ORDINANCE NO. 1289
AN ORDINANCE AMENDING SECTIONS -
5.01 AND 5.02 OF THE ST. LOUIS
PARK HOME RULE CHARTER

Section 1. Section 5.01 of the Home Rule Charter of the City of
St. Louis Park entitled "The City Manager" is amended to read:
Section 5.01. The City Manager. The city manager shall be the
chief administrative officer of the city. The manager shall be
chosen by the council solely on the basis of training, experience
and administrative qualifications. The choice shall not be limited
to inhabitants of the city or state but all candidates shall be
citizens of the United States. The city manager shall be appointed
for an indefinite period and be removed by the council at will,
provided, however, that if removed at any time after three years
of service, the city manager may within fifteen days after said
removal demand written charges and a public hearing on the same
before the council; but pending and during such hearing the
council may suspend the city manager from office, with or without
pay. Such public hearing shall take place within thirty days
after the demand for the same and the written charges shall be
furnished to the city manager by the council nt least ten days
before the hearing. During the suspension, absence or disability
of the city manager, the duties of this office shall be performed
by some properly qualified person designated by the council as
acting manager.
Section 2. Section 5.02 of the Home Rule Charter of the City of
St. Louis Park entitled "Powers and Duties of the City Manager" is
amended to read:
Section 5.02. Powers and Duties of the City Manager. Subject
to the provisions of this charter and any regulations consistent
therewith which may be adopted by the council, the city manager
shall control and direct the administration of the city's affairs.
The powers and duties of the city manager shall be:
(a) To enforce this charter and the laws, ordinances
and resolutions of the city;
(b) To appoint with the consent and approval of the
Council all department heads and subordinate officers
as set forth in Section 5.04 in the city charter; to
appoint all other employees; to remove for cause, with
the consent and approval of the Council, all permanent
employees;
(c) To exercise control over all departments and divisions
of the city administration created by this charter or
which may be hereafter created by the council;

(d) To attend all meetings of the council, with the
right to take part in the discussions but having no
vote; but the council may at its discretion exclude
the city manager from meetings at which removal of
the city manager is considered;
(e) To recommend to the council for adoption such
measures as may be deemed necessary for the welfare
of the people and the efficient administration of
the city's affairs;
(f) To keep the council fully advised as to the
financial condition and the needs of the city, and
to prepare and to submit to the council the annual
budget;
(g) To perform such other duties as may be prescribed
by this charter or required of the city manager by
ordinances or resolutions adopted by the council.
Section 3. This ordinance shall take effect ninety days after its
passage and publication.

J R RITCHAY, being duly sworn, on oath says he is and during all times here stated has
been the vice president and printer of the newspaper known at The St Louis Park Sun and
has full knowledge of the facts herein stated as follows (1) Said newspaper is printed in the
English language in newspaper format and in column and sheet form equivalent in printed
space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least
once each week (3) Said newspaper has 50% of its news columns devoted to news of local
interest to the community which it purports to serve and does not wholly duplicate any other
publication and is not made up entirely of patents, plate matter and advertisements (4) Said
newspaper is circulated in and near the municipality which it purports to serve, has at least
500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total
circulation currently paid or no more than three months in arrears and has entry as second-class
matter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park,
Golden Valley School District No 275 and Robbinsdale School District No 281 in the County
of Hennepin and it has its known office of issue in the City of Bloomington in said county,
established and open during its regular business hours for the gathering of news, sale of
advertisements and sale of subscriptions and maintained by the managing officer or persons
in its employ and subject to his direction and control during all such regular business hours
and devoted exclusively during such regular business hours to the business of the news-
paper and business related thereto (6) Said newspaper files a copy of each issue immediately
with the State Historical Society (7) Said newspaper has complied with all the foregoing conditions
for at least two years preceding the day or dates of publication mentioned below (8) Said
newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1968 and each
January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed
by the publisher of said newspaper and sworn to before a notary public stating that the newspaper
is a legal newspaper
He further states on oath that the printed Ordinance No. 1289
hereto attached as a part hereof was cut from the columns of said newspaper, and was printed
and published therein in the English language, once each week, for one successive weeks,
that it was first so published on Thurs the 10
day of Apri 1 19
and was thereafter printed and published on every _ to and including
the day of 19_ and that the following is a printed copy
of the lower case alphabet from A to Z, both inclusive, and is hereby acknowledged as being
the size and kind of type used in the composition and publication of said notice, to -wit
