AN ORDINANCE REQUIRING CONNECTION WITH THE
PUBLIC SEWER SYSTEM AND PROHIBITING PRIVATE
SEWAGE DISPOSAL SYSTEM; ADDING SECTIONS
1:700, 1:711 AND 1:712; AMENDING SECTIONS
1:706, 1:757 AND 1:770; REPEALING SECTIONS
1:750, 1:756 AND 5:1006 OF THE ST. LOUIS
PARK ORDINANCE CODE
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. Chapter 1 of the St. Louis Park Ordinance Code is amended by
adding Section 1:700 to read:
Section 1:700. Connection with Public Sewer System Required. After
Oct. 1, 1973, any structures situated on property from which sewage is
disposed and abutting a portion of the St. Louis Park public sanitary sewer
system shall be connected to the public sanitary sewer system, and any
such structures not so connected by Oct. 1, 1973 shall be completely
disconnected from the pr=vate sewer system, and such private sewage disposal
system shall be filled or otherwise abandoned in a manner approved by the
City Manager or his designee.
Section 2. Section 1:706 of the St. Louis Park Ordinance Code is amended
to read:
Section 1:706. Connections - How Made. All work relating to sewer
connections shall comply with the following:
a. Permits shall be procured before breaking ground in any street
or alley for such work, as required by Section 1:620.
b. After the pipe is properly laid the refilling must proceed
at once and it must be thoroughly tamped or puddled or both and so
done that there shall be no surplus earth left.
c. If there is a deficiency of earth to fill the excavation, the
plumber doing the work shall supply such deficiency with clean sand
or approved material.
d. No rock larger than four inches across or thick may be put
into any excavation within two feet of cover over pipe.
e. Street, sidewalk, or driveway within the public right-of-way
removed on this permit must be relaid at the expense of the plumber
and to the specifications of the City.
f. All work must be done under the supervision of the City, and
all drain pipes from public sewers shall be inspected by the City
before beim covered up.
g. All work performed under this ordinance within the public
right-of-way shall be guaranteed by the contractor for one year
from the date of final approval by the City.
h. No person shall build a fire within any sewer or drain for
any purpose whatsoever.
Section 3. Chapter 1 of the St. Louis Park Ordinance Code is amended
by adding Section 1:711 to read:
Section 1:711. Notice. If the owner of any such property does not
connect to the public sewer system on or before Oct. 1, 1973, the City
Manager or his designee shall serve a notice on the owner or agent of the
owner of such property to connect with the public sewer system within ten
days after the service of such notice. Such notice shall also state that,
in the event of non-compliance, connection will be done by the City at the
owner's expense. When no owner or agent of the owner can be found, notice
shall be sent by registered mail to the person who is listed on the records
of the county auditor or county treasurer as the owner. Service will be
complete upon mailing.
Section 4. Chapter 1 of the St. Louis Park Ordinance Code is amended by
adding Section 1:712 to read:
Section 1:712. Abatement and Assessment. If such person fails
to comply with the notice within ten days after service, the City Manager
or his designee shall have such property connected to the public sewer system.
A record showing the cost of such work attributable to each separate lot or
parcel shall be delivered to the City Clerk. Any such cost and expenses
shall be charged and billed to the owner of such property. If payment is
not received within ten days after -such billing to either the owner or agent
of the owner, the amount so charged against said lot or parcel of land,
together with a description of the premises and the name of the owner shall
be certified to the County Auditor and shall be collected in the same
manner as taxes and special assessments against said premises. The charge
shall be a perpetual lien on the premises until paid. No clerical error or
informality in such tax bill, or in the proceedings leading up to its issuance,
shall invalidate or be a defense thereto.
Section 5. Section 1:757 of the St. Louis Park Ordinance Code is amended
to read:
Section 1:757. Discharge of Prohibited Substances. No person shall
discharge or permit to be discharged, directly or indirectly, into the public
sanitary sewer system of the City:
a. rain or surface water from roofs, yards, lawns, streets,
alleys, sidewalks or driveways.

b. water or other fluid used for the operation of air-cooling
and air-conditioning equipment in plants or units;
c. any gasoline, napths, benzine, kerosene, turpentine, or
any spirit gas or fluid, or any material of an explosive
or suffocating nature, or that may possibly create combustible
or suffocating gases or vapors;
d. gravel, sand, dirt or any other heavy material;
e. any substances prohibited by the Metropolitan Sewer Board, the
City Manager, or his designee.
Section 6. Adoption by Reference.
a. Metropolitan Sewer Board Regulations. The Sewage and Waste
Control Rules and Regulations for the Metropolitan Disposal
System, dated December 1, 1971 by the Metropolitan Sewer
Board are hereby adopted and incorporated herein by reference
and three marked official copies of said rules and regulations
shall be kept on file by the City Clerk.
b. State Plumbing Code. The Minnesota State Plumbing Code, dated
February 1, 1971, is incorporated herein by reference, and three
marked official copies shall be kept on file by the City Clerk.
Said Code shall apply to all public sewer connections required
by this ordinance.
Section 7. Section 1:770 of the St. Louis Park Ordinance Code is amended
to read:
Section 1:770. Penalty.
1. Any person violating the provisions of this ordinance shall be
guilty of a misdemeanor and upon conviction thereof shall be punished
by a fine of not more than $300 or by imprisonment not to exceed 90
days or both.
2. A separate offense shall be deemed committed upon each day
during or on which a violation occurs or continues.
Section 8. Sections 1:750, 1:756, and 5:1006 of the St. Louis Park
Ordinance Code are hereby repealed.
Section 9. Effective Date. This ordinance shall take effect 15 days
after its publication.
