AN
ORDINANCE REGULATING THE ERECTION, CONSTRUCTION,
ENLARGEMENT, ALTERATION, REPAIR, MOVING,REMOVAL,
CONVERSION, DEMOLITION, OCCUPANCY, EQUIPMENT, USE,
HEIGHT, AREA, PERMITS, FIRE ZONES, AND MAINTENANCE OF
BUILDINGS OR STRUCTURES IN THE CITY OF ST. LOUIS PARK
PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION
OF FEES THEREFOR: DECLARING AND ESTABLISHING FIRE
DISTRICTS: PROVIDING PENALTIES FOR THE VIOLATION THEREOF,
AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN
CONFLICT THEREWITH, INCLUDING ORDINANCE NO. 1054.
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The erection, construction, enlargement, alteration,
repair, moving, removal, conversion, demolition, occupancy, equipment,
use, height, area, permits, fire zones, and maintenance of buildings
or structures in the City of St. Louis Park shall be licensed and
regulated as follows:
Section 5:101. Title. Sections 5:101 to 5:112 inclusive shall be
known as the "St. Louis Park 1971 Building Code, " may be cited as such, and
will_be referred to herein as "this Code".
Section 5:102. Purpose. The purpose of this Code is to provide
minimum standards to safeguard life or limb, health, property, and
public welfare by regulating and controlling the design, construction,
quality of materials, use and occupancy, location and maintenance of
all buildings and structures within the City and certain equipment
specifically regulated herein.
Section 5:103. Scope. The provisions of this Code shall apply
to the construction, alteration, moving, demolition, repair, and use
of any building or structure within the City, except work located primarily
in a public way, public utility towers and poles, mechanical equipment not
specifically regulated in this Code, and hydraulic flood control structures.
Additions, alterations, repairs, and changes of use or occupancy
in all buildings and structures shall comply with the provisions for new
buildings and structures except as otherwise provided in Sections 5:104 and 5:306
of this Code and Section 502 "Uniform Building Code, 1970 Edition, Volume 1"
incorporated herein by Section 5:110 of this Code.
Where, in any specific case, different sections of this Code
specify different materials, methods of construction or other requirements,
the most restrictive shall govern.

Wherever in this Code reference is made to any Appendix of said
"Uniform Building Code, 1970 Edition, Volume 1" the provisions in
such Appendix shall not apply unless specifically adopted herein.
Section 5:104. Application for Permits, Plans and Specifications.
The applicant shall submit with each application for a building permit
and at other times when required by the Building Official for enforce-
ment of any provisions of this Code three (3) sets of complete plans
and specifications, showing all essential parts of the building; and
four (4) copies of a certified survey showing the location of other
existing and proposed buildings on the premises. All such surveys
shall be certified by a "Registered Land Surveyor", duly qualified by
registration as required by Sections 326. 02 and 326. 03, Minnesota
Statutes 1967.
All such plans and specifications, except those hereinafter
excluded, shall be prepared and signed by a "Registered Architect"
or a "Registered Professional Engineer" duly qualified by registration
as required by Minnesota Statutes Sections 326. 02 and 326. 03.
• EXCEPTIONS: When authorized by the Building Inspector
plans and specifications need not be submitted for the following:
(1) One-story buildings of Type V conventional
wood -stud construction with an area not
exceeding 600 square feet;
(2) Group J, Division 1, occupancies of Type V
conventional wood -stud construction;
(3) Small and unimportant work.
Section 5:105. Certificate of Occupancy, Use or Occupancy.
No building or structure in Groups A to J inclusive shall be used or
occupied and no change in the existing occupancy classification of a
building or structure or portion thereof shall be made until the
Building Official has issued a Certificate of Occupancy therefor as
provided herein.
Section 5:106. Sheathing. Type V buildings shall have all
exterior walls covered with solid sheathing as specified in this Code.
Sheathing shall be one or more of the following materials:

O(a) Wood not less than five-eighths (5/8") thick, applied
diagonally.
(b) Fiberboard not less than one-half inch (1/2") thick
complying with U. B. C. Standard 22-1-67.
(c) Gypsum sheathing not less than one-half inch (1/2")
thick complying with U. B. C. Standard No. 22-2-67.
(d) Plywood not less than three-eighths inch (3/8") thick
complying with U. B. C. Standard No. 25-9-67
except as required by Section 2507 (b) 3.
Section 5:1C7. Locks. The following language is added to
Section 3304 (h) of the U. B. C.
In corridors of H occupancies every interior door opening directly
into a unit shall be equipped with the following locking devices:
(a) A single door shall be equipped with a cylinder
dead lock of an approved type that unlocks from
the outside by key and inside by turnpiece,
handle or knob or with a door locking latch of
an approved type having guarded bolt that
unlocks from outside by key and inside by
turnpiece, handle or knob.
(b) On double doors the active leaf shall be equipped
with a type of lock for single doors as prescribed
above (a) and the inactive leaf shall be equipped
with flush bolts at head and foot.
(c) Jambs and stops shall be of an approved type.
Section 5:108. Footings, Bearing Walls, Exceptions. A one
story detached wood frame building of Group J occupancy may be constructed
on a "Floating Slab", providing the soil over which it is to be built has
a soil bearing capacity of at least fifteen hundred (1500) pounds per square
foot.
All sod, root structure and other fibrous material shall be
removed from the entire area of the building. At the perimeter of the
building a haunch or thickened edge shall be formed having a minimum
vertical dimension at the exterior face of eight (8) inches, four (4) inches
of whi ch shall project above the finish grade and a minimum of four (4)

inches of the haunch below the ground surface. The bottom of the haunch
shall be a minimum of six (6) inches wide then sloped upward to the
bottom of the slab. Under the slab and the haunch shall be placed a
three (3) inch sand or approved equal "cushion". Screed block shall
be placed to provide for a minimum slab thickness of four (4) inches
properly reinforced.
Section 5:109. 1. Fire Zone No. 1. All territory and portion of
the City of St. Louis Park included within the B-1 Neighborhood Business
District and the B-2 General Business District as defined in the St. Louis
Park Toning Ordinance and the map referred to therein, except such
separate areas thereof containing less than 50, 000 square feet in area, shall
be known and designated as Fire Zone Number 1 for the purpose of
Building Code enforcement.
Section 5:109.2. Fire Zone No. 2. All territory and portion of
the City of St. Louis Park included within the B-3, Business District, I-1,
I-2, and I-3 Industrial Districts, the R-4 One to Eleven Family Residence
District, and the R -B Residence Business District, as defined in the St. Louis
Park Zoning Ordinance and the map referred to therein, except such separate
areas thereof containing less than 50, 000 square feet in area together with such
separate areas of the B-1 Neighborhood Business District and the B-2 General
Business District containing less than 50, 000 square feet in area, shall be
known and designated as "Fire Zone Number 2" for the purpose of Building
Code enforcement.
Section 5:109. 3. Fire Zone No. 3. All territory and portion of
the City of St. Louis Park included within the R-1 and R-2 Single
Family Residence Districts and the R-3 Two Family Residence District,
as defined in the St. Louis Park Zoning Ordinance, and the map referred
to therein, together with such separate areas of the B-3, Business
District, I-1, 1-2 and 1-3 Industrial Districts, the R-4 One to Eleven
Family Residence District, and the R -B Residence -Business District
containing less than 50, 000 square feet in area, shall be known and
designated as Fire Zone Number 3 for the purpose of Building Code
enforcement.
Section 5:110. Adoption of Uniform Building Code by Reference.
The "Uniform Building Code (UBC) 1970 Edition, Volume 1, "prepared by
the International Conference of Building Officials, is hereby adopted
and incorporated herein and, except for the portions of said code
specifically excepted below, shall be controlling within the City of
St. Louis Park. At least three (3) copies of said code shall be on
file in the office of the Clerk of the City of St. Louis Park for use
and examination by the public and shall be marked "Official Copies",
and a substantial supply thereof shall be made available for distribution.

O The following portions of the "Uniform Building Code" are excepted
from this ordinance and shall have no effect in the City of St. Louis Park:
•
•
(a) Those certain sections of Part 1, "Administrative", found
on pages 21 through 34, inclusive as follows: Sections
101; 102; 103; 201; 202; (a), (b) and (c); 203; 204; 205;
301 (c); 306 (a) and (e), and
(b) Section 2518, Subdivision f-5.
(c) Section 2905, subsection (b), exception No. 1, on
page 414, in its entirety.
Section 5:111. Separability. Should any section, subdivision
clause or other provisions of this ordinance be declared by a court
of competent jurisdiction to be invalid, such decision shall not affect
the validity of the ordinance as a whole nor of any part thereof other
than the part so declared to be invalid.
Section 5:112. Violations Declared. It shall be unlawful for any
person to erect, construct, enlarge, alter, repair, move, improve,
remove, convert or demolish, equip, use, occupy, or maintain any building
or structure in the City or cause the same to be done, contrary to or
in violation of this Code.
Section 2. Ordinances Repealed. The following ordinance of the City
of St. Louis Park is hereby repealed in its entirety:
Ordinance No. 1054 entitled "An Ordinance Regulating the
Erection, Construction, Enlargement, Alteration, Repair,
Moving, Removal, Conversion, Demolition, Occupancy,
Equipment,Use, Height, Area, Permits, Fire Zones, and
Maintenance of Buildings or Structures in the City of St. Louis
Park Providing for the Issuance of Permits and Collection
of Fees Therefore: Declaring and Establishing Fire Districts:
Providing Penalties for the Violation Thereof, and Repealing
All Ordinances and Parts of Ordinances in Conflict Therewith"
provided, however, that this repeal shall not affect any pending prosecution
for violation of any ordinance herein repealed and shall not relieve any person
of penalty or other legal liability for violation or failure to comply with
any provision of any such ordinance herein repealed.

Section 3. Penalty. Any person violating any of the provisions of this
Code shall be guilty of a misdemeanor, and each such person shall be
deemed guilty of a separate offense for each and every day or portion
thereof during which any violation of any of the provisions of this
Code is committed, continued, or permitted, and upon conviction of any
such violation such person shall be punishable by a fine of not more
than $300. 00 or by imprisonment for not more than 90 days or both.
Section 4. Effective Date. This ordinance shall take effect fifteen
days after its publication.

THE CITY OF ST LOUIS PARK DOES
ORDAIN
Section 1 The erection, construction,
enlargement, alteration, repair moving,
removal, conversion, demolition, occu-
pancy, equipment', use, height area,
permits, fire zones, and maintenance of
buildings or structures in the City of St
Louis Park shall be licensed and regulat-
ed as follows
Section 5 101 Title Sections 5 101 to
5 112 inclusive shall be known as the "St
Louis Park 1971 Building Code,' may be
cited as such and will be referred to here-
in as "this Code '
Section 5 102 Purpose The purpose
of this Code is to provide minimum stand-
ards to 'safeguard hfe or limb health
property, and public welfare by regulat-
ing and controlling the design, construc-
tion quahty of materials, use and occu-
pancy, location and maintenance of all
buildings and structures within the City
and certain equipment specifically regu-
lated herein
Section 5 103 Scope The provisions
of this Code shall apply to the construc-
tion, alteration moving, demolition, re-
pair, and use of any building or structure
within the City, except work located pn-
marily in a public way, public utility tow-
ers and poles mechanical equipmenLnot
specifically regulated in this Code and
hydraulic flood control structures
Additions, alterations, repairs, and
changes of use or occupancy in all build-
ings and structures shall comply with the
provisions for new buildings and struc-
tures except as other wise provided in
Sections 5 104 and 5 306 of this Code and
Section 502 "Uniform Building Code, 1970
Edition, Volume 1" incorporated herein
by Section 5 110 of this Code

entirety

claring and Establishing Fire
Districts Providing Penalties for the
Violation Thereof, and Repealing All
Ordinances and Parts of Ordinances in
Conflict Therewith"
provided, however, that this repeal shall
not affect any pending prosecution for
violation of any ordinance herein re-
pealed and shall not relieve any person of
penalty or other legal habihty for viola-
tion or failure to comply with any provi-
sion of any such ordinance herein re-
pealed
Section 3 Penalty Any person violat-
ing any of the provisions of this Code shall
be guilty of a misdemeanor, and each
such person shall be deemed guilty of a
separate offense for each and every day
or portion thereof during which any viola-
tion of any of the provisions of this Code is
committed, continued, or permitted, and
upon conviction of any such violation such
person shall be punishable by a fine of not
more than $300 00 or by impnsonment for
not more than 90 days or both
Section 4 Effective Date This ordi-
nance shall take effect fifteen days after
its publication
