( t; _ DECEMBER 8, 1969 7A AN ORDINANCE REGULATING TAXIDERMY; REQUIRING LICENSE TO OPERATE SUCH A BUSINESS; AND PROVIDING PENALTIES FOR VIOLATIONS OF THE PROVISIONS THEREOF THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. The business of Taxidermy shall be regulated as follows: Section 2:2350. 01. Title. This ordinance shall be known, cited and referred to as the "St, Louis Park Taxidermy Ordinance", except as referred to herein, where it shall be known as "this ordinance". Section 2:2350. 03. Definitions. The following definitions shall apply in the interpretation and enforcement of this ordinance and the following words and terms wherever they occur in this ordinance are defined as follows: Subd. 1. Taxiderrny shall mean the art of preparing and mounting the skins of animals, fowl, and fish to appear lifelike. Subd. 2. Health Authority shall mean the Health Officer and Public Health Sanitarians. Subd. 3. Person shall mean any individual, firm partner- ship, corporation, trustee, or association and with respect to acts prohibited or required herein shall include employees and licensees. Section 2:2350.05. License Required. No person shall operate, maintain, or be responsible for the operation of any business of taxidermy within the corporat limits of the City of St. Louis Park, unless a license for the condue cf ..:-Lich business and the premises where such business is conducted, issued pursuant to this ordinance, shall have been obtained from the City Manager. Section 2:2350.07. License Fee. The annual license fee for the business of taxidermy shall be $100. 00 for each business location. Section 2:2350.09. License Application. The application for a taxidermy license shall be made on forms furnished by the City Manager and shall set forth (a) the general nature of the business, (b) the location, (c) the general source of material, including from foreign countries, to be processed, (d) method of storing garbage and refuse and disposal thereof, (e) and such other information as the City Manager shall require. Section 2:2350.11. Display of License. Such license shall be conspicuously displayed at all times in a public area of the building on the licensed premises. Section 2:2350.13. Posting of Inspection Report. Each inspection report shall be posted by the Health Authority upon an inside wall of the place of business, not in a public area, and such inspection report shall not be defaced or removed by any person, except the Health Authority. The posting of the inspection report upon the inside wall shall constitute service of an official notification of the inspection by the Health Authority. The Health Authority may, in lieu of posting such report, deliver it to the licensee or his authorized agent or send it by registered mail, return receipt requested, in the U. S. Mail. Another copy of the inspection report shall be filed with the records of the Health Department. Section 2:2350.15. Inspection of Businesses of Taxidermy and Licensed Premises. The Health Authority shall inspect every business of taxidermy and the licensed premises therefor as frequently as he may deem necessary to insure compliance with this ordinance. Section 2:2350.17. Access to Premises. All licensees shall, upon request of the Health Authority, permit access to all parts of the licensed premise at any reasonable time, for the purpose of inspection. Section 2:2350.19. Records to be Kept and Access Thereto. A11 licensees shall keep the complete records required by the laws of the State of Minnesota upon the licensed premises and shall exhibit and allow copying by the Health Authority of any records necessary to ascertain the source of all materials upon request of the Health Authority at any reasonable time. Section 2:2350. 21. Removal and Correction of Violations. Whenever, a report shall be posted in a licensed place of business giving notification of one or more violations of this ordinance, all licensees, owners, and other persons operating such taxidermy business shall correct or remove each violation within the length of time specified for the correction or removal of each such violation as noted on the inspection report by the Health Authority. The failure to remove or correct each such violation within the time period noted on the inspection report shall constitute a separate violation of this ordinance. Section 2:2350.23. General Construction and Finish, The floors, wallls, and ceiling of the licensed premises shall be constructed of, and maintained with, smooth, cleanable and tight finish material. All equipment shall be installed and maintained so as to facilitate the cleaning thereof and of all adjacent areas and shall be kept in good repair. Preparation areas shall be of an impervious material. -2- Section 2:2350.25. Tanning of Hides Prohibited. No person shall tan hides on premises licensed for the business of taxidermy. Section 2:2350.27. Ventilation. A ventilation system shall be installed which will provide a supply of fresh make-up air, heated in winter, sufficient to eliminate any foul and obnoxious odors and to replace air expelled. Separate and additional exhaust and make-up air systems shall be provided if necessary to eliminate any foul and obnoxious odors. Section 2:2350.29. Disposal Methods. All offal, organic waste, garbage, and refuse shall be stored in tightly covered containers. All offal, garbage, and organic waste shall be secured in plastic bags of 6 to 8 millimeter thickness or the equivalent and kept in the covered containers. All containers shall be kept clean. Whenever such waste materials or operating conditions in the licensed premises shall cause a nuisance or odors, the Health Authority shall require the freezing of such substances until their removal from the licensed premises. Section 2:2350. 31. Disease Control. The Health Authority shall take all measures necessary, including but not limited to embargo and condemnation, to control the transmission of any disease from the licensed premises as well as any source of potential disease transmission. Section 2:2350.33. Premises shall be kept clean. The licensed premises shall be kept clean and free of offal and organic waste as discernible by ordinary sight, smell, or touch, and such premises shall be kept free of litter, insects, vermin, and debris. Section 2:2350.35. Hazard Limitations. The licensed premises shall not use Class I and II liquids, solvents, or sprays, flash point at or below 70° F. in the processing procedure. Section 2:2350.37. Activity Limitations. No full carcass of animals over twenty-five (25) pounds shall be permitted on the premises for processing or future processing not including fish. Processing of bone and horn for preparation of mounting shall be accomplished in such a manner as not to give off offensive odors in or about the premises. Section 2:2350. 39. Interference With or Hindrance of the Health .Authority. No person shall interfere with or hinder the Health Authority in the performance of duties under this ordinance or the laws of the State of Minnesota, nor prevent the performance thereof. -3- Section 2:2350.41. Revocation of License. Any license issued as required under this ordinance may be revoked in the manner provided in Sections 2:15 and 2:16 of the St. Louis Park Ordinance Code, on the grounds therein provided, or upon conviction of violation of any provision of this ordinance. Section 2:2350. 43. Separability. Should any section, subdivision, clause, or other provision of this ordinance be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the ordinance as a whole nor of any part not so declared to be invalid. Section 2. Penalty. Any person violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than three hundred dollars ($300. 00) or by imprisonment for a period not to exceed 90 days, or both. Section 3. Effective Date. This ordinance shall take effect fifteen days after its publication. Adopted by the City Council Decem§er 15, 1969.
