HomeMy WebLinkAbout1145 - ADMIN Ordinance - City Council - 1971/05/24a e Original ORDINANCE NO. 114 5 A Y 24, 1971 AN ORDINANCE REGULATING THE INSTALLATION AND MAINTENANCE OF PUBLIC STEAM BATHS, PUBLIC HEAT BATHING ROOMS, PUBLIC SUNTANNING ROOMS, PUBLIC REST ROOMS, PUBLIC PORTABLE REST ROOMS, PUBLIC BATHING ROOMS AND PUBLIC EXERCISE ROOMS; PROVIDING FOR THE LICENSING OF PUBLIC STEAM BATHS, PUBLIC HEAT BATHING ROOMS AND PUBLIC SUNTANNING ROOMS; PUBLIC PORTABLE REST ROOMS; PROVIDING FOR INSPECTIONS; AND PROV'DING PENALTIES FOR VIOLATIONS OF THE PROVISIONS THEREOF. THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. The installation, maintenance and licensing of public sanitary facilities shall be regulated as follows: Section 2:1720. Definitions. The following definitions shall apply in the interpretation and enforcement of this ordinance and the following words and terms wherever they occur in this ordinance are defined as follows: Subd. 1. Dwelling Unit shall mean one or more habitable rooms which are occupied or which are intended or designed to be occupied by one family with facilities for living, sleeping, cooking and eating. Subd. 2. Health Authority shall mean the duly appointed health officials of the City of St. Louis Park. Subd. 3. Person shall mean any individual, natural person, firm, association, organization, partnership, business institution, agency, or any Federal or State or local government agency of instrumentality or other entity recognized by law as the subject of rights and duties, and shall include employees, licensees, tenants, leasees, managers and operators of public facilities and equipment. Subd. 4. Public Facilities shall mean steam baths, heat bathing rooms, suntanning rooms, rest rooms, portable rest rooms, bathing rooms and exercise rooms located in clubs, gasoline stations, schools, hotels and motels, apartment buildings, commercial and industrial buildings and any other facilities not located within or constructed to accommodate one dwelling unit. Subd. 5. Public Steam Bath shall mean any public facility used for the purpose of bathing, reducing, or relaxing, utilizing steam as a cleaning, reducing or relaxing agent. Subd. 6. Public Heat Bathing Room shall mean any public facility used for the purpose of bathing, reducing, or relaxing, utilizing hot air as a cleaning, reducing or relaxing agent. Subd. 7. Public Rest Room shall mean a public facility equipped with a minimum of a flush water closet. OSubd. 8. Public Bathing Room shall mean a public facility used for cleansing the human body. Subd. 9. Public Exercise Room shall mean a public facility designed and used for the purpose of exercising. Subd. 10. Public Portable Rest Room shall mean a public facility designed to be easily portable and equipped with a minimum of a riser and seat with a collecting device. Section 2:1721. License Required. Subd. 1. Public Steam Bath, Public Heat Bathing Room, Public Suntanning Room. No person shall own, operate, maintain, lease or be responsible for any public steam bath, public heat bathing room or public suntanning room as defined in this ordinance, unless a license therefore, issued pursuant to this ordinance, shall have been obtained from the City Manager. Subd. 2. Public Portable Rest Rooms. No person shall own, operate, maintain, lease or rent to any other person; or in any way provide or service a public portable rest room within the corporate limits of the City of St. Louis Park unless a license, issued pursuant to this ordinance, shall have been obtained from the City Manager. Section 2:1722. License Fees. Subd. 1. Stearn Bath, Heat Bathing Room and Suntanning Room. The annual license fee for a public steam bath (s), a public heat bathing room (s) and/or public suntanning room (s) shall be $50. 00 for all such public facilities at each location. Subd. 2. The license fee for each person required to be licensed under Section 2:1721, Subd. 2 shall be either $50. 00 annually or $5. 00 for each location. If a $50. 00 annual license is obtained, t_:e licensee shall notify the Health Authority in writing of each location of a public portable rest room owned, operated, maintained, leased or rented by him. Section 2:1723. Combination License Fees. In the event that any one person shall be required at several locations on a sirg le contiguous tract of land to have two or more licenses required by Section 2:1721 Subd. 1 the combination fee shall be computed by adding to the first license fee required one half the specified fee for such additional licenses as may be required. Section 2:1724. License Fee Exemptions. Persons owning, operating or maintaining schools, governmental subdivisions, houses of worship, convents, rectories, parsonages or religious community centers shall be required to obtain a license but without payment of a license fee. -2- e • Section 2:1725. License Application, issuance , Maintenance and Administration. The application for a public steam bath, public heat bathing room, public suntanning room, and public portable rest room licenses shall be made on forms furnished by the City Manager and shall set forth such information as the City Manager shall require. Such application for an issuance of such licenses, their maintenance, termination and administration shall be in accordance with and subject to all conditions of the St. Louis Park Ordinance Code relative to general requirements for issuance of licenses by the City of St. Louis Park and the requirements of this ordinance. If such requirements have not been complied with, the City Manager shall deny the application for issuance of the license. Section 2:1726. Revocation of License. Any license issued as required under this ordinance may be revoked in the manner provided in Sections 2:15 and 2:16 of the St. Louis Park Ordinance Code, on the grounds therein provided, or for a violation of any provision of this ordinance: Section 2:1727. Construction Requirements. Subd. 1. All public steam baths, heat bathing rooms, suntanning rooms, public restrooms and public bathing rooms shall be constructed of materials including ceramic tile, quarry tile, smooth finished concrete block or other similar materials which are durable and impervious to moisture, bacteria, mold or fungus growth. The floor to wall and wall to wall joints shall be constructed to provide a sanitary cove. All other equipment and appurtenances shall be of sanitary design and construction which will permit easy and thorough cleaning. Subd. 2. Mechanical ventilation and lighting which meet the requirements of the St. Louis Park Building Code shall be provided in all public facilities except as provided in Subd. 5 of this section for portable public rest rooms. A hand washing sink equipped with hot and cold running water under pressure and a sanitary towel dispenser or hand -drying device shall be provided in all public rest rooms. The doors of all public rest rooms shall be self-closing. Subd. 3. Timing devices or other safety devices shall be required in public suntanning rooms. Warning signs and instructions shall be provided in public suntanning rooms. Subd. 4. Public rest rooms and portable public rest rooms shall be identified on or above the door. Subd. 5. Public Portable Rest Rooms shall be designed and constructed with materials which are durable under conditions of normal use, resistent to moisture and easily cleanable. -3- • • • The waste collection device and appurtenances shall be of watertight construction and shall be designed and constructed to withstand the treatment process and repeated use and cleaning. The treatment process shall effectively eliminate all noxious, offensive and annoying odors. A minimum of natural ventilation and lighting shall be provided. All openings and vents to the outer air shall be screened. Doors shall be self-closing. Section 2:1728. Maintenance of Public Facilities. Subd. 1. In all public facilities the floors, walls, ceilings, water closets, hand washing sinks, urinals, and all other equipment and appurtenances shall be maintai ned in a clean condition at all time s. Subd. 2. Public rest rooms shall have hand -cleaning agents, sanitary towels or an operable hand -drying device and toilet tissue at all times. Refuse receptacles, which are easily cleanable, shall be provided and emptied and cleaned as necessary. The doors shall be self-closing. Hot and cold running water under pressure must be provided at all times. Subd. 3. Portable public rest rooms shall be maintained in good repair and shall be cleaned as necessary and in a manner which will eliminate spillage, leakage, and noxious, offensive and annoying odors. Doors shall be self-closing. Section 2:1729. Availability of Portable Public Rest Rooms. The Health Authority may require public portable rest rooms when it deems necessary including but not limited to public gatherings, construction sites, recreational areas, fairs, and carnivals. The considerations to be used by the Health Authority in determining the necessity of public portable rest rooms shall include the type of activity or gathering, the number of persons attending, the duration of the event, the availability of other public rest rooms. Section 2:1730. Approval of New Construction, Repair or Alteration. No person shall construct, enlarge, repair, move, convert or alter any public facility without first obtaining appropriate permits from the Department of Protective Inspection. The St. Louis Park Department of Protective Inspection shall not issue any permits for such work until such permits have the approval of the Health Authority endorsed thereon. Section 2:1731. Inspections. The Health Authority shall inspect all public facilities as often as deemed necessary to enforce the provisions of this ordinance. -4- • • Section 2:1732. Temporary Closing of a Public Facility. The Health Authority may temporarily close a public facility if a serious public health hazard exists. A sign shall be posted on any such public facility which is temporarily closed indicating its closure. No one may remove such sign except the Health Authority. Section 2:1733. Violation Continued More Than One Day. A separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 2. Separability. Should any section, subdivision, clause or other provision of this ordinance be declared by a court of competent jurisdiction to be invalid, such decision shall not effect the validity of the ordinance as a whole nor of any part thereof other than the part so declared to be invalid. Section 3. Penalty or Violation. Any person violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than $300. 00 or by imprisonment for not to exceed 90 days or both. Section 4. Effective Date. This ordinance shall take effect fifteen days after its publication. Adopted by the City Council May 24, 1971.
