AN ORDINANCE PRESCRIBING REGULATIONS GOVERN-
ING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY
FROM FIRE OR EXPLOSION AND ADOPTED BY REFERENCE
PORTIONS OF THE AMERICAN INSURANCE ASSOCIATION
CODE, ENTITLED "FIRE PREVENTION CODE, 1965 EDITION"
AND ESTABLISHING A FIRE PREVENTION BUREAU AND
PROVIDING INSPECTORS THEREFOR AND DEFINING THEIR
POWERS AND DUTIES
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. That conditions hazardous to life and property from fire or ex-
plosions are hereby regulated as follows:
Section 5:1100. Adoption of Fire Prevention Code by Reference. There
is hereby adopted by the City of St. Louis Park for the purpose of prescrib-
ing regulations governing conditions hazardous to life and property from fire
or explosion, that certain code entitled the "Fire Prevention Code, 1965
Edition, " except that portion of Article 16 thereof entitled "Flammable and
Combustible Liquids, " as set forth in Division VI thereof entitled "Service '
Stations" containing Sections 16. 61, 16. 62, 16. 63, 16. 64, 16. 65, 16. 66, 16. 67,
16. 68 and 16. 69 and also adopting that certain code entitled "October 1966
Revision of the Fire Prevention Code, 1965 Edition" relating to Service Stations,
both of which codes have been prepared by the American Insurance Association,
being particularly the 1965 edition with the 1966 revisions thereof, ancT the
whole thereof consisting of Articles 1 through 30 inclusive, not less than (3)
copies of both of said codes have been, and now are, filed in the office of the
Clerk of the City of St. Louis Park for use and examination by the public and
marked "Official Copies" and a substantial supply thereof available for distri-
bution and the same are hereby adopted and incorporated as fully as if set out
at length herein, and from the date on which this ordinance shall take effect,
the provisions thereof shall be controlling within the limits of the City of St.
Louis Park.
Section 5:1101. Establishment of Bureau of Fire Prevention. The Fire
Prevention Code shall be enforced by the Bureau of Fire Prevention in the Fire
Department of the City of St. Louis Park which is hereby established and which
shall be operated under the supervision of the Chief of the Fire Department.
Section 5:1102. Duties of Bureau of Fire Prevention. The Fire Marshal
in charge of the Bureau of Fire Prevention shall be the Fire Chief as set forth
in Section 1:107 (2) C of the St. Louis Park Ordinance Code. The Chief of the
Fire Department may detail such members of the Fire Department as Inspectors
as shall from time to time be necessary.
0 Section 5:1103. Definitions.

Subdivision A. Wherever the word "Municipality" is used in the
Fire Prevention Code, it shall mean the City of St. Louis Park.
Subdivision B. Wherever the words "Chief of the Bureau of Fire
Prevention" are used in the Fire Prevention Code they shall mean the
Fire Chief of the City of St. Louis Park.
Subdivision C. Wherever Section Numbers 16.61, 16. 62, 16. 63,
16. 64, 16. 65, 16. 66, 16. 67, 16.63 or 16.69 or the subject matter
therein contained, shall be mentioned or referred to in the Fire Pre-
vention Code, 1965 Edition heretofore mentioned in Section 5:1100 of
this ordinance, such section numbers and references to subject
matter shall refer to the corresponding numbers and materials as set
forth in the "October 1966, Revision of the Fire Prevention Code, 1965
Edition" as heretofore also mentioned in said Section 5:1100 of this
Ordinance.
Section 5:1104. Establishment of Limits of Districts in which Storage of
Flammable Liquids in Outside Above -ground Tanks is to be Prohibited.
Subdivision A. Zones comprising areas described as the limits
referred to in Section 16. 22 of the Fire Prevention Code in which
storage of flammable liquids in outside above -ground tanks is prohi-
bited, are hereby established as follows: Zones comprising areas
described as Use Districts R1, R2, R3, R4, and RB, as bounded
and established pursuant to Ordinance No. 730, passed December 28,
1959, known as "St. Louis Park Zoning Ordinance."
Subdivision B. The limits referred to in Section 16.51 of the
Fire Prevention Code, in which new bulk plants for flammable liquids
are prohibited, are hereby established as follows: Zones comprising
areas described as R1, R2, R3, R4, and RB, as bounded and established
pursuant to Ordinance No. 730, passed December 28, 1959 known as
"St. Louis Park Zoning Ordinance."
Section 5:1105. Establishment of Limits in which Bulk Storage of
Liquified Petroleum Gases is to be Restricted. The limits referred to in
Section 21. 6a of the Fire Prevention Code, in which bulk storage of liquified
petroleum gas is restricted, are hereby established as follows: Zones
comprising areas described as R1, R2, R3, R4, and RB, as bounded and
established pursuant to Ordinance No. 730, passed December 28, 1959,
known as "St. Louis Park Zoning Ordinance."

Section 5:1106. Establishment of Limits of Districts in Which Storage
of Explosives and Blasting Agents is Prohibited. The limits referred to in
Section 21. 6a of the Fire Prevention Code, in which storage of explosives
and blasting agents is prohibited are hereby established as follows: Zones
comprising areas described as R1, R2, R3, R4, RB, B1, B2, and 13, as
bounded and established in Crdinance No. 730, passed December 28, 1959,
known as "St. Louis Park Zoning Ordinance."
Section 5:1107. Appeals. Whenever the Chief of the Fire Department
shall disapprove an application or refuse to grant a license or permit applied
for, or when it is claimed that the provisions of the code do not apply, or
that the true intent and meaning of the code have been misconstrued or wrong-
ly interpreted, the applicant may appeal from the decision of the Chief of the
Fire Department to the City l,'_anager within thirty (30) days from the date of
such decision of the Fire Chief.
Section 5:1108. Separability. Should any section, subdivision, clause,
paragraph, sentence, or word of this ordinance, or of the code hereby adopted,
be declared by a Court of Competent Jurisdiction for any reason to be invalid,
such decision shall not affect the validity of the ordinance as a whole nor any
part thereof other than the part so declared to be invalid, it would have passed
all other portions of this ordinance independent of the elimination herefrom
of any such portion as may be declared invalid.
Section 2. Repealer. Ordinance No. 782, Entitled "An Ordinance Prescribing
Regulations Governing Conditions Hazardous to Life and Property from Fire
or Explosion and Adopting by Reference Portions of the National Board of Fire
Underwriters Code, Entitled"Fire Prevention Code, 1960 Edition, "and Estab-
lishing a Fire Prevention Bureau and Providing Inspectors Therefor and De-
fining their Powers and Duties" adopted April 24, 1961 is hereby repealed,
such repeal shall be effective upon the effective date of this ordinance.
Section 3. Penalty. Any person violating the provisions of this ordinance
shall be guilty of a misdemeanor and upon conviction thereof shall be punished
by a fine of not more than one hundred dollars ($100. 00) or by imprisonment
for not to exceed ninety (90) days.

Section 4. This ordinance shall take effect fifteen days after its publication.

has been the vice president and printer of the newspaper known as The St. Louis Park Sun
and has full knowledge of the facts herein stated as follows: (1) Said newspaper
is printed in the English language in newspaper format and in column and sheet form
equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and
is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted
to news of local interest to the community which it purports to serve and does not wholly
duplicate any other publication and is not made up entirely of patents, plate matter and
advertisements. (4) Said newspaper is circulated in and near the municipality which it purports
to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of
at least 75% of its total circulation currently paid or no more than three months in arrears
and has entry as second-class matter in its local post -office. (5) Said newspaper purports to
serve the City of St. Louis Park in the County of Hennepin and it has its known office of
issue in the City of Hopkins in said county, established and open during its regular business
rs for the gathering of news, sale of advertisements and sale of subscriptions and main -
by the managing officer or persons in its employ and subject to his direction and con-
trol during all such regular business hours and devoted exclusively during such regular
business hours to the business of the newspaper and business related thereto. (6) Said news-
paper files a copy of each issue immediately with the State Historical Society. (7) Said news-
paper has complied with all the foregoing conditions for at least two years preceding the day
or dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of
State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the
form prescribed by the Secretary of State and signed by the publisher of said newspaper and
sworn to before a notary public stating that the newspaper is a legal newspaper.
