HomeMy WebLinkAbout1117 - ADMIN Ordinance - City Council - 1970/08/03ORIGINAL REPLACEMENT ORDINANCE NO. 1117 AN ORDINANCE REGULATING CHRISTMAS TREES AND DECORATIONS IN PUBLIC PLACES, ADDING SECTIONS 7:10 THROUGH 7:14 THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. The display of Ch"4stmas places shall be regulated as follows: Section 7:10. Definitions. The ascribed to them herein: trees and decorations in public following terms have the meanings (a) "Christmas tree" means any natural tree which has been cut and is set up, used, installed or maintained within any building, structure or tent for decorative or commemorative purposes. (b) "Christmas decorations" mean any cuttings, branches, cotton batting, straw, dry vines or leaves, cellulose or other flammable material used for decorative or commemorative purposes. Section 7:11. Christmas Trees or Decorations in Public Places. Places of public assembly or places of business to which the public is invited which shall use, keep, install or maintain Christmas trees or decorations shall observe and comply with the following regulations: (a) Every Christmas tree, regardless of the type, shall be so placed, kept and maintained that the butt, or bottom end of the trunk, is at all times immersed in not less than two inches of water. (b) No Christmas decorations shall be used unless treated by fire retardant method in a manner approved by the Fire Prevention Bureau of the City. (c) Christmas trees shall not be placed in or immediately adjacent to exit areas, light wells, or stairwells in buildings. (d) No candles shall be used on Christmas trees. (e) No electrical decorations shall be used on Christmas trees or Christmas decorations except in churches when used in connection with a religious or ceremonial service; provided, however, that this exception shall be subject to approval by the Fire Prevention Bureau of the City. Section 7:12. Artificial Trees and Artificial Decorations Excepted. The provisions of this ordinance shall not apply to artificial Christmas trees or decorations constructed of con -flammable materials with the exception of those constructed of metal or metal alloys which must, if used with electrical decorations be approved by the Fire Prevention Bureau of the City. 11. Oft • Section 7:13. Enforcement. The Fire Prevention Bureau shall cause any Christmas tree or decoration in violation of this ordinance to be disconnected or removed. Section 7:14. Provisions Supplementary. The provisions of this ordinance shall not be construed as superseding, limiting or repealing any other ordinance of the City relating to fire and fire prevention, but shall be construed as being in addition and supplementary thereto. Section 2. Penalty. Any person violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than $300 or by imprisonment not to exceed 90 days or both. Section 3. Effective Date. This ordinance shall take effect 15 days after its publication. Adopted by the City Council August 3, 1970. (5) Said newspaper purports to serve the City of St Louis Park in the County of Hennepin and it has its known office of ilur•ue in the City of Bloomington in said county, established and open during its regular business s for the gathering of news, sale of advertisements and sale of subscriptions and main- _ained by the managing officer or persons in its employ and subject to his direction and con- trol during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto. (8) Said news- paper files a copy of each issue immediately with the State Historical Society.
