HomeMy WebLinkAbout1129 - ADMIN Ordinance - City Council - 1970/12/21e • Original ORDINANCE NO. 1129 DECEMBER 21, 1970 7A AN ORDINANCE PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSION AND ADOPTING BY REFERENCE PORTIONS OF THE AMERICAN INSURANCE ASSOCIATION CODE, ENTITLED "FIRE PREVENTION CODE, 1970 EDITION"; ESTABLISHING A FIRE PREVENTION BUREAU, PROVIDING INSPECTORS THEREFOR, AND DEFINING THEIR POWERS AND DUTIES. THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. Sections 5:1100, 5:1101, 5:1102, 5:1103, 5:1104, 5:1105, 5:1106, 5:1107, 5:1108 and 5:1109 of the St. Louis Park Ordinance Code are amended to read: Section 5:1100. Adoption of Fire Prevention Code by Reference. There is hereby adopted by the City of St. Louis Park for the purposes of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code entitled the "Fire Prevention Code, recommended by the American Insurance Association, 1970 edition, and the whole thereof, except such portions as are hereinafter deleted, modified or amended, of which code not less than three copies have been and now are filed in the office of the Clerk of the City of St. Louis Park and marked "Official Copies" and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of St. Louis Park. Section 5:1101. Establishment of Bureau of Fire Prevention. The Fire Prevention Code shall be enforced by the Bureau of Fire Prevention in the Fire Departme-it of the City of St. Louis Park which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. Section 5:1102. Duties of Bureau of Fire Prevention. The Fire Marshal in charge of the Bureau of Fire Prevention shall be the Fire Chief as set forth in Section 1:107 (2) c of the St. Louis Park Ordinance Code. The Chief of the Fire Department may detail such members of the Fire Department as Inspectors as shall from time to time be necessary. Section 5:1103. Definitions. • Subdivision a. Wherever the word "Municipality" is used in the Fire Prevention Code{ it shall mean the City of St. Louis Park. e Subdivision b. Wherever the words "Chief of the Bureau of Fire Prevention" are used in the Fire Prevention Code they shall mean the Fire Chief of the City of St. Louis Park. Subdivision c. Wherever the term "Corporation Counsel" is used in the Fire Prevention Code, it shall be held to mean the attorney for the City of St. Louis Park. Section 5:1104. Establishment of Limits of Districts in which Storage of Flammable Liquids in Outside Aboveground Tanks is to be Prohibited. Subdivision a. Zones comprising areas described as the limits referred to in Section 16. 22 (a) of the Fire Prevention Code in which storage of flammable liquids in outside above -ground tanks is prohibited, are hereby established as follows: Zones comprising areas described as Use Districts Ri, R2, R3, R4, and RB, as bounded and established pursuant to Ordinance No.. 730, passed December 23, 1959, known as "St. Louis Park Zoning Ordinance". Subdivision b. The limits referred to in Section 16.61 of the Fire Prevention Code, in which new bulk plants for flammable liquids are prohibited, are hereby established as follows: Zones comprising areas described as R1, R2, R3, R4, and RB, as bounded and established pursuant to Ordinance No. 730, passed December 28, 1959 known as "St. Louis Park Zoning Ordinance." Section 5:1105. Establishment of Limits in which Bulk Storage of Liquified Petroleum Gases is to be Restricted. The limits referred to in Section 21. 6a of the Fire Prevention Code, in which bulk storage of liquified petroleum gas is restricted, are hereby established as follows: Zones comprising areas described as R1, R2, R3, R4 and RB, as established pursuant to Ordinance No. 730, passed December 28, 1959 known as "St. Louis Park Zoning Ordinance. " Section 5:1106. Establishments of Limits of Districts in whichS torage of Explosives and Blasting Agents is to be Prohibited. The limits referred to in Section 12. 5b of the Fire Prevention Code, in which storage of explosives and blasting agents is prohibited are hereby established as follows: Zones comprising areas described as R1, R2, R3, R4 and RB, as bounded and established in Ordinance No. 730 passed December 28, 1959, known as "St. Louis Park Zoning Ordinance." Section 5:1107. Appeals. Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a license or permit applied for, or when it is claimed that the provisions of the code do not apply, or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department to the City Manager within thirty (30) days from the date of such decision of the Fire Chief. -2- P e • Section 5:1108. Separability. Should any section, subdivision, clause, paragraph, sentence, or word of this ordinance, or of the code hereby adopted, be declared by a Court of Competent Jurisdiction for any reason to be invalid, such decision shall not affect the validity of the ordinance as a whole nor any part thereof other than the part so declared to be invalid, it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. Section 2. Penalty. Any person violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than $300. 00 or by imprisonment for not to exceed 90 days, or both. Section 3. This ordinance shall take effect fifteen days after its publication. Attest: Adopted by the City Council December 21, 1970.
