HomeMy WebLinkAbout1160 - ADMIN Ordinance - City Council - 1971/08/16Original ORDINANCE NO. AN ORDINANCE VACATING PORTIONS OF STREETS AND ALLEYS AUGUST 2, 1971 5A 1160 THE CITY OF ST. LOUIS PARI DOES ORDAIN: Section 1. It is hereby determined that a petition in writing, signed by a majority of the owners of property abutting upon both sides of the portion of the respective street and the entire block abutting upon alleys hereinafter described, has been duly filed with the City Clerk, requesting vacation of said portions of streets and alleys, and the City Clerk has furnished a copy of said petition to the City Manager who has reported filing of same to the City Council, and the Clerk has published notice in the official City newspaper, the St. Louis Park Sun on July 22, 1971, as directed by the Council, and the City Council has met at the time and place as published in said notice and has conducted a public hearing on said petition and hereby determines that it is for the best interests of the public that said portion of streets and alleys be vacated as petitioned. Section 2. The following described portion of streets and alleys, as now laid out and dedicated within the corporate limits of the City of St. Louis Park, is hereby vacated: North -south and east -west alley in Block 40, Rearrangement of St. Louis Park; east -west alley in Block 39, Rearrangement of St. Louis Park located between Lots 9-16 and Lots 17-24; Central Avenue located between Dakota Avenue and a point 50 feet east of the east line of the Minneapolis, Northfield, and Southern Railroad tracks except for that portion previously vacated; and a portion of Mound Street lying within the following described boundary, beginning at the soutowest corner of Lut 17, Block 39, Rearrangement of St, Louis Park; thence northerly along the west line of said Lot 17 a distance of 114.5 feet to the southerly right of way line of State Highway 7; thence westerly along said right of way to the west line of Mound Street; thence southeasterly to the point of beginning. Section 3. The City Clerk is hereby instructed to prepare a Notice of Completion containing a copy of this ordinance and to file the same for record forthwith in the office of the Register of Deeds or Registrar of Titles, in and for the County of Hennepin, Minnesota, as the case may be. Section 4. This ordinance shall take effect fifteen days after its publication. Adopted by the City Council August 16, 1971. RITCHAY, being duly sworn, on oath says he is and during all times here stated has been the vice president and printer of the newspaper known as The St Louis Park Sun and has full knowledge of the facts herein stated as follows (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class ,•atter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park the County of Hennepin and it has its known office of issue in the City of Bloomington in id county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours to the business of the news- paper and business related thereto (6) Said newspaper files a copy of each issue immediately with the State Historical Society (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the publisher of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
