ORDINANCE NO. 1089
AN ORDINANCE AMENDING THE ST. LOUIS PARK ORDINANCE CODE
RELATING TO FEES AND CHARGES TO BE PAID CITY FOP. SPECIAL
SERVICES, SECTION 1:271, ENTITLED "STREET AND ALLEY VACATIONS",
AND SECTION 1:272, ENTITLED "ZONING AND RELATED MATTERS", AND
ORDINANCES NO. 733, PASSED DECEMBER 28, 1959 AND NO. 829,
PASSED MARCH 12, 1962
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. That Section 1:271 of the St. Louis Park Ordinance
Code as amended by Ordinances No. 733, passed December 28, 1959 and
No. 829 passed :'larch 12, 1962 is hereby amended to read as follows:
Section 1:271. Street, Alley, and Utility Easement
Vacations. No petition to vacate a street, alley or
utility easement or portion thereof, shall be filed
with the City Clerk until those petitioning therefor
shall pay to the City Treasurer the sum of Seventy-
five Dollars ($75.00). If the Council denies the
petition prior to publication of notice of hearing,
one-half (1/2) of the fee shall be refunded to the
petitioner.
Section 2. That Section No. 1:272 of the St. Louis Park Ordinance
Code, Ordinance No. 733 entitled "An Ordinance Amending the St. Louis
Park Code Relating to Fees and Charges to be Paid in Zoning and
Related Matters, Section 1:272, Entitled 'Zoning and Related Matters'",
passed December 28, 1959, and Ordinance No. 829 entitled "An
Ordinance Amending the St. Louis Park Code Relating to Fees and
Charges to be Paid in Zoning and Related Matters, Section 1:272,
Entitled, 'Zoning and Related Matters', and Ordinance No. 733,
passed December 28, 1959 on the same subject", passed March 12,
1962 are hereby amended to read as follows:
Section 1:272. Zoning and Related Platters.
(1) Rezoning. No application for change in the boundaries
of any Zoning District shall hereafter be filed until the
petitioner or petitioners shall have paid to the City
Treasurer the sum of One -hundred -fifty Dollars ($150.00).
In cases where the City Planning Commission shall initiate
proceedings for such rezoning, the Council may require that
such payment be made by owners of property involved before
rezoning.

(2) Special Permits. No application for a special permit
under the provisions of the St. Louis Park Zoning Ordinance
as amended, shall be filed until the applicant shall have
paid to the City Treasurer the sum of One Hundred Dollars
($100.00).
(3) Variances. No application for a variance from the
provisions of the St. Louis Park Zoning Ordinance as amended,
shall be filed until the applicant shall have paid to the
City Treasurer the sum of One Hundred Dollars ($100.00).
(4) Refunding of Fees. If a petition for rezoning or an
application for a special permit or a variance shall be
withdrawn prior to initial consideration by the Planning
Commission or Board of Zoning Appeals, or if such a
petition or application shall be denied by the Council
upon initial consideration by that body without referral
to the Planning Commission or Board of Zoning Appeals,
or if such a petition for rezoning or an application for
special permit or variance is withdrawn by the petitioner
after initial consideration by the Planning Commission but
before consideration by the City Council, one-half of
the fee shall be refunded to the petitioner.
Section 3. This ordinance shall take effect fifteen days
after its publication.

W JOHN BERTRAM, being duly sworn, on oath says he is and during all times here stated
has been the vice president and printer of the newspaper known as The St Louis Park Sun
and has full knowledge of the facts herein stated as follows (1) Said newspaper
is printed in the English language in newspaper format and in column and sheet form
equivalent in printed space to at least 900 square inches (2) Said newspaper is a weekly and
is distributed at least once each week (3) Said newspaper has 50% of its news columns devoted
to news of local interest to the community which it purports to serve and does not wholly
duplicate any other publication and is not made up entirely of patents, plate matter and
advertisements. (4) Said newspaper is circulated in and near the municipality which it purports
to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of
at least 75% of its total circulation currently paid or no more than three months in arrears
and has entry as second-class matter in its local post -office. (5) Said newspaper purports to
erve the City of St. Louis Park in the County of Hennepin and it has its known office of
rue in the City of Bloomington in said county, established and open during its regular business
,urs for the gathering of news, sale of advertisements and sale of subscriptions and main-
tained by the managing officer or persons in its employ and subject to his direction and con-
trol during' all such regular business hours and devoted exclusively during such regular
business hours to the business of the newspaper and business related thereto (6) Said news-
paper files a copy of each issue immediately with the State Historical Society. (7) Said news-
paper has complied with all the foregoing conditions for at least two years preceding the day
or dates of publication mentioned below. (8) Said newspaper has flied with the Secretary of
State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the
form prescribed by the Secretary of State and signed by the publisher of said newspaper and
sworn to before a notary public stating that the newspaper is a legal newspaper
He further states on oath that the printed ordinance
hereto attached as a part hereof was cut from the columns of said newspaper. and was printed
and published therein in the English language, once each week, for 1 successive weeks,
that it was first so published on Wed. the 26th day of Nov. i969
and was thereafter printed and published on every to and including
the day of 19 and that the following is a printed copy
of the lower case alphabet from A to Z. both inclusive, and is hereby acknowledged as being
the -size and kind of type used in the composition and publication of said notice. to wit•
