ORDINANCE NO. 1191
AN EMERGENCY ORDINANCE AMENDING THE FOLLOWING
SECTIONS OF THE ST. LOUIS PARK ORDINANCE CODE
RELATIVE TO THE POSITION CLASSIFICATION PLAN,
COMPENSATION PLAN, BASIC PERSONNEL POLICY AND
CONDITIONS OF CITY EMPLOYMENT: SECTION 1:308
COMPENSATION, SECTION 1:314 OVERTIME PAYMENT;
AND SECTION 1:316B INJURY ON DUTY PAY
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The City Council hereby declares that the emergency
hereinafter defined exists and that an emergency ordinance is necessary
for the immediate preservation of the public peace, health, morals, safety
or welfare in accordance with Sections 3.05, 3.06 and 3.08 of the Charter
of the City of St. Louis Park.
Section 2. That Section 1:308 (A) (1) of the St. Louis Park Ordinance
Code entitled "Compensation Plan" is hereby amended to add the following:
Section 1:308 (A) (1) Basic Tables of Numbered Pay Ranges.
Each numbered pay range in the basic tables
consists of a minimum and maximum bi-weekly
rate with intermediate pay steps at approximately
five per cent (57) intervals. Said basic tables
shall be amended to add the following:

Section 3. That Section 1:314 of the St. Louis Park Ordinance Code
entitled "Overtime Payment" is hereby amended to read as follows:
Section 1:314. Overtime Payment. Authorized overtime work of
employees shall be compensated on the basis of one and one-half times
the regular rate of pay, either by cash payment or by compensatory time
off, as provided herein except that department and division heads and other
employees designated as supervisory personnel shall not be eligible for nor
shall they receive compensation for over -time work.

Authorized over -time work on other than a regular work day for all classes
of employees on regular 40 hour per week shifts shall be compensated at
the over -time rate for the actual hours worked but not less than three
hours regular pay. Any such employee instructed by his superior to stand
by and be subject to call on a Sunday or Holiday not included in the regular
work week shall be compensated therefor by a minimum of four hours regular
pay. Overtime shall be computed on the basis of the number of hours actually
worked in a work week in excess of the number of working hours in the regular
work week for the position involved.
A11 sworn members of the Fire Department shall be compensated at the rate
of one and one-half times the regular pay of the highest grade Firefighter
based upon the regularly scheduled work week shift for emergency call backs
with a minimum of one hour being paid for all calls, and calls over one
hour in length to be calculated in thirty minute intervals, payable
annually upon filing of a verified claim.
Over -time work in any bi-weekly pay period not amounting to four hours of
regular pay shall be compensated by cash payment. When over -time work in
a bi-weekly pay period amounts to more than four hours of regular pay,
the portion thereof in excess of four hours, or the highest multiples
thereof, shall be compensated by cash payment; the balance may be
compensated by cash payment or compensatory time off, at the discretion
of the City Manager. Such compensatory time off shall be taken as
designated by the Department Head and approved by the City Manager but
for periods of not less than four consecutive hours at a time, or multiple
thereof; and such compensatory time off shall either be designated or
approved by the Department Head, but for periods of not less than four
consecutive hours at a time, or multiple thereof; and such compensatory
time off shall either be designated by the Department Head within six
consecutive bi-weekly pay periods following the pay period in which earned,
or shall be compensated by cash payment.
Section 4. That Section 1:316 B. of the St. Louis Park Ordinance Code
entitled "Injury on Duty Leave" is hereby amended to read as follows:
Section 1:316. Sick Leave, Injury on Duty Leave and Severance Pay.
B. Injury on Duty Leave
Leave of absence with pay shall be granted to sworn Police
Officers and sworn members of the Fire Department who become
incapacitated as a result of injury or occupational disease
incurred through no misconduct of their own while in actual
performance of City assigned duties. This shall exclude
any injuries sustained while performing any voluntary off-duty
services for which payment is made by a contracting party
other than the City.

(1) Extent of Leave. Such injury leave shall extend for a
maximum of ninety (90) calendar days, unless it is determined
sooner by competent medical authority, approved by the City
Manager, that the employee can return to any duties for which
he may be capable and qualified. At the discretion of the
City Manager, the injured employee may be required to submit
to a medical examination at any time by a physician selected
by the City.
(2) Method of Payment. During such injury leave, the City
shall pay such employee his full pay, either as direct payment
from salary funds or as Workmen's Compensation insurance benefits,
or both, but the total amount so paid for loss of time from work
shall not exceed the full pay which such employee would have
received for period at his regular rate of pay. Such injury
leave shall not be charged against the employee's sick leave
or vacation leave.
(3) Notice of Injury - Failure to Report. An employee who is
physically incapacitated and who fails to report within eight
(3) hours, followed by a written report within twenty-four
(24) hours, any injury, however minor, to his supervisor and
to take such first aid or medical treatment as may be necessary
under the circumstances, shall not be eligible for injury leave
as outlined above.
Section 5 This ordinance shall take effect December 27, 1971 in
accordance with Sections 3.05, 3.06, and 3.03 of the Charter of the City
of St. Louis Park and shall be signed and published in accordance with
Section 3.07 of the City Charter of the City of St Louis Park.

been the vice president and printer of the newspaper known as The St Louis Park Sun and
has full knowledge of the facts herein stated as follows (1) Said newspaper is printed in the
English language in newspaper format and in column and sheet form equivalent in printed
space to at least 900 square inches (2) Said newspaper is a weekly and is distributed at least
once each week (3) Said newspaper has 50% of its news columns devoted to news of local
interest to the community which it purports to serve and does not wholly duplicate any other
publication and is not made up entirely of patents, plate matter and advertisements (4) Said
wspaper is circulated in and near the municipality which it purports to serve, has at least
copies regularly delivered to paying subscribers, has an average of at least 75% of its total
culation currently paid or no more than three months in arrears and has entry as second-class
atter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park
the County of Hennepin and it has its known office of issue in the City of Bloomington in
said county, established and open during its regular business hours for the gathering of news,
sale of advertisements and sale of subscriptions and maintained by the managing officer or
persons in its employ and subject to his direction and control during all such regular business
hours and devoted exclusively during such regular business hours to the business of the news-
paper and business related thereto (6) Said newspaper files a copy of each issue immediately
with the State Historical Society (7) Said newspaper has complied with all the foregoing
conditions for at least two years preceding the day or dates of publication mentioned below
(8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966
and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State
and signed by the publisher of said newspaper and sworn to before a notary public stating that

Section 1 The City Council hereby de-
