ORDINANCE NO. 1021
AN ORDINANCE AMENDING ORDINANCE NO. 743,
ADOPTED MARCH 28, 1960, ENTITLED "ORDINANCE
ESTABLISHING CONSTRUCTION CODE ADVISORY
COMMISSION AND DEFINING ITS DUTIES", RELATING
TO RENUMBERING OF SECTIONS AND TO MEMBERS
AND THEIR APPOINTMENT
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. The Building Construction Codes Advisory Commission is
hereby established as follows and its duties defined as follows:
Section 1:150. Membership and Terms.
Subd. 1. The Building Construction Codes Advisory Commission shall
consist of seven members, one ex officio member as set forth in Subd. Z
hereof, and six regular members who shall be qualified by training and
experience to pass upon matters pertaining to building construction, who
shall serve respectively for the following terms, and until their respective
successors are appointed and qualified. The term of office of the present
five regular members shall remain unchanged. The initial appointment of
the sixth regular member shall be for a term of five years ending December
31, 1972 and until his successor is appointed and qualifies, and all subsequent
appointments shall be for terms of five years each. They shall be appointed'
by the City Council, and their terms shall run until the 31st of December of
the year in which their terms expire. In the event of a vacancy the Council
shall appoint a person to complete the unexpired term. A member of the
Commission may be removed with or without cause by the City Council.
Subd. 2. One voting member, who shall be a member of the City Council
shall be appointed bI the City Council for a one year term. No Council
member shall serve as an ex officio member for more than two consecutive
years. Such member shall be appointed as soon as practicable after the
1st day of January of each year to serve until the 31st day of December of
that year and until his successor shall qualify.
Subd. 3. The Fire Chief of the City of St. Louis Park shall be a non-
voting member of the Board.
Subd.-4. The Building Inspector of the City of St. Louis Park shall be
a non-voting member and shall act as Secretary of the Board.
Section 1:151. Organization. The commission shall elect its own
chairman by vote of its members and shall provide its own rules and
procedure, determine date and time of meetings, and call public hearings

when necessary and desirable. The Commission shall render all recom-
mendations and findings in writing and shall file the same with the City
Manager for reference to the City Council and Building Inspector No
member of the Commission shall pass upon any question in which he is
directly or indirectly interested.
Section 1:152. The Building Construction Codes Advisory Com-
mission shall have the following powers and duties:
Subd. 1. To hear and recommend proper action to the City Council
on appeals from any order, requirement, permit, decision or refusal
or determination made by the Building Inspector, under the Building,
Plumbing, Heating, Gas Piping, Electrical Code Ordinances, and from
any interpretation of the text of the said Ordinances, made by the Building
Inspector.
Subd. 2. To study and review new types of materials, methods
and construction, and to advise the Building Inspector and the City Council
as to the suitability of alternate materials and types of construction to
assist in progressive development of the provisions of the Building,
Plumbing, Heating, Gas Piping and Electrical Codes of the City of St. Louis
Park, and to make recommendations relative thereto.
Subd. 3. To study and review from time to time the Building,
Plumbing, Heating, Gas Piping and Electrical Codes of the City of St.
Louis Park and similar code provisions applicable in communities sur-
rounding the City of St. Louis Park and such other codes as may come to
their attention, and to recommend to the City Council such new legislation
as to the Commission may seem desirable.
Subd. 4. To consider matters referred to the Commission by the
City Council or by the Building Inspector and make recommendations
relative thereto.
Subd. 5. To consider ana review special exceptions to the terms
of the Building, Plumbing, Heating, Gas Piping and Electrical Code
Ordinances wherever the terms are indefinite, and when the same shall
require an amendment, supplement, or change in the Building, Plumbing,
Heating, Gas Piping and Electrical Codes, to report the same to the City
Council for action.

Subd. 6. To act in advisory capacity to the City Council in all matters
pertaining to the formation, enforcement, amendment, supplement, or
change in the Building, Plumbing, Heating, Gas Piping and Electrical Codes,
or any Resolution, rule or regulation covering powers assigned to the City
Council by the City Charter and legislature of the State, concerning Building
Construction Codes matters.
Section 2. This ordinance shall take effect fifteen days after its publication.

W JOHN BERTRAM, bemg duly sworn, on oath says he is and during all the times herein stated
has been the general manager and printer of the newspaper known as The St Louis Palk
Dispatch and has full knowledge of the facts herein stated as follows• (1) Said newspaper is
printed in the English language in newspaper format and in column and sheet form
equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and
is distributed at least once each week (3) Said newspaper has 50% of its news columns devoted
to news of local interest to the community which it purports to serve and does not wholly
duplicate any other publication and is not made up entirely of patents, plate matter and
advertisements (4) Said newspaper is circulated in and near the municipality which it purports
to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of
at least 75% of its total circulation currently paid or no more than three months in arrears
and has entry as second-class matter in its local post -office (5) Said newspaper purports to
serve the City of St Louis Park in the County of Hennepin and it has its known office of
issue in the City of Hopkins in said county, established and open during regular business
hours for the gathering of news, sale of advertisements and sale of subscriptions and main-
tained by the managing officer or persons in its employ and subject to his direction and con-
trol during all such regular business hours and devoted exclusively during such regular
business hours to the business of the newspaper and.!business related thereto (6) Said news-
paper files a copy of each issue immediately with the State Historical Society (7) Said news-
paper has complied with all the foregoing conditions for at least two years preceding the day
or dates of publication mentioned below (8) Said 'newspaper has filed with the Secretary of
State of Minnesota prior to January 1. 1966 and each January 1 thereafter an affidavit in the
form prescribed by the Secretary of State and signed by the publisher of said newspaper and
sworn to before a notary public stating that the newspaper is a legal newspaper
