ORDINANCE NO. 1046
AN ORDINANCE RELATING TO SNOWMOBILES, REGULATING
THE OPERATION AND USE THEREOF, AND PROVIDING
PENALTL S FOR THE VIOLATION THEREOF
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The operation and use of snowmobiles in the City of St. Louis
Park shall be regulated as follows:
Section 3:400 Definitions.
Subd. 1. For the purposes of this ordinance the terms defined
herein shall have the meaning ascribed to them as
hereinafter set forth:
Subd. 2. "Person" includes an individual, firm, partnership,
corporation, trustee, association, the state and its
agencies and subdivisions, and any body of persons,
whether incorporated or not, and with respect to acts
prohibited or required herein shall include employees
and licensees.
Subd. 3. "Snowmobile" means a self-propelled vehicle designed
for travel on snow or ice or a natural terrain steered
by wheels, skis or runners.
Subd. 4. "Owner" means a person, other than a lien holder.
having the property in or title to a snowmobile entitled
to the use or possession thereof.
Subd. 5. "Operate" means to ride in or on and control the operation
of a snowmobile.
Subd. 6. "Operator" means every persons who operates or is in
actual physical control of a snowmobile.
Subd. 7. "Register" means the act of assigning a registration
number to a snowmobile by the Commissioner of
Conservation.
Subd. 8, "Commissioner" means the commissioner of conserva-
tion acting directly or through his authorized agent.
Subd. 9. "Roadway" means that portion of a highway improved,
designed, or ordinarily used for vehicular travel.
Subd. 10. "Street" or "Highway" shall mean the entire width between
the boundary lines of way or place when any part thereof
is open to the use of the public in the City of St. Louis
Park, as a matter of right, for the purposes of vehicular
traffic.

Subd. 11. "Daylight" hours shall mean any time except from a half
hour after sunset to a half hour before sunrise and at
any other time when there is not sufficient light to
'render clearly discernible persons and vehicles at a
distance of 500 feet.
Section 3:402 County, State and Interstate Highways, Restrictions.
No person shall operate a snowmobile upon the roadway, shoulder, or inside
bank or slope of any trunk or county state aid highway in the City of St. Louis
Park except as provided in this ordinance. No person shall operate a snow-
mobile within the right of way of any trunk or county state -aid highway between
the hours of one-half hour after sunset to one-half hour before sunrise. No
snowmobile shall be operated at any time within the right of way of any inter-
state highway or freeway within St. Louis Park.
Section 3:404 Crossing Streets or Highways. r snowmobile may make
a direct crossing of a street or highway provided:
Subd. 1. The crossing is made at an angle of approximately
90 degrees to the direction of the highway and at a
place where no obstruction prevents a quick and safe
crossing; and
Subd. 2. The snowmobile is brought to a complete stop before
crossing the shoulder or main traveled way of the
highway; and
Subd. 3. The driver yields the right of way to all oncoming
traffic which constitutes an immediate hazard; and
Subd. 4. In crossing a divided highway, the crossing is made
only at an intersection of such highway with another
public street or highway.
Section 3:406. Lamps and Brakes Required. No snowmobile shall be
operated upon a public street or highway unless it is equipped with at least one
bajad lamp and one tail lamp, and with brakes which conform to the requirements
of Section 3:414 hereof.
Section 3:408. Emergencies. A snowmobile may be operated upon a
public street or highway other than as provided by Section3:404 in an emergency
during the period of time when and at locations where snow upon the road-
way renders travel by automobile impractical.
Section 3:410. Traffic Laws and Rules Control Operation. All provisions
of Chapter 169, Minnesota Statutes regulating -traffic and the operation of motor
vehicles upon streets or highways shall apply to the operation of snowmobiles
upon streets and highways, except for those relating to required equipment,
and except those which by their nature can have no application.

Section 3:412 Operation Generally. It shall be unlawful for any
person to drive or operate any snowmobile in the following unsafe or harassing
ways:
Subd. 1. At a rate of speed greater than reasonable or proper
under all the surrounding circumstances;
Subd. 2. In a careless, reckless or negligent manner so as to -
endanger the person or property of another or to cause
injury or damage thereto;
Subd. 3. While under the influence of intoxicating liquor or
narcotics or habit forming drugs;
Subd. 4. Without a lighted head and tail light when required
for safety;
Subd. 5. In any tree nursery or any shrub or tree planting,
in a manner which damages or destroys growing stock,
or landscaping on private or public property.
Section 3:414 Equipment Required. No persons shall operate a
snowmobile within the right of way limits of a street or highway unless it is
equipped with:
Subd. 1. Brakes adequate to control the movement of and to stop
and to hold such vehicle under any conditions of operation.
Subd. 2. At least one headlamp so aimed and of sufficient intensity
to reveal persons and vehicles at a distance of at least
one hundred (100) feet ahead during hours of darkness
under normal atmospheric conditions. Such headlamp
shall be so aimed that glaring rays are not projected
into the eyes of an oncoming driver.
Subd. 3. At least one rear lamp exhibiting a red light plainly
visible from a distance of five hundred (500) feet to
the rear during hours of darkness under normal atmos-
pheric conditions.
Subd. 4. Standard mufflers which are properly attached and which
reduce the noise of operation of the vehicle to the mini-
mum noise necessary for operating the vehicle, and no
person shall use a muffler cut-out, by-pass, or similar
device on said vehicles.
Subd. 5. A safety or so called "dead man" throttle in operating
condition; a safety or "dead man" throttle is defined as a
device which, when pressure is removed from the acce-
lerator or throttle, or causes the motor to be disengaged
from the driving track.

Section 3:416 Unattended Snowmobile on Public Property Prohibited.
It is unlawful for the owner or operator to leave or allow a snowmobile to be or
remain unattended on public property, streets or highways while the motor is
running or with the keys to start same in the ignition switch.
Section 3:418 Permission to enter Private Property. No persons while
operating a snowmobile shall enter upon the lands of another unless and until
permission is cbtained from the owner or lessee, if there be one.
Section 3:420 Public Lands. No person shall operate a snowmobile on
any publicly owned lands, including but not limited to schools, park property,
playgrounds, recreation areas and golf courses, except areas previously
listed or authorized for such use by the proper public authority, in which case
such use shall be lawful and snowmobiles may be driven in and out of such areas
by the shortest route. Authorized areas, in the City of St. Louis Park, owned
by the City, shall be designated by council resolution upon recommendation of
the City Manager.
Section 3:422 Prohibited in Areas Dangerous to Person or Property. No
person shall drive a snowmobile within 100 feet of any fisherman, fish house,
shelter, pedestrian, skating rink or sliding area, or in any other area where
such operation would conflict with use or endanger other persons or property.
Section 3:424 Hours of Operation. No person shall operate a snow-
mobile except during daylight hours, unless the vehicle has the necessary
and proper equipment to be operated at night and in no event shall be operated
after 10:00 p.m. nor before 7:00 a.m.
Section 3:428 Minors, Parents Written Permission. No person under
the age of eighteen years shall operate a snowmobile without having in his
possession written permission to operate snowmobiles, signed by a parent
or legal guardian.
Section 3:430 Passengers and Towing. No person shall operate a snow-
mobile and no person shall ride as a :Jassenger at any time when three or more
persons shall be upon such snowmobile provided however snowmobiles shall
be allowed to tow.
Section 3:432 Registration. No person shall operate a snowmobile which
has not been registered as required by the State of Minnesota Statues, or without
registration numbers so assigned by the Conservation Department securely
fixed on each side of the forward half of the snowmobile in such position as to
provide clear legibility for identification; provided however this provision shall
not apply to the operation of a snowmobile on the private property of an owncr
by the owner or a member of his immediate family or to duly authorized police
officers or other officers employees or agents of political subdivisions of the
State of Minnesota while in the performance cf their duties.

Section 3:434 Valid Driver's License. No person shall operate a
snowmobile within the right of way of any public street within the City of
St, Louis Park unless the operator shall have a valid motor vehicle driver's
license issued to him by the State of Minnesota or is accompanied by a
licensed driver, who is actually occupying a seat in the vehicle, provided
however this requirement shall not apply to persons operating a snowmobile
crossing a public street or highway in a proper manner as described in Section
3:404 of this ordinance.
Section 2. Penalty. Any person violating the provisions of this ordinance
shall be guilty of a misdemeanor and upon conviction shall be punished by a fine
of not more than one hundred dollars or by imprisonment for not to exceed 90
days._
Section 3. Effective Date. This ordinance shall take effect fifteen days
after its publication.
