LOUIS PARK DOES ORDAIN: Section 1. The construction, extension, alteration, or repair of all Plumbing shall be regulated and licensed as follows: Section 5:200. Title. Sections 5:201 to 5:205 inclusive shall be known as "The St. Louis Park 1968 Plumbing Code" and is referred to therein as "this Code." Section 5:201. Scope and Application of Plumbing Code. From and after the effective date of this Code no person shall construct, extend, alter or repair any plumbing work within the City of St. Louis Park unless in compliance with the provisions of this Code, except in build- ings belonging to the United States or to the State of Minnesota. The regulations in this Code contained shall be held to include and govern all work done and materials used: (1) In installing plumbing fixtures which serve a special purpose, whether connected directly or indirectly to any waste line or stack; (2) In connecting or repairing any system of drainage where- by foul, waste or surplus water, sewage or other fluid is discharged or proposed to be discharged through a pipe or pipes from any building, premises, or establishment into any public or building sewer, drain, sump, cesspool, o or other receptacle, or into any natural or artificial watercourse flowing through public or private property; (3) In ventilating any building sewer, or any fixture or appurtenance connected therewith. Section 5:202. Adoption of Plumbing Ordinance of City of Minneapolis. There is hereby adopted and incorporated into this Code by reference thereto, by marking three copies thereof as "official copies" and filing them for reference and inspection in the office of the City Clerk, all of that certain ordinance of the City of Iv,anneapolis adopted by the City Council of said City, entitled "An ordinance to regulate the con- struction, extension, alteration and repairing of plumbing work within e the City of iv inneapolis and to provide for the sanitary installation of such plumbing work and repealing certain ordinance provisions, as amended, and now in effect, and containing Chapters 130 through 132 inclusive, and designated in the City of i\ -Minneapolis Ordinance Com- pilation as 130. 010 through 132. 320; provided, however, that the follow- ing numbered sections of said ordinance are not hereby adopted or in- corporated into this Code: 130. 060, 130. 070, 131. 020, 131. 030, 131. 090, and provided, further that wherever the term "City of Minneapolis" shall appear in said ordinance it shall be construed to mean "City of St. Louis Park;" and wherever the term "Plumbing Inspector" is used it shall be construed to mean the "Plumbing Inspector of the City of St. Louis Park, " and the term "iv_inneapolis Plumbing Ordinance" as used therein shall be construed to mean "St. Louis Park Plumbing Code. " Section 5:203. Permits. (a) It shall be unlawful for any person to do any of the work described in Section 5:201 without first obtaining a permit therefor from the Building Inspector, such permits shall be issued by the Building Inspector only to persons licensed as plumbers by the City, or to persons making application to do any such work wholly within a residence owned and occupied by the applicant to whom the permit is to be issued. (Ord. 656, effective December 5, 1968) (b) Permits will not be required for repairing leaks in drain, soil, waste are vent pipes, or for resetting fixtures or repairs to faucets, valves or water supply pipes. Section 5:204. Permit Fees. The fees for such permits shall be as follows: (a) For each permit issued under this ordinance there shall be a minimum fee of $5. 00 for said permit. (b) The fees for all plumbing permits shall be computed on the basis of the number of plumbing fixtures and/or devices provided for in such permits, whether subsequently so in- stalled or not, and the fee for each such fixture so provided for shall, except as hereinafter specifically provided, be $2. 00. (c) Where any such permit is issued for the installation of plumbing work providing for certain proposed fixtures which are to be installed or set later and for which fixture openings are to be left, a fee of $1.00 shall be -2- • • charged for each such opening, which fee shall be in addition to the fee charged for other plumbing work, if any, included in the same permit. (d) Where any such permit is issued for the setting only of certain plumbing fixtures on openings previously left for same, a fee of $1. 00 shall be charged for each such fixture, which fee shall be in addition to the fee charged for other plumbing work, if any, included in the same pe rmit. (e) Where any such permit is issued for any of the following specifically mentioned plumbing fixtures or other devices the fee which shall be charged for each such fixture or device shall be as follows and shall be in addition to the fee charged for other plumbing work, if any, included in the same permit: Beer dispenser, when connected with water supply $1. 50 Blow -off basin 3. 50 Catch -basin 3. 50 Water Heater 2.50 New ground run for existing building 2. 50 Hydraulic valve 2. 50 Rainwater leader, for 10 stories or fraction thereof and for each 15 stories or fraction thereof in excess of 10 stories 3. 50 Sump or receiving tank 3. 50 Installation of water softening device 5. 00 Cesspool or drain field connection 10. 00 Sewer Connection 15.00 (f) (g) For each permit for the alteration or repairing of existing plumbing and for other plumbing work not included above, the fee shall be $5. 00 for the first One Hundred Dollars ($100. 00), or fraction thereof in the estimated cost of such proposed work; for each additional Cne Hundred Dollars ($100. 00), or fraction thereof in such estimated cost $2.50 shall be added to the above prescribed fee for such permit. For any reinspection necessitated by negligence or error of the permittee there shall be a fee of $5. 00 in addition to the basic permit fees for each such call- back made by the Inspector. e Section 5:205. Fees, Double, When. Should any person co -partner- ship, or corporation begin work of any kind such as hereinbefore set forth, or for which a permit from the Inspector of Buildings is required by ordinance, without having secured the necessary permit therefor from the Inspector of Buildings either previous to or during the day of com- mencement of any such work, or on the next succeeding business day where such work is commenced on Saturday or on a Sunday or a holiday, he shall, when subsequently securing such permit, be required to pay double the fees hereinbefore provided for such permit, and shall be subject to all the penal provisions of this ordinance. Section 5:206. Separability — Should any section, subdivision, clause or other provisions of this ordinance be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the ordinance as a whole nor of any part thereof other than the part so de- clared to be invalid. Section 5:207. Ordinances Repealed. The following ordinances of the City of St. Louis Park are hereby repealed in their entirety: Sections 5:200, Entitled "Title"; 5:201, Entitled "Scope and Application of Plumbing Code"; 5:203 Entitled "Adoption of Plumbing Ordinance of the City of Iviinneapolis"; 5:203, Entitled "Permits", all being sections of the St. Louis Park Ordinance Code, and Ordinance No. 770, Entitled "An Ordinance Regulating the Design, Specification and Installation of Electric Wires, Apparatus and Plants" adopted January 23, 1961. Section 5:204, Entitled, "Permit Fees, " of Ordinance No. 993, Entitled "An Ordinance Amending the St. Louis Park Ordinance Code Relating to Permits: Section 5:204 Plumbing Permits, Section 5:305 Gas Piping Permits, Section 5:405 Heating and Air Conditioning Permits, Section 5:504 Electrical Permits, " adopted May 15, 1967, provided, however, that this repeal shall not affect any pending prosecution for violation of any ordinance herein repealed and shall not relieve any person of penalty or other legal liability for violation or failure to comply with any provision of any such ordinance herein repealed. Section 2. Penalty. Any person violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued, or permitted, and upon conviction of any -4- • such violation such person shall be punishable by a fine of not more than $100. 00, or by imprisonment for not more than 90 days. Section 3. Effective Date. This ordinance shall take effect fifteen days after its publication.
