ORDINANCE NO. 1086
AN ORDINANCE AMENDING SECTIONS 2:525 THROUGH 2:528
OF THE ST. LOUIS PARK ORDINANCE CODE ENTITLED "SALE
OF CHRISTMAS TREES"
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. That Sections 2:525 through 2:528 of the St. Louis Park
Ordinance Code entitled "Sale of Christmas Trees" are hereby amended to
read as follows and adding thereto Sections 2:529 through 2:531 as follows:
Section 2:525. License Required. No person shall sell
at retail or wholesale, any cut evergreen fir, spruce, or other
tree of like kind for use as what is generally known and described
as a "Christmas Tree" or engage in the business of selling any
such trees within the corporate limits of the City without first
having obtained a license to do so from the City Manager.
Section 2:526. Application. The application for such
license shall state the correct place of intended sale of such
Christmas trees, together with the name of the person from
whom and the place from which he intends to cut or secure the
Christmas tree intended to be sold by him and such other
information as shall be required.
Section 2:527. License Fee. The annual fee for such
license shall be Twenty-five Dollars ($25.00).
Section 2:528. Term. Such license shall be issued
for the term of the period from November 15 to December 28th.
Section 2:529. Inspections. All temporary lighting and
heating installations shall be inspected and approved by the
Department of Protective Inspection and all fire prevention
equipment shall be inspected and approved by the Fire Department
prior to use of the licensee premises. No person shall sell
such trees prior to such time as these inspections have been
completed.
Section 2:530. Plot Plan. The application described in
Section 2:526 hereof shall be accompanied by a sketch of the
site to be licensed showing the location of property lines,
buildings, and sales display areas thereof.
Section 2:531. Disposal of Unsold Trees. All unsold
trees described in Section 2:525 hereof shall be removed from
the licensed premises by the licensee and shall not be permitted
to remain on the premises after December 28th of any year. No
person shall burn any such trees within the City. To insure
compliance with this section, the application described in
Section 2:526 hereof shall be accompanied by a $100 cash deposit
which shall he held by the City Treasurer until released as
hereinafter provided. On December 29th, or as soon as possible
thereafter, the Supervisor of Protective Inspections shall examine
such licensed premises and if he shall find that all trees have
been satisfactorily removed from the licensed premises he shall
so certify to the City Clerk who shall then refund the said
deposit by mailing the same to the licensee at the address given
in the application. If the _icensee has failec or neglected to
comply with this section the Supervisor of Protective Inspections
shall dispose of the trees so remaining on the licensed premises
and shall certify the amount of such cost to the City Clerk and
the City Clerk shall deduct the cost of such disposal from the
deposit amount and the balance, if any, shall be refunded by
mail to the licensee.
Section 2. Penalty. Any person violating the provisions of
this ordinance shall be guilty of a misdemeanor and upon conviction
thereof shall be punished by a fine of not more than Three Hundred
Dollars or by imprisonment for not more than ninety days, or both.
Section 3. Effective Date. This ordinance shall take effect
fifteen days after its publication.

has been the vice president and printer of the newspaper known as The St Louis Park Sun
and has full knowledge of the facts herein stated as follows• (1) Said newspaper
is printed in the English language in newspaper format and in column and sheet form
equivalent in printed space to at least 900 square inches (2) Said newspaper is a weekly and
is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted
to news of local interest to the community which it purports to serve and does not wholly
duplicate any other publication and is not made up entirely of patents, plate matter and
advertisements. (4) Said newspaper is circulated in and near the municipality which it purports
to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of
at least 75% of its total circulation currently paid or no more than three months in arrears
and has entry as second-class matter in its local post -office (5) Said newspaper purports to

trol during all such regular business hours and devoted exclusively during such regular
business hours to the business of the newspaper and business related thereto (6) Said news-
paper files a copy of each issue immediately with the State Historical Society. (7) Said news-
paper has complied with all the foregoing conditions for at least two years preceding the day
or dates of publication mentioned below (8) Said newspaper has filed with the Secretary of
State of Minnesota prior to January 1. 1966 and each January 1 thereafter an affidavit in the
form prescribed by the Secretary of State and signed by the publisher of said newspaper and
sworn to before a notary public stating that the newspaper is a legal newspaper

I Section 1 That Sections 2 525 through 2 528
of the St Louis Park Ordinance Code entitled
"Sale of Chnstinas Trees ' are hereby amend-
ed to read as follows and adding thereto Sec-
tions 2 529 through 2 531 as follows
Section 2 525 License Required No per-

any such trees with in the corporate lim-
its of the City without first having obtain-

Section 2 526 Apphcation The applica-
tion for such license shall state the cor-
rect place of intended sale of such Christ-
mas trees together with,the name of the
person Irom whom and the place from
which he intends to cut pr secure the
Chnstmas tree intended to be sold by him
and such other information as shall be
required ,
Section 2 527 License ,Fee The annual
fee for such license shall be Twenty-five
Dollars 1825 001
Section 2 528 Term Such hcense shall
be issued for the term of the penod from
November 15 to December 28th
Section 2 529 Iospectlom All temporary

All unsold trees described in Section 2 525 '

premises by the licensee and shall not be

the apphcation described in Section 2 526
hereof shall be accompanied by a 8100
cash deposit which shall be held by the
City Treasurer until released as herein -
alter prowled On December 29th or as
soon as possible thereafter the Supervisor
of Protective Inspections shall ex-
amine such licensed premises and if he
shall find that all trees have been satis-
factdnlv-removed from the licensed prem-
ices he shall so certify to the Cite Clerk
who shall then refund the said deposit by
maihng the same to the licensee at the ad-
dress given in the application 11 the li-
censee has failed or neglected to comply
with this section the Supervisor of Protec-
tive Inspections shall dispose of the trees
so remaining on the licensed premises
and shall certify the amount of such cost
to the City Clerk and the City Clerk shall
deduct the cost of such disposal from the
deposit amount and the balance if any
shall be refunded by mail to the licensee
Section 2 Penalty Any person violating
the provisions of this ordinance shall be guilty
of a misdemeanor and upon conviction there-
of shall be punished by a fine of not more
than Three Hundred Dollars or by impnson-
ment for not more than ninety days or both
Section 3 Effective Dale This ordinance
shall take effect fifteen days after its pub-
lication
