:130 and
ADDING SECTIONS 5:106, 5:110.1 and 5:110.2
THE CITY COUNCIL OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The St. Louis Park Ordinance Code, Sections 5:101, 5:106, 5:110,
5:110.1, 5:110.2, 5:120, 5:125 and 5:130 are amended to read:
Section 5:101. Title. Sections 5:101 to 5:135 inclusive shall be known as
the "St. Louis Park Building Code", and are referred to herein as "this Building
Code".
Section 5:105. Application for Permits. The applicant shall submit with each
application for a building permit, and at other times when required by the Building
Official for enforcement ofd any provisions of the Building Code, three sets of com-
plete plans and specifications, showing all essential parts of the building, and
four copies of a certified survey showing the location of other existing and pro-
posed buildings on the premises. Surveys shall be certified by a "Registered
Land Surveyor", duly qualified by registration as required by law.
Plans and specifications, unless expressly excluded by this Building Code,
shall be prepared and signed by a "Registered Architect" or a "Registered
• Professional Engineer" duly qualified by registration as required by law.
EXCEPTIONS: When authorized by the Building Official, plans and specifications
need not be submitted for the following:
(1) One-story buildings of Type V conventional wood -stud construction
with an area not exceeding 600 square feet;
(2) Group J, Division 1, occupancies of Type V conventional wood -stud
construction;
(3) Small and unimportant work.
Section 2. The St. Louis Park Ordinance Code, Chapter 5, is amended by adding a
section to read:
Section 5:106. Permit Fees. A fee for each building permit shall be paid
to the City as set forth in Table No. I.
The determination of value or valuation under any of the provisions of this
Code shall be made by the City. The valuation to be used in computing the permit
and plan -check fees shall be the total value of all construction work for which
the permit is issued, as well as all finish work, painting, roofing, electrical,
plumbing, heating, air conditioning, elevators, fire -extinguishing systems and
any other permanent work or permanent equipment.
Where work for which a permit is required by this Code is started or pro-
ceeded with prior to obtaining said permit, the fees specified in Table No. I shall

be doubled, but the payment of such double fee shall not relieve any persons from
fully complying with the requirements of this Code in the execution of the work
e nor from any other penalties prescribed herein.

(a) Plan -checking Fees. When the valuation of the proposed construction
exceeds $1,000.00 and a plan is required to be submitted by Section 5:105, a
plan -checking fee shall be paid to the City at the time of submitting plans and
specifications for checking.
Said plan -checking fees for buildings of Groups I and J Occupancies
shall be one-half of the building permit fees. Plan -checking fees for all other
buildings shall be 65 percent of the building permit fees as set forth in Table
No. I.
Where plans are incomplete, or changed so as to require additional
plan -checking, an additional plan -check fee shall be charged at a rate established
by the City.
The permit fee to demolish any building which is connected to a sewage
disposal system or a water supply shall be $25.00. The permit fee to demolish
all other buildings shall be $5.00.
Section 5:110. Certificate of Occupancy, New Construction. No person,
co -partnership, corporation or association shall use or occupy any building or
structure in Groups A to J inclusive until the City has made an occupancy in-

spection and issued a Certificate of Occupancy therefore as provided herein.
Section 5:110.1. Certificate of Occupancy, Occupant Change. No person,
co -partnership, corporation, or association shall permit any change in occupant
of an existing building or structure or portion thereof in Groups A to H in-
clusive or Group J or any change in ownership of the building or structure
until the City has made an occupancy inspection and issued a Certificate of
Occupancy therefore as provided herein. The City may post buildings or struc-
tures subject to occupancy inspection.
Section 5:110.2. Certificate of Occupancy, Occupancy Change Inspection Fee.
The occupancy inspection fee for all structures for change in occupancy or owner-
ship as required in Section 5:110.1 except licensed apartment buildings shall be
$30.00.
Section 5:120. Adoption of Minnesota Building Code by Reference. The
Minnesota Building Code and Appendix "A" thereto prepared by the Department of
Administration, State of Minnesota and filed with the Secretary of State and
the Commissioner of Administration January 14, 1974, is hereby adopted and in-
corporated herein shall be controlling within the City of St. Louis Park. At
least three copies of said Code shall be on file in the office of the Clerk of
the City of St. Louis Park for use and examination by the public and shall be
marked "Official Copies".
Section 5:125. Adoption of Uniform Building Code by Reference. The Uniform
Building Code (U.B.C.) 1973 Edition, prepared by International Conference of
Building Officials is hereby adopted and incorporated herein and except for the
portions of said Codes specifically excepted below shall be controlling within
the City of St. Louis Park. At least three (3) copies of said Code shall be on
file in the office of the Clerk of the City of St. Louis Park for use and exam-
ination by the public and shall be marked "Official Copies".
The following portions of the "Uniform Building Code" are excepted from
this ordinance and shall have no effect in the City of St. Louis Park:
(a) Those certain sections of Part 1, "Administrative" found on pages
21 through 34, inclusive as follows: Sections 201; 202, (a), (b), and
(c); 203; 204; 205; 301, (c); 303 (a), (b); 306, (a) and (b) and
(e). All of Chapter 1 and all of Chapters 4 through 60 and all
Appendix chapters, namely 12, 23, 38, 48, 49, 57 and 70.
Section 5:130. Violations Declared. It shall be unlawful for any person
to erect, construct, design, enlarge, alter, repair, move, improve, remove,
convert or demolish, equip, use, occupy, or maintain any building or structure
in the City or cause the same to be done, contrary to or in violation of this
Building Code.
Section 3. Penalty. Any person violating any of the provisions of this Code
shall be guilty of a misdemeanor, and each such person shall be deemed guilty
of a separate offense for each and every day or portion thereof during which
any violation of any of the provisions of this Code is committed, continued,
or permitted, and upon conviction of any such violation such person shall be
punishable by a fine of not more than $300.00 or by imprisonment for not more
than 90 days or both.

Section 4. Effective Date. This ordinance shall take effect fifteen days after
its publication.
