LOUIS PARK DOES ORDAIN: Section 1. It is hereby de armined that a petition in writing, signed by the sole ow:.er of property abutting upon both sides of the Public Utility Easement and of all property in the entire block which contains the Public Utility Easement hereinafter described, has been duly filed with the City Clerk, requesting vacation of said Public Utility Easement, and the City Clerk has furnished a copy of said petition to the City Manager who has reported filing of same to the City Council, and the Clerk has published notice in the official city newspaper, the St. Louis Park Sun, on July 22, 1971 as directed by the Council and the City Council has met at the time and place as published in said notice and has conducted a public hearing on said petition and hereby determines that said Public Utility Easement is not needed for public purposes, and that it is for the best interests of the public that said Public Utility Easement be vacated as petitioned. Section 2. The following described length of the Public Utility Easement, as no,a dedicated and laid out within the corporate limits of the City of St. Louis Park, be hereby vacated: Utility and drainage easement granted to the City of St. Louis Park by Document Nos. 3855104, 3355105 and 3855106 being 5 feet on either side of the following described line: Commencing at a point in the centerline of Excelsior Avenue distance 313.25 feet Northeasterly (when, measured along said centerline) from its intersection with the West line of the Northeast Quarter of the Northwest Quarter of Section 7, Township 28, Range 24; thence Northwesterly along a line at right angles to said centerline a distance of 382 feet to the actual point of beginning; thence continuing Northwesterly along the same line to its intersecticr. with a ',_e lying parallel to and 10 feet East of the West line of the said Northeast Quarter of the Northwest Quarter; thence continue North along said line to the North line of said Northeast Quarter of Northwest Quarter and there terminating. Section 3. The City Clerk is hereby instructed to prepare a Notice of Completion containing a ccpy of this ordinance and to file the same for record forthwith in the Office of the Register of Deeds or Registrar of Titles in and for the County of Hennepin, Minnesota, as the case may be. RITCHAY, being duly sworn, on oath says he is and during all times here stated has been the vice president and printer of the newspaper known as The St Louis Park Sun and has full knowledge of the facts herein stated as follows• (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class .atter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park the County of Hennepin and it has its known office of issue in the City of Bloomington in id county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the news- paper and business related thereto (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the publisher of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
