ORDINANCE NO. 1095
AN ORDINANCE REGULATING TRAFFIC; ADOPTING
THE STATE TRAFFIC CODE AND ORDINANCES
NO. 567, NO. 613, NO. 692, NO. 694, NO. 744
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. Traffic Regulations. Traffic in the City of
St. Louis Park shall be regulated as follows:
Section 3:100. Adoption of State Highway Traffic
Regulation and Drivers' License Acts. There is hereby adopted by
reference and made a part of this section the following statutes of
the State of _Minnesota as heretofore amended and as in force and effect
as of December 1, 1969, three copies of which are marked as official
copies and filed for use and examination by the public in the office
of the City Clerk:
All of Chapter 169, Minnesota Statutes, known as the
"Highway Traffic Regulation Act, " excepting the following
sections thereof: Subdivisions 1, 2, and 3 of Section
169. 06; Subdivision 9 of Section 169. 09; Sections 169. 10,
169. 11, 169. 27, 169. 66, 169. 77, 169. 78; Subdivision 6 of
Section 169. 83; and Section 169. 87.
All of Chapter 171, Minnesota Statutes, known as the
"Drivers' License Lawn except Section 171. 04 thereof.
Section 3:101. Penalty It shall he unlawful and a violation
of the requirements of Section 3:100 for any person to violate within
the City of St. Louis Park any provision of such statutes adopted by
reference herein, and any person upon conviction thereof shall be
fined not more than Three Hundred Dollars ($300. 00) or imprisoned
for a period not to exceed ninety (90) days, or both, except as
penalties are otherwise provided in the Sections adopted in
Section 3:100, in which case the provisions set forth in the statutes
adopted by reference shall apply.
Section 3:102. Complaint. A complaint alleging violation
of this ordinance shall allege the appropriate section of the statute herein
incorporated as contrary to Section 3:100 of this ordinance.
Section 3:103. Permit to Exceed vVeight Limitations.
Any vehicle or combination of vehicles may be operated upon the highways
of the City excepting state trunk highways, in excess of the weight
limits prescribed in subdivision 2 of Section 169. 83, Minnesota Statutes,
if the owner thereof shall first secure from the City Engineer a certificate
setting forth the route or routes and the conditions under which such
vehicle or combination of vehicles may be operated, and such vehicle
or combination of vehicles shall thereafter be so operated in
accordance with the terms of such certificate. The City Engineer is
hereby empowered, and it is hereby made his duty, to issue or deny,
or to issue in modified form, such certificates upon application and
to prescribe therein the route or routes and the conditions for
operations under each such certificate, and in determining such route
or routes and such conditions, the City Engineer shall permit maximum
use of the particular highways and bridges consistent with the meximum
capacity of such highways and bridges as determined by the Engineer
in accordance with highway engineering practice. The City Engineer
shall have the power to revoke or to modify the terms of any existing
certificate at any time in the event of operations in violation of any
such certificate or in the event of changed conditions requiring such
action. The original or a correct copy of the certificate under which
operations are being conducted shall be carried at all times in the
driver's cab or any vehicle or combination of vehicles while the same
is being operated thereunder.
Section 3:110. State Drivers License Required. No person
shall operate or drive any mot or vehicle upon any street or highway
of the City of St. Louis Park unless such person has a valid license
as a driver under the provisions of Chapter 171, Minnesota Revised
Statutes, except those persons expressly exempted by said chapter.
Section 3:111. Posses cion of License. No person except
those expressly exempted by said Chapter 171, Minnesota Revised Statutes,
shall operate or drive any motor vehicle upon any street or highway of
the City of St. Louis Park unless he or she shall have in his or her
immediate possession at all times when operating such vehicle a
license to operate motor vehicles in the State of Minnesota issued
pursuant to said Chapter and shall display the same upon demand of a
municipal Judge, a peace officer, an authorized representative
of the Highway Department, or any officer authorized by law to
enforce the laws relating to the operation of motor vehicles on public
streets and highways, and the licensee shall, upon request of any such
officer, write his name in the presence of such officer in order that
the identity of the licensee may be determined.

Section 3:114. Windshields Obstructed Vision. No person
shall drive or operate any motor vehicle with a windshield cracked
or discolored to an extent to limit or obstruct proper vision, or with
any objects suspended between the driver and windshield, other than
sun visots and rear vision mirrors, or with any sign, poster, or
other non-transpare nt material upon the front windshield, sidewings,
side or rear windows of such vehicle, other than a certificate or other
paper required to be so displayed by law, or authorized by the State
Director of Civil Defense.
The windshield on every motor vehicle shall be equipped
with a device for cleaning rain, snow or other moisture from the windshield
which device shall be so constructed as to be controlled or operated by
the driver of the vehicle.
No person shall drive any motor vehicle with the windshield
or front side windows covered with steam or frost to such an extent as
to prevent proper vision.
Section 2. Repealed Ordinances. The following Ordinances
are hereby repealed:
Ordinance No. 567, Entitled "An Ordinance Re -Adopting
by Reference Chapter 169, Minnesota Revised Statutes
and Other Statutes Relating to Traffic Regulation"
Adopted March 18, 1957.
Ordinance No. 613, Entitled, "An Ordinance Amending
Ordinance No. 567 Relating To Traffic Regulation, "
Adopted March 3, 1953.
Ordinance No. 692, entitled "An Ordinance Prohibiting
Driving Motor Vehicle With Driver's Vision Obstructed, "
Adopted May 25, 1959.
Ordinance No. 694, entitled "An Ordinance Regulating
Keeping Or Consumption Of Intoxicating And Non -
Intoxicating Malt Beverages In I\ otor Vehicles On
Public Highways, " Adopted iv�ay 25, 1959,
provided however, that the repeal of said Ordinances by the passage of
this Ordinance shall not be construed as abating any actions now pending
under or by virtue of such Ordinance; or as discontinuance, abating, modify-
ing or altering any penalty accruing or to accrue; or as affecting the
liability of any person, firm or corporation, or as waiving any right

of the City under any section or provision existing at the tire of the
passage of this Ordinance; any actions, proceedings, prosecutions or
claims, commenced under any of the above mentioned Ordinances, and
in progress when this Ordinance takes effect shall be continued and
completed under the Ordinances under which Ordinances they were
commenced.
Section 3. Any person violating the provisions of this Ordinance
other than Section 3:100 for which Section penalties are provided
in Section 3:101 thereof, shall be guilty of a misdemeanor and upon
conviction shall be punished by a fine of not more than Three hundred
dollars or by imprisonment for not to exceed 90 days, or both.
Section 4. This Ordinance shall take effect fifteen days after
its publication.

Section 1 Traffic Regulations Traffic in the

There is hereby adopted by reference and
made a part of this section the following stat
utes of the State of Minnesota as heretofore
amended and as in force and effect as of De-
cember 1 1969 three copies of which are
marked as official copies and filed for use and
examination by the public in the office of the
City Clerk
All of Chapter 169 Minnesota Statutes
known as the Highway Traffic Regula-
tion Act ' excepting the following sections
thereof Subdivisions 1 2 and 3 of Section
169 06 Subdivision 9 of Section 169 09
Sections 169 10, 169 11, 169 27 169 66
169 77 169 78 Subdivision 6 of Section
169 83 and Section 169 87
All of Chapter 171 Minnesota Statutes
known as the Driver s License Law
except Section 171 04 thereof
Section 3 101 Penalty It shall be unlawful
and a violation of the requirements of Section
3 100 for any person to violate within the City
of St Louis Park any provision of such statutes

Section 3 102 Complaint A complaint al-

Section 3 103 Permit to Exceed Weight
Limitations Any vehtgle or combination of
vehicles may be operated upon the highways of
the City excepting state trunk highways in
excess of the weight limits prescribed in Sub-
division.2 of Section 169 83 Minnesota Statutes
if the owner thereof shall first secure frau the
City Engineer a certificate setting forth the
route or routes and the conditions under which
such vehicle or combination of vehicles may be
operated and such vehicle or combination of
vehicles shall thereafter be so operated in ac-
cordance with the terms of such certificate
The City Engineer is hereby empowered and it
is hereby made his duty to isse or deny, or to
issue in modified form such certificates upon
application and to prescribe therein the route
or routes and the conditions for operations
under each such certificate and in determin-
ing such route or routes and such conditions
the City Engineer shall permit maximum use
of the particular highways and bridges con-
sistent with the maximum capacity of such
highways and bridges as determined by the
Engineer in accordance with highway engi
neermg practice The City Engineer shall have
the power to revoke or to modify the terns of
any existing certificate at any time in the event
of operations in violation of any such cern('
cate or in the event of changed conditions re-

Section 3 110 State Dnvers License Re
quired No person shall operate or drive any
motor vehicle upon any street or highway of
the City of St Louis Park unless such parson
has a valid license as a driver under the provi-
sions of Chapter 171 Minnesota Revised Stat-
utes except those persons expressly exempted
by said chapter
Section 3 111 Possession of License No
person except those expressly exempted by
said Chapter 171 Minnesota Revised Stalutes
shall operate or drive any motor vehicle upon
any street or highway of the City of St Louis
Park unless he or she shall have in his or her

has been the vice president and printer of the newspaper known as The St Louis Park Sun
and has full knowledge of the facts herein stated as follows• (1) Said newspaper
is printed in the English language in newspaper format and in column and sheet form
