AFFIDAVIT OF PUBLICATION

J R RITCHAY, being duly sworn, on oath says he is and during all times here stated has
been the vice president and printer of the newspaper known as The St Louis Park Sun and
has full knowledge of the facts herein stated as follows (1) Said newspaper is printed in the
English language in newspaper format and in column and sheet form equivalent in printed
space to at least 900 square inches (2) Said newspaper is a weekly and is distributed at least
once each week (3) Said newspaper has 50% of its news columns devoted to news of local
interest to the community which it purports to serve and does not wholly duplicate any other
likvblication and is not made up entirely of patents, plate matter and advertisements (4) Said
spaper is circulated in and near the municipality which it purports to serve, has at least
copies regularly delivered to paying subscribers, has an average of at least 75% of its total
circulation currently paid or no more than three months in arrears and has entry as second-class
iitter in its Local post -office (5) Said newspaper purports to serve the City of St Louis Park
,he County of Hennepin and it has its known office of issue in the City of Bloomington in
aid county, established and open during its regular business hours for the gathering of news,
sale of advertisements and sale of subscriptions and maintained by the managing officer or
persons in its employ and subject to his direction and control during all such regular business
hours and devoted exclusively during such regular business hours to the business of the news-
paper and business related thereto (6) Said newspaper files a copy of each issue immediately
with the State Historical Society (7) Said newspaper has complied with all the foregoing
conditions for at least two years preceding the day or dates of publication mentioned below
(8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966
and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State
and signed by the publisher of said newspaper and sworn to before a notary public stating that
the newspaper is a legal newspaper
He further states on oath that the printed OrrlinannA Nn. 1239
hereto attached as a part hereof was cut from the columns of said newspaper, and was printed
and published therein in the English language, once each week, for o uuccessive weeks;
that it was first so published on Thurs the 13 day of September 19 73

AN ORDINANCE PROVIDING FOR
THE REMOVAL OF SNOW, ICE, AND
RUBBISH FROM SIDEWALKS, THE
ELIMINATION OF WEED$ FROM
PUBLIC AND PRIVATE PROPERTY,
THE REPAIR OF SIDEWALKS :AND
THE COLLECTION OF THE COSTS AS
A SPECIAL ASSESSMENT, AMEND-
ING THE ST LOUIS PARK ORDI-
NANCE CODE SECTIONS 1 651, 1655
and 1 656
THE CITY COUNCIL OF THE CITY
, OF ST LOUIS PARK ORDAINS
Section 1 Section 1 651 of the St Louis
Park Ordinance Code is amended to read
Section 1 651 Snow, Ice and Rubbish a
Public Nuisance on Sidewalks - Removal
by Owner
(a) All snow ice and rubbish being on a
public sidewalk in such quantities, or in
such a manner, as to render the use of the
sidewalk by a pedestnan unsafe is here-
by declared a public nuisance
( b) The owner or occupant of any prop-
erty abutting a public sidewalk shall re-
move and clear away all snow, ice and I
rubbish from so much of the sidewalk' as '
is in front of or abuts on the property as
follows
11 I Snow and ice shall be removed from
all sidewalks in all business and industrial
districts within 4 business hours after the
cessation of any fall of snow, sleet or
freezing rain or by the beginning of busi-
ness hours of the next business day fol-
lowing such fall, whichever period is
shorter Snow and ice shall be removed
from all other sidewalks on the same day
of the cessation of any fall of snow, sleet
or freezing ram when at least 6 hours of
daylight remain after the cessation, or i
otherwise by noon on the following day,
whichever period is longer
12) Rubbish shall be removed from all
sidewalkf within 12 hours after its acc)1

Section 2 Section 1 655 of the St Louis
Park Ordinance Code is amended to read
Section 1 655 Notice
(a) Snow, Ice and Rubbish Removal
When an owner or occupant permits a
nuisance to exist in violation of Section
1 651, the city clerk shall serve a notice
on the owner of the property ordering
removal or elimination of the nuisance
within the period allowed by Section
1 651 The notice shall state that in for
event of non-compliance, removal of
elimination will be done by the city of St
Louis Park at the owner's expense, and
that if the expenses are not paid prior to
the following September 1 the charge for
the work will be made a special assess-
ment against the property When no own-
er or agent of the owner can be found, no-
tice shall be sent by certified mail to the
person who is hsted on the records of the
county auditor or county treasurer as the
owner Service will be complete upon
mailing
(bl Sidewalk Repair and Weed,Ehmi-
nation When an owner or occupant per-
mits a nuisance to exist in violation of
Sections 1 652, 1 653 or 1 654, the city
clerk shall serve a notice on the owner of
the property ordering removal, elimina-
tion, or repair of the nuisance within sev-
en days after the service of the property
The notice shall state that in the event of i
non-compliance, removal or ehmination
will be done by the city at the owner's
expense, and that if the expenses are not
paid pnor to the following September 1
the charge for the work will be made a
special assessment against the property
When no owner or agent of the owner can
be found, notice shall be sent by certified
mail to the person who is hsted on the
records of the county auditor or county
treasurer as the owner Sernce will be

Section 3 Section 1 656 of the St Louis
Park Ordinance Code is amended to read
Section 1656. Abatement by City U the
owner or occupant fails to comply with
the notice within the period allowed for
compbance after sernce, or if no owner,
occupant or agent can be found the direc-
tor of public works shall
la) Cause the snow or ice or rubbish
constituting the nuisance to be removed
or
)b) In the case of a pubhc sidewalk
which is unsafe and in need of repairs,
report the facts to the city manager who
in turn shall report them to the City Coun-
cil The Council thereupon, by resolution,
may order the city mana:er to'cause the
