AN ORDINANCE RELATING TO SNOWMOBILES,
REGULATING THE OPERATION AND USE THEREOF,
AND PROVIDING PENALTIES FOR THE VIOLATION
THEREOF, AND AMENDING ORDINANCE NO. 1046,
ENTITLED "AN ORDINANCE RELATING TO
SNOWMOBILES, REGULATING THE OPERATION
AND USE THEREOF, AND PROVIDING PENALTIES
FOR THE VIOLATION THEREOF," PASSED
NOVEMBER 13, 1968
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. Ordinance No. 1046 entitled "An Ordinance Relating
To Snowmobiles, Regulating The Operation And Use Thereof, and
Providing Penalties For The Violation Thereof, " is hereby amended to
read as follows: The operation and use of snowmobiles in the City of
St. Louis Park shall be regulated as follows:
Section 3:400 Definitions.
Subd. 1. For the purpose of this ordinance the terms
defined herein shall have the meaning
ascribed to them as hereinafter set
forth:
Subd. 2. "Person" includes an individual, firm,
partnership, corporation, trustee, as sociation,
the state and its agencies and subdivisions,
and any body of persons, whether
incorporated or not, and with respect to
acts prohibited or required herein shall
include employees and licensees.
Subd. 3. "Snowmobile" means a self-propelled vehicle
designed for travel on snow or ice or a
natural terrain steered by wheels, skis
or runners.
Subd. 4. "Owner" means a person, other than a lien
holder, having the property in or title to a
snowmobile entitled to the use or possession
thereof.
Subd. 5. "Operate" means to ride in or on and control
the operation of a snowmobile.

Subd. 6. "Operator" means every person who operates
or is in actual physcial control of a
snowmobile.
Subd. 7.
"Register" means the act of assigning a
registration number to a snowmobile by
the Commissioner of Conservation.
Subd. 8. "Commissioner" means the commissioner
of conservation acting directly or through his
authorized agent.
Subd. 9. "Roadway" means that portion of a highway
improved, designed, or ordinarily used for
vehicular travel.
Subd. 10. "Street" or "Highway" shall mean the
entire width between the boundary lines of
way or place when any part thereof is open
to the use of the public in the City of St. Louis
Park, as a matter of right, for the purposes
of vehicular traffic.
Subd. 11. "Daylight" hours shall mean any time except
from a half hour after sunset to a half hour
before sunrise and at any other time when
there is not sufficient light to render clearly
discernible persons and vehicles at a distance
of 500 feet.
Section 3:402 County, State and Interstate Highways, Restrictions.
No person shall operate a snowmobile upon the roadway, shoulder, or inside
bank or slope of any trunk, county state aid or county highway in the City
of St. Louis Park and, in the case of a divided trunk or county highway,
on the right of way between the opposing lanes of traffic except as provided
in this ordinance. No person shall operate a snowmobile within the right
of way of any trunk, county state -aid or county highway between the hours
of one-half hour after sunset to one-half hour before sunrise except on
the right hand side of such right of way and in the same direction as the
highway traffic on the nearest lane of the roadway adjacent thereto. No
snowmobile shall be operated . at any trn.e within the right of way of any
interstate highway or freeway within St. Louis Park.

Section 3:404 Crossing Streets or Highways. A snowmobile
may make a direct cDossing of a street or highway at any hour of the
day provided:
Subd. 1. The crossing is made at an angle of approximately
90 degrees to the direction of the highway
and at a place where no obstruction prevents
a quick and safe crossing; and
Subd. 2. The snowmobile is brought to a complete
stop before crossing the shoulder or main
traveled way of the highway; and
Subd. 3. The driver yields the right of way to all
oncoming traffic which constitutes an
immediate hazard; and
Subd. 4. In crossing a divided highway, the crossing
is made only at an intersection of such high-
way with another public street or highway.
Subd. 5. If the crossing is made between the hours of
one half hour after sunset to one half hour
before sunrise or in conditions of reduced
visibility, only if both front and rear lights
are on.
Section 3:406. Lamps and Brakes Required. No snowmobile
shall be operated upon a public street or highway unless it is equipped
with at least one head lamp, one tail lamp, each of minimum candlepower
as prescribed by regulations of the commissioner, reflector material of
a minimum area of 16 square inches mounted on each side forward of
the handle bars, and with brakes each of which shall conform to the
requirements of Section 3:414 hereof, each of which shall have the approval
of the commissioner.
Section 3:403. Emergencies. A snowmobile may be operated
upon a public street or highway other than as provided by Section 3:404
in an emergency during the period of time when and at locations where
snow upon the roadway renders travel by automobile impractical.
Section 3:410. Traffic Laws and Rules Control Operation.
All provisions of Chapter 169, Minnesota Statutes regulating traffic and the
operation of motor vehicles upon streets or highways shall apply to the
operation of snowmobiles upon streets and highways, except for those
relating to required equipment, and except those which by their nature
can have no application.

Section 3:412 Operation Generally. It shall be unlawful for any
person to drive or operate any snowmobile in the following unsafe or
harassing ways.
Subd. 1. At a rate of speed greater than reasonable or
proper under all the surrounding
circumstances;
Subd. 2. In a careless, reckless or negligent manner
so as to endanger the person or property of
another or to cause injury or damage thereto;
Subd. 3. While under the influence of intoxicating liquor
or narcotics or habit forming drugs;
Subd. 4. Without a lighted head and tail light when
required for safety;
Subd. 5. In any tree nursery or any shrub or tree
planting, in a manner which damages or
destroys growing stock, or landscaping on
private or public property.
Section 3:414 Equipment Required. No person shall operate a
snowmobile within the right of way limits of a street or highway unless
it is equipped with:
Subd. 1. Brakes adequate to control the movement of
and to stop and to hold such vehicle under
any conditions of operation.
Subd. 2. At least one headlamp so aimed and of sufficient
intensity to reveal persons and vehicles at a
distance of at least one hundred (100) feet
ahead during hours of darkness under normal
atmospheric conditions. Such headlamp
shall be so aimed that glaring rays are not
projected into the eyes of an oncoming
driver.
Subd. 3. At least one rear lamp exhibiting a red light
plainly visible from a distance of five hundred
(500) feet to the rear during hours of darkness
under normal atmospheric conditions.

Subd. 4. Except as provided in this section, every
snowmobile shall be equipped at all times
with a muffler in good working order
which blends the exhaust noise into the overall
snowmobile noise and is in constant operation
to prevent excessive or unusual noise. The
exhaust system shall not emit or produce a
sharp popping or crackling sound. This
section does not apply to organized races or
similar competitive events held on (1) private
lands, with the permission of the owner,
lessee, or custodian of the land; (2) public
lands and water under the jurisdiction of the
commissioner of conservation, with the
commissioner's permission; or (3) other public
lands, with the donsent of the public agency
owning the land. No person shall have for
sale, sell, or offer for sale on any new
snowmobile any muffler that fails to comply
with the specifications required by the rules
and regulations of the commissioner after
the effective date of the rules and
regulations.
Subd. 5. A safety or so called "dead man" throttle in
operating condition; a safety or "dead man"
throttle is defined as a device which,
when pressure is removed from the
accelerator or throttle, or causes the motor
to be disengaged from the driving track.
Section 3:416 Unattended Snowmobile on Public Property
Prohibited. It is unlawful for the owner or operator to leave or allow a
snowmobile to be or remain unattended on public property, streets or
highways while the motor is running or with the keys to start same in the
ignition switch.
Section 3:148 Permission to enter Private Property. No persons
while operating a snowmobile shall enter upon the lands of another unless
and until permission is obtained from the owner or lessee, if there be one.
Sectinn 3:420 Public Lands. No person shall operate a snow-
mobile on any publicly owned lands, including but not limited to schools,
park property, playgrounds, recreation areas and golf courses, except
areas previously listed or authorized for such use by the proper public
authority, in which case such use shall be lawful and snowmobiles may be
driven in and out of such areas by the shortest route. Authorized areas,

Q in the City of St. Louis Park, owned by the City, shall be designated by
council resolution upon recommendation of the City Manager.
Section 3:422 Prohibited in Areas Dangerous to Person or Property.
No person shall drive a snowmobile within 100 feet of any fisherman, fish
house, shelter, pedestrian, skating rink or sliding area, or in any other area
where such operation would conflict with use or endanger other persons or
property.
Section 3:424 Hours of Operation. No person shall operate a
snowmobile except during daylight hours, unless the vehicle has the
necessary and proper equipment to be operated at night and in no event
shall be operated after 10:00 p. rn. nor before 7:00 a.m., provided further
that no person shall operate a snowmobile upon city streets and alleys between
the hours of one half hour after sunset to one half hour before sunrise.
Section 3:428 Youthful Operators. No person under the age of
14 years shall operate a snowmobile within the City of St. Louis Park. No
person 14 years of age or older but less than 18 years of age may operate
a snowmobile in St. Louis Park without having in his immediate possession
a valid certificate issued to him by the commissioner. No owner of a
snowmobile shall allow any person to operate such owner's snowmobile
contrary to the provisions of this section.
Section 3:430 Passengers and Towing. No person shall operate
a snowmobile and no person shall ride as a passenger at any time when
three or more persons shall be upon such snowmobile provided however
snowmobiles shall be allowed to tow.
Section 3:432 Registration. No person shall operate a snow-
mobile which has not been registered as required by the State of Minnesota
Statutes, or without registration numbers so assigned by the Conservation
Department securely fixed on each side of the forward half of the snow-
mobile in such position as to provide clear legibility for identification.
Section 2. Penalty. Any person violating the provisions of this
ordinance shall be guilty of a misdemeanor and upon conviction shall be
punished by a fine of not more than three hundred dollars or by
imprisonment for not to exceed 90 days, or both.

Section 3. Effective Date. This ordinance shall take effect fifteen
days after its publication.
