AN ORDINANCE AMENDING SECTION 4:815.21, OF ORDINANCE
NO. 1034, ADOPTED MAY 20, 1968, ENTITLED "AN ORDINANCE
REGULATING BURNING: REQUIRING CONTROL AND CORRECTION
OF AIR POLLUTION: REQUIRING LICENSES AND PERMITS TO
OPERATE CERTAIN EQUIPMENT; AND PROVIDING PENALTIES
FOR VIOLATIONS OF THE 2ROVISIONS THEREOF, "RELATIVE
TO FUEL BURNING EQUIPMENT LICENSE FEE
THE CITY OF ST. LOUIS PARC DOES ORDAIN:
Section 1. That Section 4:315.21, of Ordinance No. 1034, passed
May 20, 1968 entitled "An Ordinance Regulating Burning; Requiring
Control and Correction of Air Pollution; Requiring Licenses and Permits
to Operate Certain Equipment; And Providing Penalties for Violations of
the Provisions Thereof." is hereby amended to read as follows:
Section 4:815.21. Fuel Burning Equipment License Fee. For each
single building for business and industrial use and for each single building
for residential use having five (5) or more family dwelling units the annual
fuel heating equipment license fee shall be Twenty -Five ($25. 00) Dollars
provided, however, if there are two or more buildings all located within
a compact and contiguous area, owned by a single licensee, using the same
grade of oil in their fuel burning equipment, and each building having its
own fuel burning equipment, the annual license fees shall be as follows:
$25. 00 for the first building plus $2. 00 for each building
after the first and less than eleven (11) buildings;
$5. 30 for each building in excess of ten (10) and less than
twenty one (21) buildings;
$4. 00 for each building in excess of twenty (20)and less
than thirty-one (31); and $3. 00 for each building 'in'excess
of thirty (30).

Provided, further, the license fees shall apply only to licenses issued after
the effective date of this ordinance, and provided further that Section 4:815.23,
Combination License Fees, providing for a reduction in license fees for
Process Equipment Licenses, Refuse Burning Equipment Licenses and -
Fuel Burning Equipment Licenses in combination to any one licensee,
shall not be applied in such a manner as to further reduce the license fees
provided in this section, and its application shall be limited to reduction
of Process Equipment Licenses and Refuse Burning Equipment License fees.

W JOHN BERTRAM, being duly sworn, on oath says he is and during all times here stated
has been the vice president and printer of the newspaper known as The St Louis Park Sun
and has full knowledge of the facts herein stated as follows (1) Said newspaper
is printed in the English language in newspaper format and in column and sheet form
equivalent in printed space to at least 900 square inches (2) Said newspaper is a weekly and
is distributed at least once each week (3) Said newspaper has 50% of its news columns devoted
to news of local interest to the community which it purports to serve and does not wholly
duplicate any other publication and is not made up entirely of patents, plate matter and
advertisements (4) Said newspaper is circulated in and near the municipality which it purports
to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of
at least 75% of its total circulation currently paid or no more than three months in arrears
and has entry as second-class matter in its local post -office. (5) Said newspaper purports to
serve the City of St. Louis Park in the County of Hennepin and it has its known office of
ie in the City of Hopkins in said county, established and open during its regular business

tained by the managing officer or persons in its employ and subject to his direction and con-

paper has complied with all the foregoing conditions for at least two years preceding the day
or dates of publication mentioned below (8) Said newspaper has filed with the Secretary of
State of Minnesota prior to January 1, 1986 and each January 1 thereafter an affidavit in the
form prescribed by the Secretary of State and signed by the pubhsher of said newspaper and
sworn to before a notary public stating that the newspaper is a legal newspaper
