AN ORDINANCE VACATING A PORTION OF STREET
ON DAKOTA AVENUE LYING BETWEEN WEST LAKE
STREET AND HAMILTON AVENUE
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. It is hereby determined that a petition in writing,
signed by a majority of all of the owners of property abutting upon
both sides of the street hereinafter described, has been duly filed
with the City Clerk, requesting vacation of said portion of street,
and the City Clerk having furnished a copy of said petition to the
City Manager who has reported filing of same to the City Council,
and the Clerk having published notice in the official City newspaper,
the St. Louis Park Sun on April 19, 1973, as directed by the Council,
and the City Council having met at the time and place as published
in said notice and having conducted a public hearing on said petition
and having determined that said portion of street is not needed for
public purposes, and that it is for the best interests of the public
that said portion of street be vacated as petitioned.
Section 2. The following described portion of street, as now
dedicated and laid out within the corporate limits of the City of
St. Louis Park, is hereby vacated:
lying within the bounds of the following described
line beginning at the most westerly point of Tract B,
RLS #450 and extending south westerly to the intersection
with a line which is the westerly line of Lot 37, Block 173,
extended southeasterly; thence southeasterly along said
line to the southwest corner of Lot 9, Block 1,
Rearrangement of St. Louis Park; thence north along
the west line of Block 1, Rearrangement of St. Louis
Park and along the west line of Tract C, RLS #450 to
the point of beginning.
Section 3. The City Clerk is hereby instructed to prepare a Notice
of Completion containing a copy of this ordinance and to file the same
for record forthwith in the Office of the Register of Deeds or Registrar
of Titles, in and for the County of Hennepin, Minnesota, as the case may be.
Section 4. This ordinance shall take effect fifteen days after
its publication.

J R RITCHAY, being duly sworn, on oath says he is and during all times here stated has
been the vice president and printer of the newspaper known as The St Louis Park Sun and
has full knowledge of the facts herein stated as follows (1) Said newspaper is printed in the
English language in newspaper format and in column and sheet form equivalent in printed
space to at least 900 square inches (2) Said newspaper is a weekly and is distributed at least
once each week (3) Said newspaper has 50% of its news columns devoted to news of local
interest to the community which it purports to serve and does not wholly duplicate any other
publication and is not made up entirely of patents, plate matter and advertisements (4) Said
newspaper is circulated in and near the municipality which it purports to serve, has at least
aii. copies regularly delivered to paying subscribers, has an average of at least 75% of its total
culation currently paid or no more than three months in arrears and has entry as second-class
tter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park
the County of Hennepin and it has its known office of issue in the City of Bloomington in
said county, established and open durmg its regular business hours for the gathering of news,
sale of advertisements and sale of subscriptions and maintained by the managing officer or
persons in its employ and subject to his direction and control during all such regular business
hours and devoted exclusively during such regular business hours to the business of the news-
paper and business related thereto (6) Said newspaper files a copy of each issue immediately
with the State Historical Society (7) Said newspaper has complied with all the foregoing
conditions for at least two years preceding the day or dates of publication mentioned below
(8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966
and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State
and signed by the publisher of said newspaper and sworn to before a notary public stating that
the newspaper is a legal newspaper
He further states on oath that the printed Ordinance No. 1221
hereto attached as a part hereof was cut from the columns of said newspaper, and was printed
and published therein in the English language, once each week, for one i;ttccessive weeks,
that it was first so published onThurs the 17 day of May

and was thereafter printed and published on every to and including
