ORDINANCE NO. 1045
AN EMERGENCY ORDINANCE AUTHORIZING THE CITY
MANAGER TO ENTER INTO A CONTRACT FOR CON-
STRUCTION WORK TO BE UNDERTAKEN BY TI -IE CITY
IN EXCESS OF $2000.00 WITHOUT ADVERTISING FOR
BIDS FOR SANITARY SEWER REFA IRS IN MINNETONKA
BOULEVARD AND GEORGIA AVENUE
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The City Council hereby declares that the emergency
hereinafter defined exists and that an emergency ordinance is necessary
for the immediate preservation of the public peace, health, morals, safety
or welfare in accordance with Section 3.05, 3. 06, 3.08 and 5. 06 of the
Charter of the City of St. Louis Park.
Section 2. The City Council hereby finds and determines the
following facts and defines declares the existence of an emergency as
follows:
1. The County of Hennepin through its Engineering Department, has
been making repairs in County Highway No. 5, which is Minnetonka Boulevard
in the City of St. Louis Park, at its intersection with Georgia Avenue at the
site of a watermain break.
2. Said repairs consist of filling the sub -soil underneath the concrete
pavement by a process known as mud -jacking which consists of forcing a
hardening material into cavities in the underlying earth in a soft condition
to fill existing pockets or holes, which material then in the course of time
hardens to form a support for the pavement.
3. During the process of the repair work to the street as aforesaid,
such hardening material was injected into the sanitary sewer system of the
City of St. Louis Park in said area, filling such sanitary sewer pipe to
within two or three inches of the top thereof in such a manner as to block
the flow of sewerage therein.
4. That as a result of the foregoing it is now necessary to repair the
said sanitary sewer by the removal of such materials at an engineer's esti-
mated cost in the sum of approxin-iately Thirty -Five Hundred Dollars
($3500.00) for work at a depth of approximately Sixteen (16) feet under
the level of the street which work is beyond the capacity of presently
owned city equipment.

5. That the plugging of the sewer as mentioned hereinbefore
constitutes a health hazard of complete stoppage and backing up of
sewerage in the city sanitary sewer system which threat could result
in public health problems at any time and which hazard makes necessary
the immediate letting of a contract for the emergency repair made
necessary by the existing conditions, there being insufficient time for
the usual advertising for bids in the manner required by charter.
6. The City Council hereby declares that an emergency exists in
connection with such sanitary sewer, justifying and requiring that this
ordinance upon its passage on the date hereof shall become effective
immediately without publication, to remove the hazard to the health of
the public as hereinbefore described.
Section 3. The City Manager is hereby authorized to negotiate a
contract for the repair of the blockage in the sanitary sewer system herein-
before described and the Mayor and City Manager are hereby authorized an
behalf of the City to execute all necessary instruments for such materials,
equipment, and construction work as may be necessary.
Section 4. This ordinance shall take effect immediately upon its
passage, without publication, on the date hereof.

equivalent in printed space to at least 900 square inches (2) Said newspaper is a weekly and
is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted
to news of local interest to the community which it purports to serve and does not wholly
duplicate any other publication and is not made up entirely of patents, plate matter and

to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of

State of Minnesota prior to January 1, 1986 and each January 1 thereafter an affidavit in the
form prescribed by the Secretary of State and signed by the publisher of said newspaper and
sworn to before a notary public stating that the newspaper is a legal newspaper

within two or three inches of the
top thereof in such a manner as
to block the flow of sewerage
therein
4 That as a result of the fore-
going it is now. necessary to re-
pair the said sanitary sewer by
the removal of such materials at
an engineer's estimated cost in
the sum of approximately Thirty -
Five Hundred Dollars ($3500 00)
for work at a depth of approxi-
mately Sixteen (16) feet under
the level of the street which work
is beyond the capacity of pres-
ently owned city equipment
5 That the plugging of the
sewer as mentioned hereinbefore
constitutes a health hazard of
complete stoppage and backing

tary sewer system which threat
could result in public health prob-
lems at any time and which haz-
