LOUISPARKSUN 6601 W. 78th St. Bloomington, Minnesota State of Minnesota County of Hennepin SS. J R RITCHAY, being duly sworn, on oath says he is and during all times here stated has been the vice president and printer of the newspaper known at The St Louis Park Sun and has full knowledge of the facts herein stated as follows (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches (2) Said newspaper is a weekly and is distributed at least once each week (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements (4) Sald newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park, Golden Valley School District No 275 and Robbinsdale School District No 281 in the County of Hennepin and it has its known office of issue in the City of Bloomington in said county. established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the news• paper and business related thereto (8) Said newspaper files a copy of each issue immediately with the State Historical Society. Ordinance No 730, Sec- tion 8 032 59 is amended to read Section 6 032 59 Senior Citizen Housing. A residential housing de- velopment, or that portion of a hous- mg development, in which 80 percent or more of the units, exclusive of any unit occupied by a caretaker, consist of units meeting the following re- quirements (a) The units are designed for occu- pancy by individuals over 00 years of age or by an elderly cou- ple with one or both members over 60 years of age (b) These units shall be designated for occupancy by the elderly for a duration of at least ten years No amendment to the special permit that changes the designation of these units for occupancy by the elderly shall be made within ten years Any such amendment after ten years must be adopted by a vote of at least five members of the City Council (c) If required by the City, the owner of the property shall re- cord a covenant on the property executed m a form approved by the City which indicates the fact that the property is designated for occupancy by the elderly (d) The development is owned or leased by the Housing Authority of the City of St Louis Park or is assisted by the U S Department of Housing and Urban Develop- ment under one of its programs for housing low- and moderate - income elderly Or such housing is constructed by a profit or a nonprofit organization which can demonstrate experience and a commitment to housing for the elderly, and provided such agency shall record at least e 20 -year covenant and other land use controls on the property, exe- 1 cuted in a form approved by the City, which will limit use of the property or a portion thereof to the occupancy by the elderlyj under the terms of the prove- cions governing senior citizen,! housing (e) The development provides for a� lounge or other inside community' rooms amounting to at least•15- square feet for each unit (f) The development is provided with other special features which' meet the needs of low- and moderate -income elderly per-. sons Section 2 This ordinance shall take effect 15 days after its publication i Adopted by the City Council De- cember 15, 1975 FRANK FLEETHAM Attest Mayor EARL HANSON: City Clerk Approved as to form and legality WAYNE POPHAM City Attorney Reviewed for administration CHRIS CHERCHES City Manager (Dec 24, 1975)—SLP-GV File No. Affidavit of Publication Si LOUISPARKSUN St. Louis Park, Minnesota In The Matter Of
