AN ORDINANCE RELATING TO ZONING: AMENDING
ORDINANCE 730, SECTIONS 6:051 AND 6:212; AND
ADDING SECTION 6:058, PLANNED UNIT DEVELOPMENT
DISTRICT
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. Ordinance 730, Section 6:051 is amended to read:
Section 6:051 - Districts - For the purpose of this Ordinance, the City
of St. Louis Park is hereby divided into the following Use Districts and
groups of Use Districts:
"R" DISTRICTS
R-1 Single Family Residence District
R-2 Single Family Residence District
R-3 Two Family Residence District
R-4 Multiple Family Residence District
"B" DISTRICTS
R -B Residence - Business District
B-1 Neighborhood Business District
B-2 General Business
B-3 Business District
"I" DISTRICTS
I-1 Industrial District
I-2 Industrial District
1-3 Industrial District
"PUD" DISTRICT
PUD Planned Unit Development District
Reference in this Ordinance to "R", "B", "I", and "PUD" Districts shall refer
to the Use District Groups as above set forth, and reference to specific
Use Districts shall be by reference to the individual districts listed
above as "R-1", "R-2", and so forth.
Flood Plain District - In addition, there is hereby created the F-2, Flood
Plain District which has specific zoning regulations superimposed upon the
existing zoning districts and which supersede the underlying use district
regulations only to the extend expressed in the provisions of the Flood
Plain District. In all other aspects, the regulations in the underlying
zoning use districts are applicable.

Section 2. Ordinance 730 is amended by adding Section 6:058.
Section 6:058 - PUD - PLANNED UNIT DEVELOPMENT DISTRICT
Section 6:058.1. The purpose of this Use District is to provide for total planned
development for those areas which are essentially vacant, designated for
redevelopment, or because of other features such as existing development,
planned streets, vegetation, slopes, wetlands, lakes or streams, should
be developed under the provisions of this district. The objectives are
to permit and promote greater flexibility to allow more creativity and
imaginative design, and to promote more efficieu: uses of the land while
preserving existing landscape amenities and allowing harmonious development
consistent with the City's plans.
Section 6:058.2 Requirements for FUD Special Permit. Within any PUD District,
there shall be no construction and/or expansion of buildings or
structures nor shall any new land use be established or an existing land
use expanded without obtaining a special permit for the specific
development. Application for the special permit shall include the
submission of detailed site and development plans for development of
all or an appropriate portion of the site. The plans must be in
compliance with the General PUD Plans, and must consist of the following:
Subd. 1. A plan to scale showing the subject property; all easements
affecting the property; and within 200 feet of the site, indication of
all easements, public park and open space, public buildings, private
land use, subdivisions and private property and structures, provided
that if there are no structures within 200 feet of the site, indication
of the nearest sLructure.
Subd. 2. A topographic map and plans showing contour intervals of not
more than 2 feet of elevation; trees in excess of 1 foot in diameter;
water bodies, wetlands and water courses; existing structures, roads;
sewer lines, water lines, power and gas lines and related elements.
Subd. 3. A detailed site plan showing the location, shape and size of all
proposed structures, the location and size of all roads, points and
facilities, proposed improvements, ::11 public open spaces and dedications,
utility improvement including storm sewers, water, sanitary sewer;
retaining walls and fences, lighting facilities, signs, land uses
and their density and intensity of development including number of
dwelling units, type of units, floor area ratio, ground floor area
ratio, open space, usable open space, parking required and parking
provided, building elevation plans showing heights, materials and
colors.
Subd. 4. Documents providing for the recording or showing of individual
properties to be recorded as well as common property, covenants, home
owners association provisions and the like.
Subd. 5. A landscape plan showing proposed landscape improvements by size,
type and species and location.

Subd. 6. Plans for circulation of cars,• pedestrians, and mass transit,
including transit plazas and shelters, and associated facilities
where appropriate.
Subd. 7. Interim uses of lands and buildings will be considered where
permanent uses and buildings are not feasible. Such interim use
shall be consistent with the approved General PUD plans to the
extent possible, and the duration of such interim use shall be
5 years or less.
Section 3. Ordinance 703, Section 6:212 is amenddd to read:
Section 6:212 - Additional Requirements for Amendments:Changing
Zoning Districts and Boundaries Thereof.
Section 6:212.1. Applications - All applications for changes in the
boundaries of any zoning district which are initiated by the
petition of the owner or owners of the property, the zoning of
which is proposed to be changed, shall be accompanied by a map
or plat showing the lands proposed to be changed and all lands
within two hundred (200) feet of the boundaries of the property
proposed to be rezoned, together with the names and addresses of
the owners of the lands in such areas as the same appear on the
records of the County Auditor of Hennepin County.
Section 6:212.2. Procedure for PUD Zoning. Applications for establishment
of the PUD District shall be made pursuant to the provisions of
Sections 6:211 and 6:212.1 and also in accordance with the additional
special requirements of this Section.
Subd. 1. Sketch Plan Submitted before Application.
(1) Prior to the initiation of a zoning change application, owners
of property in the proposed PUD District are invited to prepare, for
review with the Planning Director, development sketch plans which,
in order to be most useful, should contain the following information:
Proposed general development and use, significant topographical
and physcial features, streets on and adjacent to the tract, scale
and tract boundaries and north point.
(2) Such sketch plans submitted shall be for informal discussion
between the developer and the Planning Director. Submission of sketch
plan shall not constitute formal filing of an application.
(3) As far as may be practicable on the basis of a sketch plan, the
Planning Director shall informally advise the owner as promptly as
possible of the extent to which the proposed plan conforms to the
design standards of this ordinance and discuss possible plan modifi-
cations necessary to secure conformance. The sketch may be reviewed,
where applicable, by the Planning Commission, the Housing Authority,
and the City Council.
Subd. 2. Additional Special Requirements.
(1) The proposed use(s) must be in general harmony (consistent) with
the Comprehensive Plan.
(2) All proposals shall include a General PUD Plan for the site.

Subd. 3. Preliminary General PUD Plans. Submission of an application
for PUD zoning shall be accompanied by preliminary plans for the
proposed Planned Unit Development. These plans shall be submitted
and reviewed in the following manner:
(1) Submission. Three copies of the preliminary plans shall be filed
with the Planning Director. The plans shall contain the following
information: Legal description of the property involved; graphic
scale; north point; date of preparation; boundary line of the area;
acreage; adjacent streets (within 200 feet of the site, indication
of all easements, public park and open space, public buildings,
private land use, subdivisions and private property and structures,
provided that if there are no structures within 200 feet of the
site, indicate the nearest structure) topographic data, water courses,
wetlands, trees and wooded areas; proposed streets or private roads;
open spaces and preservation areas; proposed buildings, structures
and uses of the property; density of development; and other relevant
features of the proposal.
(2) Review. The preliminary plans will be reviewed by the Planning
Commission for possible comment. Within 60 days after submission
to the Planning Commission, it shall transmit the proposed change to
the City Council for its possible comment.
Subd. 4. Final General PUD Plans: Completed Application. Upon review
by the Council of the preliminary general PUD plans, the applicant
shall prepare final general PUD Plans. Three copies of the General
PUD plans shall be submitted to the Planning Director and such plans
shall contain all of the information and detail as required on all
site plans. These plans shall be submitted to the Planning Commission
as a part of the completed application for zoning change. Further
processing of the application shall be as in the case of all other
applications for zoning change.
Subd. 5. Uses,Density and Lot Requirements. The uses permitted, density
of development, lot requirements and associated elements shall be
determined on the basis of (1) Comprehensive Plan; (2) available or
proposed community facilities such as streets, water, sewer, storm
sewer, parks, open space, and transportation, topography, vegetation
soil conditions, and (3) existing & proposed developing in the area.
Subd. 6. Approval by Council. Approval by the Council of the establishment
of a PUD District shall incorporate the general PUD plans as a part
of the zoning district boundary change. Subsequent amendment to the
plans shall require an amendment to this ordinance.
Section 6:212.3. Notice - The City Council upon receiving the recommendation
of the Planning Commission respecting any proposed change, or after
sixty (60) days from the submission thereof to the Planning Commission
without a recommendation, shall consider the same, and if a majority
of the Council are in favor thereof, notice of a regular or special
meeting, at which a public hearing willbe had thereon, shall be
given by publication at least once in the official newspaper, not
less than ten (10) days and not more than thirty (30) days prior
to said hearing, stating the time and place thereof, description of
property to be changed, and a general statement of the nature of
the proposed change. Not less than ten (10, nor more than thirty (30)

days prior to said hearing, a copy of said notice shall also be
served, in the manner provided by law for service of a summons
in a civil action, upon all known adult occupants of the actual
land proposed to be changed, and a copy of said notice shall be
mailed by the City Clerk to all owners of said land, as the same
appear upon the records of the County Auditor of Hennepin County,
and addressed to the last known address, as shown by said Auditor's
records; provided that such notices need not be served on, or mailed
to, persons who have signed a written petition for the rezoning,
or served on occupants of the property the owner or owners of which
have been personally served or have signed a written petition for
the rezoning. A copy of said notice shall be likewise mailed to
all owners of property situated within two hundred (200) feet of
the property to be rezoned, as the same then appear on the records
of the County Auditor. If attempt is made in good faith to serve
all persons in the manner and at the times above provided, failure
to serve one (1) or more through inadvertence shall not invalidate
the proceedings. Proof of service shall be made by the affidavit
of the persons serving same and shall be filed with the City Clerk.
Section 6:212.4. Hearings - At the time set for the hearing, the City
Council shall hear arguments for and against said proposed change,
and may continue said hearing from time to time not exceeding
sixty (60) days from the original date specified in the notice of
hearing. Final vote on the proposed change shall be taken within
said sixty (60) days.
Section 5. This ordinance shall take effect 15 days after its
publication.
