ORDINANCE NO. 1178
AN ORDINANCE REGULATING THE DESIGN AND CONSTRUC-
TION OF SWIMMING POOLS; ADOPTING MINNESOTA REGU-
LATION MHD 115 RELATING TO PUBLIC SWIMMING POOLS;
ADOPTING THE AMERICAN PUBLIC HEALTH ASSOCIATION
REGULATIONS FOR THE DESIGN AND CONSTRUCTION OF
PRIVATE RESIDENTIAL SWI'IMING POOLS; REQUIRING
LICENSES FOR PUBLIC SWIMMING POOLS; PROVIDING
FOR INSPECTIONS; AND PROVIDING PENALTIES FOR
VIOLATIONS OF THE PROVISIONS THEREOF BY
ADDING SECTION 2:1670.01 THROUGH 2:1670.47
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The construction, operation and licensing of
swimming pools shall be regulated as follows:

Section 2:1670.01. Definitions. The following definitions
shall apply in the interpretation and enforcement of this ordinance
and the following words and terms wherever they apply in this or-
dinance are defined as follows:
(a) Health Authority shall mean the duly appointed health
officials of the City of St. Louis Park.
(b) Health Department, Health Officer, State Board of
Health, Board used at any place in this ordinance and in the
requirements adopted by reference shall mean the Health Authority
of St. Louis Park.
(c) Person shall mean any individual, natural person,
firm, association, organization, partnership, business institution,
agency, or any Federal, State or local government agency or in-
strumentality or other entity recognized by law as the subject
of rights and duties, and shall include, but not be limited to,
employees, licensees, tenants, caretakers, lessees, managers and
operators of swimming pools.
(d) Private Residential Pool shall mean any swimming pool
located on private property under the control of the homeowner,
permanent or portable, the use of which is limited to swimming or
bathing by his family or their invited guests, and having a depth
• of more than two feet (24 inches) at any point and (a) a surface
area exceeding 250 square feet, or (b) a volume over 3,250 gallons.
(e) Public Swimming Pool shall mean any swimming pool,
other than a private residential pool, intended to be used
collectively by numbers of persons for swimming and bathing, operated
by any person as defined herein, whether he be owner, lessee,
operator, licensee, or concessionaire, regardless of whether a fee
is charged for such use.
(f) Special Purpose Pool shall mean any swimming pool
used as a treatment pool, therapeutic pool, or a special pool for
water therapy.
(g) Swimming Pool shall mean any structure, basin, chamber,
or tank containing an artificial body of water for swimming, diving,
relaxation or recreational bathing.
(h) Wading Pool shall mean any swimming pool used or
designed to be used exclusively for wading or bathing and having
a maximum depth of 24 inches.
Section 2:1670.03. License Required. No person shall
own, operate, maintain, lease or be responsible for any public
swimming pool unless a license therefore, issued pursuant to this
ordinance, shall have been obtained from the City Manager.
Section 2:1670.05. License Fees.
(a) The license fee for a public swimming pool(s)
operating on a year-round basis shall be $100.00 for all such
facilities at each location.
(b) The license fee for a public swimming pool(s)
operating on a seasonal basis shall be $50.00 for all such facilities
at each location.
Se7.tion 2:1670.07. Combination License Fees. In the
event that any one person shall be required at several locations
on a single contiguous tract of land to have two or more licenses
required by Section 2:1670.03 the combination fee shall be
computed by adding to the first license fee required one half the
specified fee for such additional licenses as may be required.
Section 2:1670.09. License Fee Exemptions. Persons
owning, operating or maintaining schools, governmental subdivisions,
Houses of Worship, convents, rectories, parsonages or religious
community centers shall be required to obtain a license but without
payment of a license fee.
Section 2:1670.11. License Application, Issuance, Main-
tenance and Administration. The application for a public swimming
epool license shall be made on forms furnished by the City Manager
and shall set forth such information as the City Manager shall require.
Such application for an issuance of such licenses, their maintenance,
termination and administration shall be in accordance with and
subject to all conditions of the St. Louis Park Ordinance Code
relative to general reauirements for issuance of licenses by the
City of St. Louis Park and the requirements of this ordinance. If
such requirements have not been complied with, the City Manager
shall deny the application for issuance of the license.
Section 2:1670.13. Revocation of License. Any license
issued as required under this ordinance may be revoked in the manner
provided in Sections 2:15 and 2:16 of the St. Louis Park Ordinance
Code, on the grounds therein provided, or for a violation of any
provision of this ordinance.
Section 2:1670.15. Plan Checking Fee For Public Swimming
Pools. A plan checking fee of $25.00 shall be paid to the City
Treasurer at the time of submitting plans and specifications for
review and approval as required in Section 2:1670.19.
Section 2:1670.17. Plumbing, Electrical, and Ventilation.
• All plumbing, electrical and mechanical installations and equipment
shall meet the requirements of the St. Louis Park Building Codes.
Section 2:1670.19. Approval of New Construction, Repair,
Remodeling, or Alteration. No person shall construct, enlarge,
repair, move, convert, or alter any swimming pool without first
submitting plans and obtaining approval of the Health Authority and
the appropriate permits from the Department of Protective Inspection.
The St. Louis Park Department of Protective Inspection shall not
issue any permits for such work until such permits have the approval
of the Health Authority endorsed thereon.
Section 2:1670.21. Equipment Standards. All new equip-
ment purchased or installed on any swimming pool after the effective
date of this ordinance shall comply with the following standards
of the National Sanitation Foundation when applicable:

Equipment not covered by the National Sanitation Foundation
Standards shall not be installed or used before it has been approved
by the Health .Authority.
Section 2:1670.23. Fencing Requirements. Fencing or other
effective means, including but not limited to walls or buildings,
acceptable to the Health Authority shall be provided to positively
control all access to public swimming pools and private residential
pools. Fencing shall meet the following criteria:
(a) The fencing shall prevent the entrance of children
eand be without hand or foot holds that would enable a child to
climb over it.
(b) The fencing shall be at least 4 feet high and entrances
shall be equipped with self-closing and self -latching gates capable
of being locked.
Section 2:1670.25. Access and Inspections. The Health
Authority shall have access to and shall inspect all swimming
pools and equipment as often as deemed necessary to enforce the
provisions of this ordinance.
Section 2:1670.27. Interference with or Hindrance of Health
Authority. No person shall interfere with or hinder the Health
Authority in the performance of duties under this ordinance or the
laws of the State of Minnesota, nor prevent the performance thereof.
Section 2:1670.29. Closure of Pools. When any of the
following conditions are found, any public swimming pool shall be
immediately closed to use when so ordered by the Health Authority
and may be placarded with the appropriate wording to indicate that
it has been closed; no one may remove such sign except the Health
Authority.

(a) The proper safety equipment as required in Minnesota
Regulations MHD 115 (q) (2) page 15 is not provided.
(b) The clarity is such that the main outlet grating is
not clearly discernible from the edge of the swimming pool or a
black disc 6 inches in diameter is not readily visible when placed
on a white field at the deepest point of the pool.
(c) The disinfectant level is found to be below the
acceptable levels established in Minnesota Regulations MHD 115 (r)
(1) page 16.
(d) The proper warning signs as required in Minnesota
Regulations MHD 115 (q)(5) page 16 are not provided.
(e) Any other condition which endangers the health,
safety or welfare of the public.
Section 2:1670.31. Adoption of Minnesota Regulation MHD
115, 1971, Relating to Public Swimming Pools. The Minnesota
•Regulation MHD 115, 1971, relating to public swimming pools, approved
by the Attorney General on August 4, 1971, is hereby adopted and
incorporated herein by reference and, except for the Sections of
said code specifically exempted below, shall be controlling within
the City of St. Louis Park. At least three (3) copies of said code
shall be on file in the office of the Clerk of the City of St. Louis
Park for use and examination by the public and shall be marked
"Official Copies."
The following portions of the Minnesota Regulation MHD 115, 1971,
relating to public swimming pools are exempted from this ordinance
and shall have no effect in the City of St. Louis Park.
1. All of section (b) page 3.
2. All of section (d) (3) page 4.
3. All of section (i) (2) (gg) page 6.
4. All of section (v) page 17.
Section 2:1670.33. Private Residential Swimming Pool Depth
Markings. Depth of water shall be plainly marked at or above the
water surface on the vertical pool wall or on the edge of the deck
or walk next to the pool, at maximum and minimum points, at the
points of change of slope between the deep and shallow portions,
®and at intermediate increments of depth spaced at not more than 25
foot intervals.

Section 2:1670.35. Private Residential Pool Decking
Requirements. A deck at least 3 feet wide, measured from the pool
water's edge shall be provided which extends completely around
all private residential pools; provided that above ground private
residential pools may be provided with decking of a minimum size
of 4 feet by 4 feet at pool entry points and provided that such
decking has the approval of the Health Authority.
Section 2:1670.3'x. Addic onal Outlet and Skimmer Require-
ments for Private Residential Pools. All pools with a depth greater
than 5 feet at any point shall be provided with an outlet at the
deepest point to permit the pool to be completely and easily emptied.
Openings shall be covered by a proper grating which is securely
fastened and not readily removable by bathers. Outlet openings
of the floor of the pool shall be at least four times the area of
discharge pipe or shall provide sufficient area so the maximum
velocity of the water passing the grate openings shall not exceed
one and one-half feet per second. The minimum width of grate open-
ings shall be one-half inch and the maximum not over one inch. An
antivortex type of drain may be used in lieu of grating.
Any pool not required to provide a main outlet as discussed above
shall be provided with one additional skimmer and one or more
additional outlets, above and beyond the requirements of section
9.1 pages 11, 12 and section 7.5 page 10, respectively, of the
American Public Health Association's Regulations for the Design and
Construction of Private Residential Swimming Pools, 1970, prepared
by the Joint Committee of Swimming Pools of the American Public
Health Association and adopted by Section 2:1670.39 of this ordinance.
Section 2:1670.39. Adoption of Regulations for the Design
and Construction of Private and Residential Swimming Pools by
Reference. The Regualtions for the Design and Construction of Private
Residential Swimming Pools, 1970, orepared by the American Public
Health Association, is hereby adopted and incorporated herein by
reference and, except for the Sections of said code specifically
exempted below, shall be controlling within the City of St. Louis
Park. At least three (3) copies of said regulations shall be on
file in the office of the Clerk of the City of St. Louis Park for
use and examination by the public and shall be marked "Official
Copies."

Section 2:1670.41. Nuisance Prohibited. No person shall
operate, maintain or permit any swimming pool that creates a
nuisance by annoying, injuring or endangering the safety, health,
comfort or repose of the public.
Section 2:1670.43. Violation Continued More Than One Day.
A separate offense shall be deemed committed upon each day during
or on which a violation occurs or continues.
Section 2:1670.45. Removal and Correction of Violations-
Any person given notification of one or more violations of this
Ordinance shall correct or remove each violation in a length of
time determined by the Health Authority. The length of time for the
correction or removal of each violation shall be noted on the
inspection report. The failure to remove or correct each such
violation within the time period noted on the inspection report
shall constitute a separate violation of this Ordinance.
Section 2:1670.47. Separability. Should any section,
clause or other provision of this ordinance be declared by a court
Of competent jurisdiction to be invalid, such decision shall not
affect the validity of the ordinance as a whole nor of any part
thereof other than the part so declared to be invalid.
Section 2. Penalty for Violation. Any person violating the
provisions of this ordinance shall be guilty of a misdemeanor
and upon conviction thereof shall be punished by a fine of not more
than $300.00 or by imprisonment for not to exceed 90 days or both.
Section 3. Effective Date. This ordinance shall take effect
fifteen days after its publication

single contiguous tract of land to have two
or more licenses required by Section
2 1670 03 the combination fee shall be
computed by adding to the first license
fee required one half the specified fee for
such additional hcenses as may be re-
quired
Section 2 1670 09 License Fee Exemp-
tions Persons owning, operating or main-
taining schools, governmental subdivi-
sions, Houses of Worship convents rec-
tories parsonages or religious commu-
nity centers shall be required to obtain a
license but without payment of a license
fee
Section 2 1670 11 License Application,
Issuance, Maintenance and Administra-
tion The application for a public swim
ming pool license shall be made on forms
furnished by the City Manager and shall
set forth such information as the City
Manager shall require
Such application for an issuance of such
licenses, their maintenance termination
and administration shall be in accordance
with and subject to all conditions of the
St Louis Park Ordinance Code relative to
general requirements for issuance of li-
censes by the City of St Louis Park and
the requirements of this ordinance If
such requirements have not been com-
plied with, the City Manager shall deny
the application for issuance of the hcense
Section 2 1670 13 Revocation of LI
cense Any license issued as required
under this ordinance may be revolked in
the manner provided in Sections 2 15 and
2 16 of the St Lows Park Ordinance
Code on the grounds therein provided or
for a violation of any provision of this or-
dinance
Section 2 167015 Plan Checking Fee
For Public Swimming Pools A plan
checking fee of 525 00 shall be paid to the
City Treasurer at the time of submitting
plans and specifications for review and
approval as required in Section 2 1670 19
Section 2 167017 Plumbing, Electri-
cal, and Ventilation All plumbing elec-
trical and mechanical installations and
equipment shall meet the requirements of
the St Louts Park Building Codes
Section 2 t670 19 Approval of New
Construction, Repair, Remodeling, or
Alteration No person shall construct
enlarge, repair move convert or alter
any swimming pool without first submit-
ting plans and obtaining approval of the
Health Authority and the appropriate
permits from the Department of Protec-
tive Inspection The St Louis Park De-
partment of Protective Inspection shall
not issue any permits for such work until
such permits have the approval of the
Health Authority endorsed thereon
Section 2 1670 21 Equipment Stand-

installed on any swimming pool after the
effeclve date of this ordinance shall
