AN ORDINANCE VACATING PUBLIC UTILITY EASEMENT
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. It is hereby determined that the City Council by its Resolution
No. 3493, has initiated public utility easement vacation proceedings with
respect to the public utility easement hereinafter described, and the Clerk
having published notice in the official newspaper, the St. Louis Park Sun,
met at the time and place as published in said notice and having conducted
a public hearing on said vacation and having determined that said public
utility easement is not needed for public purposes, and that it is for the
best interests of the public that said public utility easement be vacated.
Section 2. The following described public utility easement, as now
dedicated and laid out within the corporate limits of the City of St. Louis
Park, is hereby vacated:
An easement for storm sewer and drainage purposes over that portion of
Tract C, Registered Land Survey No. 900 described as follows: In and
over a strip of land 12 feet in width 6 feet on both sides of the following
described line: Commencing at the Northwest corner of said Tract C,
Registered Land Survey No. 900; thence South along the West line Tract C,
Registered Land Survey No. 900, 366.2 feet to the actual point of beginning
of the easement to be described; thence East at an angle of 90 degrees 00
minutes a distance of 150 feet to the East boundary line of Tract C,
Registered Land Survey No. 900.
Section 3. The City Clerk is hereby instructed to prepare a Notice of
Completion containing a copy of this ordinance and to file the same for record
forthwith in the office of the Register of Deeds or Registrar of Titles, in and
for the County of Hennepin, Minnesota, as the case may be.
Section 4. This ordinance shall take effect fifteen days after its publication.

W. JOHN BERTRAM, being duly sworn, on oath says he is and during all times here stated
has been the vice president and printer of the newspaper known as The St Louis Park Sun
and has full knowledge of the facts herein stated as follows: (1) Said newspaper
is printed in the English language in newspaper format and in column and sheet form
equivalent in printed space to at least 900 square inches (2) Said newspaper is a weekly and
is distributed at least once each week (3) Said newspaper has 50% of its news columns devoted
to news of local interest to the community which it purports to serve and does not wholly
duplicate any other publication and is not made up entirely of patents, plate matter and
advertisements. (4) Said newspaper is circulated in and near the municipality which it purports
to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of
at least 75% of its total circulation currently paid or no more than three months in arrears
and has entry as second-class matter in its local post -office (5) Said newspaper purports to
ve the City of St Louis Park in the County of Hennepin and it has its known office of
e in the City of Hopkins in said county, established and open during its regular business
urs for the gathering of news, sale of advertisements and sale of subscriptions and main-
tained by the managing officer or persons in its employ and subject to his direction and con–
trol during all such regular business hours and devoted exclusively during such regular
business hours to the business of the newspaper and business related thereto. (6) Said news-
paper files a copy of each issue immediately with the State Historical Society. (7) Said news-
paper has complied with all the foregoing conditions for at least two years preceding the day
or dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of
State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the
form prescribed by the Secretary of State and signed by the publisher of said newspaper and
sworn to before a notary public stating that the newspaper is a legal newspaper
