ORDINANCE NO. 1 198
AN ORDINANCE RELATING TO THE EXEMPTION OF HANDI-
CAPPED PERSONS FROM CERTAIN PARKING RESTRICTIONS BY
ADDING SECTIONS 3:138.01 THROUGH 3:138.05
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. Sections 3:138.01 through 3:138.05 are hereby added to
the St. Louis Park Ordinance Code, which sections shall read as follows:
Section 3:138.01. Findings. The City Council finds that there
are a number of residents of the City of St. Louis Park who, by reason of
a heart condition, arthritis or similar serious impairment of their
ability to walk long distances, are put to substantial and unnecessary
hardship by the application of certain of the ordinances of the City
prohibiting parking upon certain residential streets. The Council
further finds such persons to constitute a reasonable classification for
purposes of parking ordinance application, and therefore adopts this
ordinance to promote the health and safety of the community.
Section 3:138.02. Arplication. Any person who, by reason
of a heart condition, arthritis or similar serious impairment of his
ability to walk long distances, may make application to the City Manager,
containing such information as the City Manager shall require, for
authorization to park his vehicle on a street in front of his residence
for periods of time longer than those established by existing ordinances.
Section 3:138.03. Investigation. The City Manager shall, upon
receipt of the application, refer it to the Police Department for
investigation and report upon the traffic conditions of the street where
the applicant resides and upon the probable effects of granting the
application.
Section 3:138.04. Issuance of Permit. The City Manager shall
consider the report of the Police Department and evaluate the effects of
issuance upon the public safety and health. If the City Manager finds that
the public safety and health would be promoted by the granting of the
application, and that the applicant otherwise complies with all applicable
regulations of the City, he may issue the applicant a permit which shall
specify the identity of the applicant's vehicle, and the time and location
when and where the parking of that vehicle will be permitted.
Section 3:318.05. Permit Fee. The annual permit fee shall be $2.50.

Section 2. Penalty. Any person violating the provisions of this
ordinance shall be guilty of a misdemeanor and upon conviction shall be
punished by a fine of not more than three hundred dollars or by
imprisonment for not to exceed 90 days, or both.
Section 3. Effective Date. This ordinance shall take effect
fifteen days after its publication.

publication and is not made up entirely of patents, plate matter and advertisements (4) Said
newspaper is circulated in and near the municipality which it purports to serve, has at least
500 copies regularly delivered to paying subscnbers, has an average of at least 75% of its total
circulation currently paid or no more than three months in arrears and has entry as second-class
atter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park
the County of Hennepin and it has its known office of issue in the City of Bloomington in
id county, established and open during its regular business hours for the gathering of news,
ale of advertisements and sale of subscriptions and maintained by the managing officer or
persons in its employ and subject to his direction and control during all such regular business
hours and devoted exclusively during such regular business hours to the business of the news-
paper and business related thereto - (6) Said newspaper files a copy of each issue immediately
with the State Historical Society (7) Said newspaper has complied with all the foregoing
conditions for at least two years preceding the day or dates of publication mentioned below
(8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966
and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State
and signed by the publisher of said newspaper and sworn to before a notary public stating that
the newspaper is a legal newspaper
He further states on oath that the printed Ord. No. 1198
hereto attached as a part hereof was cut from the columns of said newspaper, and was printed
and published therein m the English language, once each week, for one_successiveweeks;
